Sponsored by: Joint Transportation, Highways & Military Affairs Interim Committee A BILL for 1 AN ACT relating to motor vehicles; amending expiration and 2 renewal of licenses for persons under twenty-one (21) years 3 of age; amending identification card contents; clarifying 4 the timeline for contested case hearings regarding 5 licenses; amending requirements for replacement licenses; 6 adding a fee for replacement licenses; repealing obsolete 7 provisions; providing rulemaking authority; and providing 8 for effective dates. 9 10 11 12. W.S. 31-7-105(e), 31-7-113(a) by creating 13 a new paragraph (xiii), 31-7-115(b), 31-7-118 and 14 31-8-102(a)(vii) are amended to read: 15 2025STATE OF WYOMING25LSO-02122HB00301 2 3 (e) The licensee has twenty (20) days from the date 4 the department denies the license or gives the notice of 5 intent to suspend, revoke or cancel the license or 6 disqualify the licensee from driving a commercial motor 7 vehicle within which to request a hearing or the 8 opportunity for a hearing is waived. If the request for a 9 hearing is timely and the request is for a contested case, 10 the department shall forward the request and certified 11 record to the hearing examiner who shall schedule a hearing 12 within forty-five (45) days after receipt of the certified 13 record at a time and place specified by the hearing 14 examiner. The hearing examiner shall provide the licensee 15 notice of the hearing at least ten (10) days in advance of 16 the hearing. If the hearing examiner fails to schedule the 17 hearing within forty-five (45) days of 18, other than at 19 the request of the licensee, the licensee, as his sole 20 remedy, shall be given credit against any action upheld at 21 the hearing for the time between the expiration of the 22 forty-five (45) day period and the date the hearing was 23 first scheduled. The hearing examiner may administer oaths, 2025STATE OF WYOMING25LSO-02123HB0030 1 subpoena and compel the attendance of witnesses or the 2 production of relevant books, papers and other evidence 3 reasonably necessary to resolve the matters under 4 consideration in accordance with W.S. 16-3-101 through 5 16-3-115 and may require reexamination of the licensee. The 6 hearing examiner shall issue subpoenas upon his own motion 7 or upon the request of any party to the proceedings in 8 compliance with the Wyoming Rules of Civil Procedure. Upon 9 hearing, the hearing examiner shall either rescind or 10 uphold the action or upon a showing of good cause, may 11 continue or modify a suspension of the license. 12 13 14 15 (a) The following fees are imposed, in addition to 16 the fee in subsection (g) of this section: 17 18 19 20 21 22 2025STATE OF WYOMING25LSO-02124HB00301 (b) Licenses issued to persons under twenty-one (21) 2 years of age shall bear distinctive markings indicating the 3 licensee is under twenty-one (21) years. It shall have: 4 5 (vii) The following: "State of 6 Wyoming"-"Identification Card No. ...."-"This card is 7 8 9 10 11W.S. 31-7-113(a)(iv) and 31-7-119(e) are 12 repealed. 13 14The department of transportation shall 15 promulgate rules as necessary to implement this act. 16 2025STATE OF WYOMING25LSO-02127HB00301 2 3 (a) Except as provided in subsection (b) of this 4 section, this act is effective July 1, 2025. 5 6 (b) Sections 3 and 4 of this act are effective 7 immediately upon completion of all acts necessary for a 8 bill to become law as provided by Article 4, Section 8 of 9 the Wyoming Constitution. 10 11 (END)
