The bill specifies that “fluid milk product,” for this purpose, includes raw milk and liquid and milk products and byproducts, including liquid whey and whey byproducts. Under the bill, DOT may not impose different conditions for permits issued for different fluid milk products. SENATE SUBSTITUTE AMENDMENT 1 Senate Substitute Amendment 1 also allows DOT to issue annual or consecutive month permits for the transportation of fluid milk product in vehicle combinations that exceed the maximum gross weight limitations subject to various requirements. As under the bill, under the substitute amendment, fluid milk product includes raw milk and liquid and milk products and byproducts, including liquid whey and whey byproducts. The substitute amendment provides that a permit issued under the bill’s provisions does not apply on any highway that is part of the national system of interstate and defense highways. It also prohibits DOT from differentiating between types of fluid milk product in imposing permit conditions. Finally, the substitute amendment allows DOT to suspend a fluid milk permit if the person operating under the permit does any of the following: Violates any weight limitation specified in the permit more than two times during the valid period of the permit. Violates any weight limitation specified in the permit by exceeding the weight limitation by 10,000 or more pounds. Under the substitute amendment, the suspension shall be for a period of six months. BILL HISTORY Senator Ballweg offered Senate Substitute Amendment 1 to Senate Bill 431 on November 7, 2023. On November 9, 2023, the Senate Committee on Transportation and Local Government voted unanimously to recommend adoption of the substitute amendment and passage of the bill, as amended.
