Sponsored by: Representative(s) Knapp, Allemand, Bear, Brown, G, Clouston, Haroldson, Johnson, Locke, Strock, Tarver and Wylie and Senator(s) Steinmetz A BILL for 1 AN ACT relating to elections; prohibiting government 2 officials and election officials from accepting private 3 funds to conduct elections as specified; prohibiting any 4 person from providing or offering private funds for 5 purposes of conducting an election; providing exceptions; 6 creating new misdemeanor offenses; and providing for an 7 effective date. 8 9 10 11. W.S. 22-2-123 is created to read: 12 13 14 2025STATE OF WYOMING25LSO-06182HB02281 (a) Notwithstanding any other provision of law, no 2 agency or any state or county official responsible for 3 conducting elections, including, but not limited to, a 4 county clerk, shall solicit, accept, use or dispose of any 5 donation in the form of money, grants, property or personal 6 services from an individual or nongovernmental entity for 7 the purpose of funding any type of expenses related to 8 election administration, including, but not limited to, 9 voter education, voter outreach or voter registration 10 programs. All costs and expenses relating to elections 11 shall be paid with public funds. This subsection shall not 12 apply to meals or food provided or donated in support of 13 election training or education, or to meals or food 14 provided on election day to poll workers and other election 15 staff. This section shall not apply to elections that are 16 conducted by a special district in accordance with W.S. 17 22-29-113. 18 19 (b) No individual or nongovernmental entity shall 20 provide or offer to provide any donation in the form of 21 money, grants, property or personal services in violation 22 of subsection (a) of this section. 23 2025STATE OF WYOMING25LSO-06183HB02281 (c) Nothing in this section shall be construed to 2 prohibit the acceptance and expenditure of federal funds 3 for purposes of conducting elections as provided by law. 4 5.
