LEGISLATIVE INTENT 10 (a) It is the intent of the General Assembly that of the $111,965,288.44 11 authorized in this act, not more than $61,614,761.44 shall be appropriated in 12 the first year of the biennium, and the remainder shall be appropriated in the 13 second year. 14 (b) It is the intent of the General Assembly that in the second year of the 15 biennium, any amendments to the appropriations or authorities granted in this 16 act shall take the form of the Capital Construction and State Bonding 17 Adjustment Bill. not reallocated in this act that were appropriated in the 15 following capital construction acts: 16 (1) 2017 Acts and Resolves No. 84, Sec. 11(f)(2)(A), as added by 17 2018 Acts and Resolves No. 190, 7 Program); and 8 (2) 2017 Acts and Resolves No. 84, Sec. 11(l), as added by 2018 Acts 9 and Resolves No. 190, Sec. 8 (Municipal Mitigation Program). 10 Bonded Dollars $5,074,938.48 11 Cash GENERAL OBLIGATION BONDS AND APPROPRIATIONS 14 (a) The State Treasurer is authorized to issue general obligation bonds in 15 the amount of $100,000,000.00 for the purpose of funding the appropriations 16 made in Secs. 2–16 of this act. The State Treasurer, with the approval of the 17 Governor, shall determine the appropriate form and maturity of the bonds 18 authorized by this section consistent with the underlying nature of the 19 appropriation to be funded. 20 BILL AS INTRODUCED H.494 2025 Page 24 of 31 VT LEG #381494 v.7 (b) The State Treasurer is authorized to issue additional general obligation 1 bonds in the amount of $6,890,350.00 that were previously appropriated but 2 unissued under 2023 Acts and Resolves No. 69, as amended by 2024 Acts and 3 Resolves No. 162, for the purpose of funding the appropriations in this act. 4 Total Revenues – Section 18 $106,890,350.00 5 Sec. 19. FY 2026 AND 2027; CAPITAL PROJECTS; FY 2026 6 APPROPRIATIONS ACT; INTENT; AUTHORIZATIONS 7 (a) Findings. The General Assembly finds that in addition to the issuance 8 of general obligation bonds, eligible capital projects may be funded from the 9 Fund established in 32 V.S.A. § 1001b. 10 (b) Intent. It is the intent of the General Assembly to authorize certain 11 capital projects eligible for funding by 32 V.S.A. § 1001b in this act but 12 appropriate the funds for these projects in the FY 2026 Appropriations Act. It 13 is also the intent of the General Assembly that the FY 2026 Appropriations Act 14 appropriate funds to the Fund established in 32 V.S.A. § 1001b for projects in 15 FY 2027. 16 (c) Authorizations; Capital Infrastructure subaccount. CAPITAL CONSTRUCTION BILL 13 * * * 14 (d)(1) On or before November 15 each year, the Commissioner of Finance 15 and Management shall require each entity to which spending authority has 16 been authorized by a capital construction act enacted in a legislative session 17 that was two or more years prior to the current legislative session to submit a 18 report on the current fund balances of each authorized project with unexpended 19 funds. FORM OF ANNUAL CAPITAL BUDGET AND 10 -YEAR 10 CAPITAL PROGRAM PLAN 11 * * * 12 (b) The capital budget request for the following biennium shall be 13 presented as the next increment of the 10-year plan. Elements of the plan shall 14 include: 15 * * * 16 (2) Comprehensive cost and financing assessment. 17 (A) Amounts appropriated and expended for the current fiscal year 18 and for the preceding fiscal year shall be indicated for capital programs and for 19 individual projects. The assessment shall indicate further the source 3 of funds for any project that required additional funding and a description of 4 any authorized projects that were delayed. 5 * * * 6 Sec. 22. 32 V.S.A. § 1001b is amended to read: 7 § 1001b. CASH FUND FOR CAPITAL AND ESSENTIAL INVESTMENTS 8 * * * 9 (e) Spending authority. Any entity authorized to make expenditures from 10 the Capital Infrastructure subaccount shall have not more than two three years 11 from the end of the legislative session in which the act authorizing the 12 expenditure was enacted to encumber the funds. TRANSFER OF RANDALL MEADOW PROPERTY IN THE 16 TOWN OF WATERBURY 17 Notwithstanding 29 V.S.A. § 166(b), the Commissioner of Buildings and 18 General Services is authorized to survey, subdivide, and transfer to the Town 19 of Waterbury the portion of land in the Waterbury State Office Complex 20 (Parcel ID # 69622111909 as designated on the Town of Waterbury’s Tax 21 BILL AS INTRODUCED H.494 2025 Page 29 of 31 VT LEG #381494 v.7 Parcel Maps) that is commonly referred to as the “Randall Meadow,” provided 1 that the Commissioner may transfer the Randall Meadow property only once: 2 (1) the parcel has been subdivided to reflect stormwater management 3 needs of the Waterbury State Office Complex to the satisfaction of the 4 Commissioner; 5 (2) any permits required for transfer have been obtained; and 6 (3) the Commissioner and the Town of Waterbury have created a plan to 7 align the transfer with the current lease for the parcel. 8 Sec. 24. 2024 Acts and Resolves No. 162, Sec. 27 is amended to read: 9 Sec. 27.
