Statementofpurposeofbillasintroduced:Thisbillproposestoprovide
additionaltimefortheadministrationofextraditionwarrantsandtoexpedite
theextraditionofpersonswhohavebrokenthetermsofbail,probation,
parole,orotherreleaseinanotherstate.
Anactrelatingtoextraditionprocedures
ItisherebyenactedbytheGeneralAssemblyoftheStateofVermont:
Sec.1.13V.S.A.§ 4955isamendedtoread:
§4955.COMMITMENT TOAWAITEXTRADITION;BAIL
Ifuponexaminationitappearsthatthepersonheldisthepersoncharged
withhavingcommittedthecrimeallegedandthatthepersonprobably
committedthecrime,and,exceptincasesarisingundersection4946ofthis
title,thatthepersonhasfledfromjustice,thejudgeormagistrateshallcommit
thepersontojailbyawarrant,recitingtheaccusation,forsuchatime,not
exceeding30120days,tobespecifiedinthewarrantaswillenablethearrest

oftheaccusedtobemadeunderawarrantoftheGovernoronarequisitionof
theexecutiveauthorityofthestatehavingjurisdictionoftheoffense,unless
theaccusedgivebailasprovidedinsection4956ofthistitle,oruntilthe
personshallbelegallydischarged.Onrequestofthestate,thehearingmaybe
continuedforuptothreeworkingbusinessdays,onlyforthepurposeof
determiningwhetherthepersonprobablycommittedthecrime.Findings
underthissectionmaybebaseduponhearsayevidenceoruponcopiesof
affidavits,whethercertifiedornot,madeoutsidethisState.Itshallbe
sufficientforafindingthatapersonprobablycommittedthecrimethatthereis
acurrentgrandjuryindictmentfromanotherstate.
Sec.2.13V.S.A.§ 4967isamendedtoread:
§4967.WRITTENWAIVEROFEXTRADITIONPROCEEDINGS
(a)AnypersonarrestedinthisStatechargedwithhavingcommittedany
crimeinanotherstateorallegedtohaveescapedfromconfinement,orbroken
thetermsofhisorherbail,probation,orparolemaywaivetheissuanceand
serviceofthewarrantprovidedforinsections4947and4948ofthistitleand
allotherprocedureincidentaltoextraditionproceedings,byexecutingor
subscribinginthepresenceofajudgeofanycourtofrecordwithinthisStatea
writingthatstatesthatheorshethepersonconsentstoreturntothedemanding
state;providedhowever,beforesuchthewaivershallbeisexecutedor
subscribedbysuchthepersonitshallbethedutyofsuch,thejudgetoshall

informsuchthepersonofhisorhertherightsrighttotheissuanceandservice
ofawarrantofextraditionandtoobtainawritofhabeascorpusasprovided
forinsection4950ofthistitle.
(b)Ifandwhensuchconsenthasbeendulyexecuted,itshallforthwithbe
forwardedtotheofficeoftheGovernorofthisStateandfiledtherein.The
judgeshalldirecttheofficerhavingsuchpersonincustodytodeliverforthwith
suchpersontothedulyaccreditedagentoragentsofthedemandingstate,and
shalldeliverorcausetobedeliveredtosuchagentoragentsacopyofsuch
consent;providedhowever,thatnothinginthissectionshallbedeemedto
limittherightsoftheaccusedpersontoreturnvoluntarilyandwithout
formalitytothedemandingstate,norshallthiswaiverprocedurebedeemedto
beanexclusiveprocedureortolimitthepowers,rightsordutiesoftheofficers
ofthedemandingstateorofthisState.
(c)Notwithstandinganyotherprovisionoflaw,alawenforcementagency
inthisStateholdingapersonwhoisallegedtohavebrokenthetermsofthe
person’sprobation,parole,bail,oranyotherreleaseinthedemandingstate
shallimmediatelydeliverthatpersontothedulyauthorizedagentofthe
demandingstatewithouttherequirementofaGovernor’swarrantifallofthe
followingapply:

