2023 SENATE BILL 109 
Current law prohibits the operation of all-terrain vehicle (ATV) or utility terrain vehicle (UTV) upon any 
part of a freeway which is part of the federal system of interstate and defense highways and, subject to 
certain exceptions, upon any part of any other freeway unless the Department of Transportation 
authorizes the use of that vehicle on the freeway. Current law exempts from these restrictions the 
operator of an ATV or UTV owned by a municipality, state agency, or public utility, or by the Great 
Lakes Indian Fish and Wildlife Commission (GLIFWC) while the operator is engaged in an emergency 
or in the operation of an ATV or UTV directly related to the functions of the municipality, state agency, 
or public utility, or of GLIFWC, if safety does not require strict adherence to the restrictions.  
2023 Senate Bill 109 exempts the operator of an ATV or UTV owned by an electric cooperative from the 
restrictions described above under the same circumstances as apply to the operator of an ATV or UTV 
owned by a municipality, state agency, or public utility, or by GLIFWC. 
SENATE AMENDMENT 1 
Senate Amendment 1 to 2023 Senate Bill 109 also exempts from the restrictions above the operator of 
an ATV or UTV while the operator is engaged in activities at the direction of and under contract with a 
municipality or an electric cooperative, if safety does not require strict adherence to the restrictions.

Senator Wanggaard offered Senate Amendment 1 to Senate Bill 109 on May 1, 2023. On October 6, 
2023, the Senate Committee on Transportation and Local Government voted unanimously to 
recommend adoption of Senate Amendment 1 and passage of Senate Bill 109, as amended.
