2023 Senate Bill 868 Senate Amendment 1 
2023 SENATE BILL 868 
Senate Bill 868 requires the Department of Revenue (DOR) to place on income tax forms a method by 
which a resident of this state who is 15 years of age or older, or an emancipated minor, may elect to 
include his or her name as a donor of an anatomical gift in the donor registry maintained by the 
Department of Transportation (DOT). The bill requires DOR to transmit certain information about 
applicants who elect to be included in the donor registry to DOT, and requires DOT to record donor 
authorizations received from DOR in the donor registry even if the person does not have an operator’s 
license or identification card issued by DOT.  
The bill also adds DOR to the list of state agencies that must cooperate with DHS in establishing a 
donor registry. 
SENATE AMENDMENT 1 
The amendment adds material to the statutory section on amending or revoking an anatomical gift 
before a donor’s death to specify that a donor may not revoke an anatomical gift by declining to 
authorize inclusion of his or her name in the donor registry when applying for or renewing a driver’s 
license or identification card, when applying for a hunting, fishing, or trapping license, or when filing an 
income tax form unless the donor expressly indicates his or her intent to have his or her name removed 
from the donor registry.

Committee on Health recommended adoption of the amendment, and passage of the bill, as amended, 
on votes of Ayes, 6; Noes, 0.
