AN ACT to repeal 175.095; to amend 125.32 (3) (a), 125.68 (4) (c) 1. and 990.001 (12) of the statutes; relating to: eliminating daylight saving time in Wisconsin. Analysis by the Legislative Reference Bureau This bill eliminates daylight saving time. Current law defines standard time and provides that daylight saving time begins at 2 a.m. on the second Sunday in March and ends at 2 a.m. on the first Sunday in November of each year. Federal law generally preempts states from deviating from standard time or eliminating daylight saving time, but federal law allows a state that lies entirely in one timezone, such as Wisconsin, to observe standard time instead of daylight saving time as long as the observation is throughout the entire state. The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. 125.32 (3) (a) of the statutes is amended to read: 125.32 (3) (a) No premises for which a Class XBY license or permit is issued may remain open between the hours of 2 a.m. and 6 a.m., except as provided in this 1 2 3 4 5 6 2025 - 2026 Legislature ASSEMBLY BILL 160 - 2 - LRB-2451/1 CMH&FFK:cdc SECTION 1 paragraph and par. (c). On Saturday and Sunday, the closing hours shall be between 2:30 a.m. and 6 a.m. except that, on the Sunday that daylight saving time begins as specified in s. 175.095 (2), the closing hours shall be between 3:30 a.m. and 6 a.m. On January 1 premises operating under a Class XBY license or permit are not required to close. SECTION 2. 125.68 (4) (c) 1. of the statutes is amended to read: 125.68 (4) (c) 1. Subject to subds. 3. and 6. and s. 125.51 (3r) (a) 3., no premises for which a XClass BY license or permit or a XClass CY license has been issued may remain open between the hours of 2 a.m. and 6 a.m., except as otherwise provided in this subdivision and subd. 4. On January 1 premises operating under a XClass BY license or permit are not required to close. On Saturday and Sunday, no premises may remain open between 2:30 a.m. and 6 a.m. except that, on the Sunday that daylight saving time begins as specified in s. 175.095 (2), no premises may remain open between 3:30 a.m. and 6 a.m. This subdivision does not apply to a XClass BY license issued to a winery under s. 125.51 (3) (am). SECTION 3. 175.095 of the statutes is repealed. SECTION 4. 990.001 (12) of the statutes is amended to read: 990.001 (12) TIME. When time is referred to, the standard of time as provided by s. 175.09 or 175.095, whichever is applicable, is meant. SECTION 5. Effective date.
