2023 Wisconsin Act 158
[2023 Senate Bill 431]
Overweight Transportation of
Certain Fluid Milk Products
2023 Wisconsin Act 158 allows the Department of Transportation (DOT) to issue annual or consecutive
month permits for the transportation of fluid milk product in vehicle combinations that exceed the
maximum gross weight limitations subject to various requirements. For this purpose, “fluid milk
product” includes raw milk and liquid and milk products and byproducts, including liquid whey and
whey byproducts. A permit issued under the act’s provisions does not apply on any highway that is part
of the national system of interstate and defense highways.
Under the act, DOT may not differentiate between types of fluid milk product in imposing permit
conditions. DOT may, however, suspend a fluid milk permit, for a period of six months, if the person
operating under the permit does any of the following:
 Violates any weight limitation specified in the permit more than two times during the valid period of
the permit.
 Violates any weight limitation specified in the permit by exceeding the weight limitation by 10,000
or more pounds.
Effective date: March 23, 2024
