A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated ยง18A-4-10b, relating to providing an optional lump sum payment of accrued personal leave to full-time employees of a county school board upon the ending of full-time employment due to death, establishing a cap for payment, clarifying deductions and contributions, and providing time frame for payment.

Be it enacted by the Legislature of West Virginia:

 

##  ARTICLE 4. SALARIES, WAGES AND OTHER BENEFITS.

ends due to death, may be paid in a lump sum amount to the personal representative of the estate of the employee for accrued and unused personal leave at the employee's usual rate of pay at the time the employment ends: Provided, That the lump sum payment may not exceed $6000. 

(b) The lump sum payments may not include deductions for contributions toward retirement and may not be a part of final average salary computation.

(c) The lump sum payment shall be made within one month after the request.
