WEST virginia legislature 2025 regular session Enrolled Committee Substitute for Senate Bill 336 By Senator Woodrum [Passed March 20, 2025; in effect from passage] AN ACT to amend and reenact §64-6-1 et seq. of the Code of West Virginia, 1931, as amended, relating to authorizing certain agencies of the Department of Homeland Security to promulgate legislative rules; authorizing the rules as filed and as modified by the Legislative Rule-Making Review Committee; authorizing the Governor’s Committee on Crime, Delinquency, and Correction to promulgate a legislative rule relating to the protocol for law-enforcement response to child abuse and neglect; authorizing the Governor's Committee on Crime, Delinquency, and Correction to promulgate a legislative rule relating to sexual assault forensic examinations; authorizing the Division of Protective Services to promulgate a legislative rule relating to the ranks and duties of officers within the membership of the division; authorizing the State Emergency Response Commission to promulgate a legislative rule relating to the Emergency Planning Grant Program; authorizing the West Virginia State Police to promulgate a legislative rule relating to cadet selection; and authorizing the West Virginia State Police to promulgate a legislative rule relating to the West Virginia State Police Career Progression System. Be it enacted by the Legislature of West Virginia: ## ARTICLE 6. Authorization for Department of Homeland Security to promulgate legislative rules. The legislative rule filed in the State Register on August 28, 2024, authorized under the authority of §15-2D-3 of this code, relating to the Division of Protective Services (ranks and duties of officers within the membership of the division, 99 CSR 02), is authorized. The legislative rule filed in the State Register on August 29, 2024, authorized under the authority of §15-5A-5 of this code, modified by the State Emergency Response Commission to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on October 1, 2024, relating to the State Emergency Response Commission (Emergency Planning Grant Program, 55 CSR 02), is authorized. On page 2, subdivision 3.2.11, by striking out the words “for two years”. The legislative rule filed in the State Register on August 28, 2024, authorized under the authority of §15-2-5 of this code, modified by the West Virginia State Police to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on October 1, 2024, relating to the West Virginia State Police (West Virginia State Police Career Progression System, 81 CSR 03), is authorized.