(1)Thepersonhassignedapriorwaiverofextraditionasatermofthe
person’scurrentprobation,parole,bail,orotherreleaseinthedemanding
state.
(2)Thelawenforcementagencyholdingthepersonhasreceivedan
authenticatedcopyofthepriorwaiverofextraditionsignedbythepersonand
photographsorfingerprintsorotherevidenceproperlyidentifyingtheperson
asthepersonwhosignedthewaiver.
(3)ExceptastheState’sAttorneyshallotherwisedetermineinthe
interestofjustice,allopencriminalchargesinthisStatehavebeendisposedof
throughtrialandsentencing.
Sec.3.13V.S.A.§ 5043isamendedtoread:
§5043.HEARING,COMMITMENT,DISCHARGE
(a)IfanarrestismadeinthisStatebyanofficerofanotherstatein
accordancewiththeprovisionsofsection5042ofthistitle,heorsheshallthe
officer,withoutunnecessarydelay,shalltakethepersonarrestedbeforea
Superiorjudgeoftheunitinwhichthearrestwasmade,whoshallconducta
hearingforthepurposeofdeterminingthelawfulnessofthearrest.
(b)Ifthejudgedeterminesthatthearrestwaslawful,heorshethejudge
shallcommitthepersonarrestedtoawaitforareasonabletimetheissuanceof
anextraditionwarrantbytheGovernorofthisStatewithin120daysoradmit
suchpersontobailpendingtheissuanceofsuchwarrant.Thejudgeshall

considertheissuanceofajudicialwarrantforthearrestofthepersonwhohas
fledjusticetoVermontfromanotherstatewhendeterminingtheriskofflight
fromprosecution.
(c)Ifthejudgedeterminesthatthearrestwasunlawful,heorshethejudge
shalldischargethepersonarrested.
Sec.4.EFFECTIVEDATE
Thisactshalltakeeffectonpassage.
Sec.1.13V.S.A.§ 4955isamendedtoread:
§4955.COMMITMENTTOAWAITEXTRADITION;BAIL
Ifuponexaminationitappearsthatthepersonheldisthepersoncharged
withhavingcommittedthecrimeallegedandthatthepersonprobably
committedthecrime,and,exceptincasesarisingundersection4946ofthis
title,thatthepersonhasfledfromjustice,thejudgeormagistrateshallcommit
thepersontojailbyawarrant,recitingtheaccusation,forsuchatime,not
exceeding3090days,tobespecifiedinthewarrantaswillenablethearrestof
theaccusedtobemadeunderawarrantoftheGovernoronarequisitionof
theexecutiveauthorityofthestatehavingjurisdictionoftheoffense,unlessthe
accusedgivebailasprovidedinsection4956ofthistitle,oruntiltheperson
shallbelegallydischarged.Onrequestofthestate,thehearingmaybe
continuedforuptothreeworkingbusinessdays,onlyforthepurposeof
determiningwhetherthepersonprobablycommittedthecrime.Findings
underthissectionmaybebaseduponhearsayevidenceoruponcopiesof
affidavits,whethercertifiedornot,madeoutsidethisState.Itshallbe
sufficientforafindingthatapersonprobablycommittedthecrimethatthereis
acurrentgrandjuryindictmentfromanotherstate.
Sec.2.13V.S.A.§ 4957isamendedtoread:
§4957.EXTENDINGTIMEOFCOMMITMENT
IftheaccusedisnotarrestedunderwarrantoftheGovernorbythe
expirationofthetimespecifiedinthewarrant,bond,orundertaking,such
judgemaydischargehimorherormayrecommithimorhertheaccusedfora
furtherperiodnottoexceed6030days,ormayagaintakebailforhisorher
theaccused’sappearanceandsurrenderasprovidedinsection4956ofthis

