2023 Senate Bill 773 Senate Amendment 1 
2023 SENATE BILL 773 
2023 Senate Bill 773 makes a number of changes to activities and powers of credit union, bank, savings 
bank and savings and loan institutions, including the creation of a crime of interference with an 
automated teller machine (ATM). Under the bill, whoever intentionally causes impairment or 
interruption of use, in whole or in part, of a financial institution’s ATM or customer bank 
communications terminal is guilty of a Class H felony. 
SENATE AMENDMENT 1 
Senate Amendment 1 deletes the requirement that the ATM or customer bank communications 
terminal belong to a financial institution for interference with such a machine to qualify as a crime.

Financial Institutions and Sporting Heritage recommended both the adoption of Senate Amendment 1, 
and passage of Senate Bill 773 as amended, by votes of Ayes, 5; Noes, 0; on January 5, 2024.
