W.S. 21-13-338 is created to read: 2025STATE OF WYOMING25LSO-06852HB02351 2 3 4 5 (a) Commencing with school year 2026-2027, to augment 6 amounts within the education resource block grant model 7 available to districts for career and technical education 8 programs, a school district may apply to the department of 9 education for career and technical education supplies, 10 materials and equipment funding in accordance with this 11 section. Application shall be on a form and in a manner 12 prescribed by the department. 13 14 (b) Each school district shall report the number of 15 full-time equivalent (FTE) career and technical education 16 teachers within a school from the prior school year, as 17 computed in accordance with guidelines prescribed by the 18 department, who are providing career and technical 19 education instruction in grades nine (9) through twelve 20 (12) and except as provided under W.S. 21-2-202(a)(xxvii), 21 certified by the Wyoming professional teaching standards 22 board to provide instruction at the high school level for 23 career and technical education courses comprising career 2025STATE OF WYOMING25LSO-06853HB0235 1 and technical education programs. Nothing in this 2 subsection shall require a district to employ teachers 3 certified for high school career and technical education 4 instruction on a full-time basis or to require teachers to 5 teach only high school career and technical education 6 courses on a full-time basis. 7 8 (c) Amounts awarded to each school district for 9 career and technical education supplies, materials and 10 equipment funding under this section shall be calculated as 11 the product of each school's FTE career and technical 12 education teachers reported under subsection (b) of this 13 section multiplied by fourteen thousand one hundred 14 eighty-four dollars and sixty-eight cents ($14,184.68). The 15 department shall further adjust the amount under this 16 subsection by any external cost adjustment enacted by the 17 legislature for the educational materials category of the 18 educational resource block grant model. 19 20 (d) Not later than October 15 of the applicable 21 school year and following review of applications submitted 22 under this section, the department shall notify applicant 23 districts of awards and shall provide each applicant 2025STATE OF WYOMING25LSO-06854HB0235 1 district a written statement of the reasons for approving 2 or denying the application. Upon approval of applications, 3 the department shall pay each school district not later 4 than February 15 of the applicable school year. 5 6 (e) Each applicant district shall report to the 7 department on the expenditure of amounts awarded under this 8 section and shall provide other information as required by 9 rule of the department. Amounts awarded under this section 10 shall only be expended on supplies, materials and equipment 11 for career and technical education programs. 12 13 (f) The department of education shall promulgate 14 rules necessary to carry out this section. 15 16 (g) As used in this section, "career and technical 17 education program" shall be as specified in W.S. 18 21-13-309(m)(v)(D)(II). 19 20W.S. 21-12-105(b), 21-13-101(a)(v) and 21 (xvii) and 21-13-337(a) and (c) are amended to read: 22 2025STATE OF WYOMING25LSO-06855HB02351 2 3 4 5 (b) Any amount awarded to a district under this 6 section shall be in addition to and not be considered in 7 determining the school foundation program amount under the 8 education resource block grant model pursuant to W.S. 9 21-13-309 10 11. A grant awarded under this section shall be for 12 a period of two (2) years and shall not exceed one hundred 13 fifty thousand dollars ($150,000.00) for the first year of 14 demonstration project planning, and not more than two 15 hundred thousand dollars ($200,000.00) for project 16 implementation in year two (2) of the project 17 grant. Thereafter, state assistance for the project shall 18 be limited to funds distributed to the district within its 19 foundation program amount as determined under the education 20 resource block grant model 21. Any school district receiving funds under 22 W.S. 21-13-337 for career and technical supplies, materials 23 and equipment shall be ineligible to receive a grant under 2025STATE OF WYOMING25LSO-06856HB0235 1 this section for the period the district receives funds 2 under W.S. 21-13-337. 