Working animal protection act.

A BILL
for
1 AN ACT relating to counties, cities and towns; prohibiting
2 counties, cities and towns from enacting and enforcing
3 policies on the use of animals as specified; and providing
4 for an effective date.

13 (a) No city or town shall enact an ordinance or
14 policy that terminates, bans or unduly restricts a person 2025STATE OF WYOMING25LSO-05082HB0063
1 from using a working animal in lawful commerce or an animal
2 enterprise.

4 (b) This section supersedes any municipal ordinance
5 or policy that conflicts with this section, but shall not
6 supersede:

8 (i) Any municipal zoning ordinance enacted under
9 this title;
10
11 (ii) Any municipal ordinance or policy relating
12 to public health or public safety.

14 (c) This section shall not be interpreted to amend
15 any other Wyoming law that relates to animal care, public
16 health or public safety, including the provisions of W.S.
17 23-3-109.

19 (d) As used in this section, "working animal" means a
20 nonhuman animal used primarily for the purpose of
21 performing a specific duty or function in commerce or an
22 animal enterprise including human service, legal hunting,
23 agriculture, ranching, husbandry, transportation, 2025STATE OF WYOMING25LSO-05083HB0063
1 education, competition, tourism, entertainment or
2 exhibition. The term shall not include rabbits, llamas,
3 cattle, swine, sheep, goats, poultry or any other animal
4 that is used primarily for the production of food or fiber.

8 (a) No county shall enact any resolution, ordinance
9 or policy that terminates, bans or unduly restricts a
10 person from using a working animal in lawful commerce or an
11 animal enterprise.

13 (b) This section supersedes any resolution, ordinance
14 or policy that conflicts with this section, but shall not
15 supersede:
16
17 (i) Any county zoning resolution enacted under
18 this title;
19
20 (ii) Any policy relating to public health or
21 public safety.

2 any other Wyoming law that relates to animal care, public
3 health or public safety, including the provisions of W.S.
4 23-3-109.
