Sponsored by: Representative(s) Brown, L, Angelos, Clouston, Filer, Geringer and Harshman and Senator(s) Barlow, Brennan and Crago A BILL for 1 AN ACT relating to workplace safety; requiring the 2 department of workforce services to compile reports of 3 workplace violence in hospitals, health care clinics and 4 long term care facilities as specified; requiring 5 reporting; providing definitions; requiring rulemaking; and 6 providing for effective dates. 7 8 9 10. 11 12 (a) Every hospital, health care clinic and long-term 13 care facility that receives any state funds shall be 14 required to report to the department of workforce services 2025STATE OF WYOMING25LSO-05672HB0155 1 the following information on a monthly basis beginning 2 August 1, 2025: 3 4 (i) Incidents of workplace violence against 5 health care providers; 6 7 (ii) The category of the person committing the 8 violence, including: 9 10 (A) Patient; 11 12 (B) Health care provider; 13 14 (C) Family members or acquaintances of 15 patients; 16 17 (D) Others, as specified by the person 18 making the report. 19 20 (iii) Patient-related risk factors that may have 21 contributed to the violence, such as mental health disorder 22 diagnoses or substance use; 23 2025STATE OF WYOMING25LSO-05673HB01551 (iv) Environmental risk factors, such as 2 restricted patient visitation, lack of security or 3 excessive wait times; 4 5 (v) The types of incidents, including physical 6 assaults, attempted physical assaults, verbal abuse, 7 threats of harm or verbal discrimination based on race, sex 8 or gender; 9 10 (vi) The victims of the reported incidents by 11 job type; 12 13 (vii) The location of each incident, by physical 14 address and department of the hospital, clinic or long‑term 15 care facility. 16 17 (b) The department of workforce services shall report 18 the information in subsection (a) of this section, as well 19 as the total number of incidents reported between July 1, 20 2025 and July 1, 2026, to the joint labor, health and 21 social services interim committee not later than October 1, 22 2026. 23 2025STATE OF WYOMING25LSO-05674HB01551 (c) As used in this section, "health care provider" 2 means as defined in W.S. 1-1-130(b)(i). 3 4. The department of workforce services shall 5 promulgate all rules necessary to implement the provisions 6 of this act, including the creation of a standardized form 7 for hospitals, health care clinics and long‑term care 8 facilities to utilize for reporting workplace violence. 9 10 11 12 (a) Except as provided by subsection (b) of this 13 section, this act is effective July 1, 2025. 14 15 (b) Sections 2 and 3 of this act are effective 16 immediately upon completion of all acts necessary for a 17 bill to become law as provided by Article 4, Section 8 of 18 the Wyoming Constitution. 19 20 (END)
