Smith, Pritt, and Masters Introduced February 25, 2025; referred to the Committee on Government Organization then the Judiciary A BILL to amend the Code of West Virginia, 1931, as amended, by adding a new section, designated ยง17C-13-9, relating to prohibiting parking meters at handicapped spaces and eliminating late or overdue parking tickets for individuals with disabilities. Be it enacted by the Legislature of West Virginia: ## ARTICLE 13. STOPPING, STANDING AND PARKING. (a) Legislative findings and purpose. โ (1) The Legislature finds that individuals with disabilities often face financial and mobility challenges that make parking accessibility a necessity. (2) It is in the public interest to remove unnecessary financial burdens on individuals with disabilities regarding parking accessibility. (3) This bill ensures that no parking meters shall be placed at designated handicapped parking spaces and that individuals with disabilities shall not be subject to late fees or penalties for overdue parking citations. (b) Prohibition of Parking Meters on Handicapped Spaces and Late Fees on Parking Citations for Individuals with Disabilities โ (1) No city, municipality, county, government organization, or any other public or private entity operating parking meters within the state shall install or maintain parking meters at any designated handicapped parking space, whether on public or private property. (2) Any existing parking meter located at a designated handicapped parking space shall be removed or disabled within 90 days of the enactment of this section. (3) An individual with a valid disabled parking placard or license plate issued by the West Virginia Division of Motor Vehicles shall not be subject to late fees, overdue penalties, or additional fines on unpaid parking citations. (4) Nothing in this section shall be construed to exempt individuals from receiving parking citations for parking violations unrelated to expired meters, including but not limited to unauthorized use of a handicapped space, parking in a fire lane, or obstructing traffic. (5) A violation of this section by any government entity or private organization shall result in a fine of up to $500 per offense. The West Virginia Attorney General shall have the authority to enforce this provision. (c) Effective Date. โ This section shall take effect immediately upon passage. NOTE: The purpose of this bill is to prohibit parking meters at handicapped spaces and eliminating late or overdue parking tickets for individuals with disabilities.