title,butwithinaperiodnottoexceed6030daysafterthedateofsuchnew
bond.
Sec.3.13V.S.A.§ 4967isamendedtoread:
§4967.WRITTENWAIVEROFEXTRADITIONPROCEEDINGS
(a)AnypersonarrestedinthisStatechargedwithhavingcommittedany
crimeinanotherstateorallegedtohaveescapedfromconfinement,orbroken
thetermsofhisorherbail,probation,orparolemaywaivetheissuanceand
serviceofthewarrantprovidedforinsections4947and4948ofthistitleand
allotherprocedureincidentaltoextraditionproceedings,byexecutingor
subscribinginthepresenceofajudgeofanycourtofrecordwithinthisStatea
writingthatstatesthatheorshethepersonconsentstoreturntothe
demandingstate;provided,however,beforesuchthewaivershallbeis
executedorsubscribedbysuchthepersonitshallbethedutyofsuch,the
judgetoshallinformsuchthepersonofhisorhertherightsrighttothe
issuanceandserviceofawarrantofextraditionandtherighttoobtainawrit
ofhabeascorpusasprovidedforinsection4950ofthistitle.
(b)Ifandwhensuchconsenthasbeendulyexecuted,itshallforthwithbe
forwardedtotheofficeoftheGovernorofthisStateandfiledtherein.The
judgeshalldirecttheofficerhavingsuchpersonincustodytodeliverforthwith
suchpersontothedulyaccreditedagentoragentsofthedemandingstate,and
shalldeliverorcausetobedeliveredtosuchagentoragentsacopyofsuch
consent;provided,however,thatnothinginthissectionshallbedeemedto
limittherightsoftheaccusedpersontoreturnvoluntarilyandwithout
formalitytothedemandingstate,norshallthiswaiverprocedurebedeemedto
beanexclusiveprocedureortolimitthepowers,rights,ordutiesofthe
officersofthedemandingstateorofthisState.
(c)Notwithstandinganyotherprovisionoflaw,alawenforcementor
correctionsagencyinthisStateholdingapersonwhoisallegedtohavebroken
thetermsoftheperson’sprobation,parole,bail,oranyotherreleaseinthe
demandingstateshallimmediatelydeliverthatpersontothedulyauthorized
agentofthedemandingstatewithouttherequirementofaGovernor’swarrant
ifallofthefollowingapply:
(1)Thepersonhassignedapriorwaiverofextraditionasatermofthe
person’scurrentprobation,parole,bail,orotherreleaseinthedemanding
state.
(2)Thelawenforcementorcorrectionsagencyholdingthepersonhas
receivedanauthenticatedcopyofthepriorwaiverofextraditionsignedbythe

thepersonasthepersonwhosignedthewaiver.Thesedocumentsmaybe
receivedbyreliableelectronicmeans.
(3)ExceptastheState’sAttorneyshallotherwisedetermineinthe
interestofjustice,allopencriminalchargesinthisStatehavebeendisposedof
throughtrialandsentencing.
Sec.4.13V.S.A.§ 5043isamendedtoread:
§5043.HEARING,COMMITMENT,DISCHARGE
(a)IfanarrestismadeinthisStatebyanofficerofanotherstatein
accordancewiththeprovisionsofsection5042ofthistitle,heorsheshallthe
officer,withoutunnecessarydelay,shalltakethepersonarrestedbeforea
Superiorjudgeoftheunitinwhichthearrestwasmade,whoshallconducta
hearingforthepurposeofdeterminingthelawfulnessofthearrest.
(b)Ifthejudgedeterminesthatthearrestwaslawful,heorshethejudge
shallcommitthepersonarrestedtoawaitforareasonabletimetheissuanceof
anextraditionwarrantbytheGovernorofthisStatewithin90daysoradmit
suchpersontobailpendingtheissuanceofsuchwarrant.Thejudgeshall
considertheissuanceofajudicialwarrantforthearrestofthepersonwhohas
fledjusticetoVermontfromanotherstatewhendeterminingtheriskofflight
fromprosecution.
(c)Ifthejudgedeterminesthatthearrestwasunlawful,heorshethejudge
shalldischargethepersonarrested.
Sec.5.EFFECTIVEDATE
Thisactshalltakeeffectonpassageandshallapplyprospectivelyandnot
affectextraditionsinprocessatthetimeofenactment.
