Wisconsin Legislative Council ACT MEMO One Ea st Ma in Stre e t, Suite 401 • Ma dison, W I 53703 • (608) 266-1304 • le g.council@le gis.wisconsin.gov • http://www.le gis.wisconsin.gov/lc Prepared by: David Moore, Senior Staff Attorney December 13, 2023 2023 Wisconsin Act 64 [2023 Senate Bill 109] Operation of All-Terrain and Utility Terrain Vehicles by a Municipality or Electric Cooperative Wisconsin law prohibits the operation of an all-terrain vehicle (ATV) or utility terrain vehicle (UTV) upon any part of a freeway which is part of the federal system of interstate and defense highways and, subject to certain exceptions, upon any part of any other freeway unless the Department of Transportation authorizes the use of that vehicle on the freeway. The operator of an ATV or UTV owned by a municipality, state agency, or public utility, or by the Great Lakes Indian Fish and Wildlife Commission (GLIFWC) is exempt from these restrictions while the operator is engaged in an emergency or in the operation of an ATV or UTV directly related to the functions of the municipality, state agency, or public utility, or of GLIFWC, if safety does not require strict adherence to the restrictions. 2023 Wisconsin Act 64 exempts the operator of an ATV or UTV owned by an electric cooperative from the restrictions described above under the same circumstances as apply to the operator of an ATV or UTV owned by a municipality, state agency, or public utility, or by GLIFWC. The act also exempts from these restrictions the operator of an ATV or UTV while the operator is engaged in activities at the direction of and under contract with a municipality or an electric cooperative, if safety does not require strict adherence to the restrictions.
