[2023 Senate Bill 626] 
Remote Notarization 
CURRENT LAW 
Current law generally permits a notary public to perform a notarization remotely for certain specified 
transactions. Remote notarization, however, is generally not permitted for the purposes of transactions 
related to the creation and execution of wills and trusts; marital property agreements; health care 
powers of attorney; and other powers of attorney unless the transaction is between two or more persons 
relating to the conduct of business, commercial, or governmental affairs. 
2023 WISCONSIN ACT 129 
2023 Wisconsin Act 129 creates an exception to the general prohibition on remote notarization of 
powers of attorney, permitting remote notarization of a limited financial power of attorney for a real 
estate transaction. 
Effective date: March 23, 2023
