Value-Based Purchasing 
Arrangements Under the Medical 
Assistance Program 
2023 WISCONSIN ACT 184 
2023 Wisconsin Act 184 allows the Department of Health Services (DHS) to enter into a value-based 
purchasing arrangement for the Medical Assistance program with a drug manufacturer based on 
agreed-upon metrics to which DHS and the manufacturer agree in writing. 
The act provides that a value-based purchasing arrangement may include rebates, discounts, price 
reductions, risk sharing, reimbursements, payment deferrals or installment payments, guarantees, 
shared savings payments, withholds, bonuses, or any other thing of value.  
The act specifies that DHS must seek any necessary approval from the federal government, and DHS is 
not required to implement the act if any necessary approval is not granted. 
Effective date: March 24, 2024