3 4 5 6 (a) As used in this chapter: 7 8 (v) "Foundation program" means the level of 9 funding which is to be made available to each district 10 under this 11 comply with the state uniform educational program standards 12 imposed under W.S. 21-9-101 and 21-9-102 and the uniform 13 state student content and performance standards prescribed 14 by the state board of education under W.S. 15 21-2-304(a)(iii); 16 17 (xvii) "Attachment A" to 18 19 20 consists of an enumeration of model 21 components as enacted into law, summarizing and executing 22 recommendations contained within the 2010 cost of education 2025STATE OF WYOMING25LSO-06857HB0235 1 study, as modified by the legislature, and is hereby 2 incorporated into this chapter by this reference; 3 4 5 6 7 (a) A school district may apply to the state 8 department of education for state assistance to fund the 9 purchase of supplies, materials and equipment for a new or 10 existing career and technical education program in the 11 district. Amounts awarded under this section shall be in 12 addition to and shall not be considered in determining the 13 school foundation program amount under the education 14 resource block grant model pursuant to W.S. 21-13-309 15 16 17. Any school district receiving funds under 18 W.S. 21-12-105 for a career and technical education 19 demonstration project grant shall be ineligible to receive 20 funds under this section for the period the district 21 receives funds under W.S. 21-12-105. 22 2025STATE OF WYOMING25LSO-06858HB02351 (c) Not later than August 15 of the applicable school 2 year and following review of applications submitted under 3 this section, the department shall notify applicant 4 districts of its grant awards and shall provide each 5 applicant district a written statement of the reasons for 6 approving or denying the application. No award shall be 7 given to a district unless it has expended, or will expend 8 with the award of the grant requested under this section, 9 the entire amount generated under W.S. 21-13-309(m)(v)(D) 10 for supplies, materials and 11 equipment for career and technical education programs 12 13 14 15 utilizing expenditure data from the immediately preceding 16 five (5) school years from the date of application and 17 amounts from the special reserve fund created under W.S. 18 21-13-504 for supplies, materials and equipment for career 19 and technical education programs. reference shall 20 be given to districts that have not received a grant under 21 this section in the immediately preceding five (5) school 22 years from the date of application. If an application is 23 approved, the department shall award the grant from amounts 2025STATE OF WYOMING25LSO-06859HB0235 1 made available by legislative appropriation from the public 2 school foundation program account for purposes of this 3 section. 4 52011 Wyoming Session Laws, Chapter 185, 6 ATTACHMENT "A"(b)(xxv), as amended by 2017 Wyoming Session 7 Laws, Chapter 205, Section 3 is amended to read: 8 9 ATTACHMENT "A" 10 ATTACHMENT "A" CONTAINS AN ENUMERATION OF 11 EDUCATION RESOURCE BLOCK GRANT MODEL COMPONENTS 12 SUMMARIZING AND EXECUTING RECOMMENDATIONS 13 CONTAINED IN THE 2010 COST OF EDUCATION STUDY AS 14 FOLLOWS: 15 16 (b) Notwithstanding components specified in 17 the 2010 cost of education study accepted by the 18 legislature, the Wyoming education resource block 19 grant model components and the resourcing for 20 those components, as enacted by the legislature, 21 shall be as follows: 22 2025STATE OF WYOMING25LSO-068510HB02351 (xxv) Vocational Career and 2education: 0.29 3 times 4 FTE career and 5 education ADM.; 6 7 8 9 10 11W.S. 21-13-309(m)(v)(D)(III) is repealed. 12 132011 Wyoming Session Laws, Chapter 185, 14 ATTACHMENT "A"(a)(iii)(D), as amended by 2012 Wyoming 15 Session Laws, Chapter 99, Section 3 is repealed. 16 17There is appropriated four million six 18 hundred forty thousand six hundred thirty- 19 ($4,640,631.00) from the public school foundation program 20 account to the department of educationschool finance for 21 career and technical education supplies, equipment and 22 replacement payments to school districts made necessary by 23 the amendments enacted in this act. This appropriation 2025STATE OF WYOMING25LSO-068511HB0235 1 shall be for the period beginning July 1, 2025 and ending 2 June 30, 2026. This appropriation shall not be transferred 3 or expended for any other purpose and any unexpended, 4 unobligated funds remaining from this appropriation shall 5 revert as provided by law on June 30, 2026. It is the 6 intent of the legislature that this appropriation be 7 included in the standard budget for the department of 8 education-school finance for the immediately succeeding 9 fiscal biennium. 10 11This act is effective July 1, 2025 12 13 (END)
