2023 SENATE BILL 626 
2023 Senate Bill 626 eliminates the provision of current law that prohibits the remote notarization of 
documents that create or execute powers of attorney. This would generally permit individuals to engage 
in remote notarization transactions for the purposes of creating or executing any powers of attorney.    
SENATE SUBSTITUTE AMENDMENT 1  
Senate Substitute Amendment 1 creates an exception to the current prohibition on the use of remote 
notarization for the purposes of the creation or execution of powers of attorney for a limited financial 
power of attorney for a real estate transaction. This would generally permit individuals to engage in 
remote notarization for the purposes of powers of attorney for real estate transactions only.

Senate Substitute Amendment 1 was offered by Senator Quinn on December 11, 2023. The Senate 
Committee on Financial Institutions and Sporting Heritage recommended both the adoption of Senate 
Substitute Amendment 1, and the passage of Senate Bill 626 as amended, by vote of Ayes, 5; Noes, 0; on 
January 5, 2024.
