A BILL expiring funds to the unappropriated surplus balance of the State Fund, General Revenue, for the fiscal year ending June 30, 2025, in the amount of $155,288,050 from the Governor’s Office- Civil Contingent Fund, fund 0105, fiscal year 2024, organization 0100, appropriation 85700, and supplementing and amending of public moneys out of the Treasury from the balance of moneys remaining as unappropriated surplus balance in the State Fund, General Revenue, to a new line item under the Higher Education Policy Commission , Administrative- Control Account, fund 0589, fiscal year 2025, organization 0441 by increasing the appropriations for the fiscal year ending June 30, 2025.
WHEREAS, The Legislature finds that the account balance in the Governor’s Office- Civil Contingent Fund exceeds that which is necessary for the purposes for which the account was established; and
WHEREAS, The Governor submitted the Executive Budget Document to the Legislature on February 12, 2025, containing a statement of the State Fund, General Revenue, setting forth therein the cash balance as of July 1, 2024, and further included the estimate of revenue for the fiscal year 2025, less net appropriation balances forwarded and regular and surplus appropriations for the fiscal year 2025, and further included recommended supplemental appropriations from the balance of the State Fund, General Revenue; and
WHEREAS, It appears from the Governor’s Statement of the State Fund, General Revenue, there now remains an unappropriated balance in the Treasury which is available for appropriation during the fiscal year ending June 30, 2025; therefore
Be it enacted by the Legislature of West Virginia:
That the balance of the funds available for expenditure in the fiscal year ending June 30, 2025, Governor’s Office- Civil Contingent Fund, fund 0105, fiscal year 2024, organization 0100, appropriation 87500, be decreased by expiring the amount of $155,288,050 to the unappropriated surplus balance of the State Fund, General Revenue, to be available for appropriation during the fiscal year 2025.
And, That the total appropriation for the fiscal year ending in June 30, 2025, to fund 0589, fiscal year 2025, organization 0441 be supplemented and amended by adding a new line item of appropriation and increasing that line item as follows:
