W.S. 21-13-338 is created to read: 2025STATE OF WYOMING25LSO-0685 ENGROSSED 2HB02351 2 3 4 5 (a) Commencing with school year 2026-2027, to augment 6 amounts within the education resource block grant model 7 available to districts for career and technical education 8 programs, the department of education shall distribute 9 career and technical education supplies, materials and 10 equipment funding in accordance with this section. 11 12 (b) Each school district shall report the number of 13 full-time equivalent (FTE) career and technical education 14 teachers within a school from the prior school year, as 15 computed in accordance with guidelines prescribed by the 16 department, who are providing career and technical 17 education instruction in grades nine (9) through twelve 18 (12) and except as provided under W.S. 21-2-202(a)(xxvii), 19 certified by the Wyoming professional teaching standards 20 board to provide instruction at the high school level for 21 career and technical education courses comprising career 22 and technical education programs. Nothing in this 23 subsection shall require a district to employ teachers 2025STATE OF WYOMING25LSO-0685 ENGROSSED 3HB0235 1 certified for high school career and technical education 2 instruction on a full-time basis or to require teachers to 3 teach only high school career and technical education 4 courses on a full-time basis. 5 6 (c) Amounts distributed to each school district for 7 career and technical education supplies, materials and 8 equipment funding under this section shall be calculated as 9 follows: 10 11 (i) Except as provided in paragraph (ii) of this 12 subsection, the product of each school's FTE career and 13 technical education teachers reported under subsection (b) 14 of this section multiplied by fourteen thousand one hundred 15 eighty-four dollars and sixty-eight cents ($14,184.68); 16 17 (ii) If a school's FTE career and technical 18 education teachers reported in subsection (b) of this 19 section is less than two (2), the amount of funding for the 20 school's career and technical education supplies, materials 21 and equipment funding shall be equal to twenty-eight 22 thousand three hundred sixty-nine dollars and thirty-six 23 cents ($28,369.36); 2025STATE OF WYOMING25LSO-0685 ENGROSSED 4HB0235 1 2 (iii) The department shall further adjust the 3 amounts for career and technical education supplies, 4 materials and equipment funding in paragraphs (i) and (ii) 5 of this subsection by any external cost adjustment enacted 6 by the legislature for the educational materials 7 category of the educational resource block grant model. 8 9 (d) Not later than October 15 of the applicable 10 school year and following review of reports submitted under 11 this section, the department shall notify districts of 12 distributions. The department shall pay each school 13 district not later than February 15 of the applicable 14 school year. 15 16 (e) Each district shall report to the department on 17 the expenditure of amounts distributed under this section 18 and shall provide other information as required by rule of 19 the department. Amounts distributed under this section 20 shall only be expended on supplies, materials and equipment 21 for career and technical education programs. 22 2025STATE OF WYOMING25LSO-0685 ENGROSSED 5HB02351 (f) The department of education shall promulgate 2 rules necessary to carry out this section. 3 4 (g) As used in this section, "career and technical 5 education program" shall be as specified in W.S. 6 21-13-309(m)(v)(D)(II). 7 8W.S. 21-12-105(b), 21-13-101(a)(v) and 9 (xvii) and 21-13-337(a) and (c) are amended to read: 10 11 12 13 14 15 (b) Any amount awarded to a district under this 16 section shall be in addition to and not be considered in 17 determining the school foundation program amount under the 18 education resource block grant model pursuant to W.S. 19 21-13-309 20 21. A grant awarded under this section shall be for 22 a period of two (2) years and shall not exceed one hundred 23 fifty thousand dollars ($150,000.00) for the first year of 2025STATE OF WYOMING25LSO-0685 ENGROSSED 6HB0235 1 demonstration project planning, and not more than two 2 hundred thousand dollars ($200,000.00) for project 3 implementation in year two (2) of the project 4 grant. Thereafter, state assistance for the project shall 5 be limited to funds distributed to the district within its 6 foundation program amount as determined under the education 7 resource block grant model 8. Any school district receiving funds under 9 W.S. 21-13-337 for career and technical supplies, materials 10 and equipment shall be ineligible to receive a grant under 11 this section for the period the district receives funds 12 under W.S. 21-13-337. 13 14 15 16 (a) As used in this chapter: 17 18 (v) "Foundation program" means the level of 19 funding which is to be made available to each district 20 under this 21 comply with the state uniform educational program standards 22 imposed under W.S. 21-9-101 and 21-9-102 and the uniform 23 state student content and performance standards prescribed 2025STATE OF WYOMING25LSO-0685 ENGROSSED 7HB0235 1 by the state board of education under W.S. 2 21-2-304(a)(iii); 3 4 (xvii) "Attachment A" to 5 6 7 consists of an enumeration of model 8 components as enacted into law, summarizing and executing 9 recommendations contained within the 2010 cost of education 10 study, as modified by the legislature, and is hereby 11 incorporated into this chapter by this reference; 12 13 14 15 16 (a) A school district may apply to the state 17 department of education for state assistance to fund the 18 purchase of supplies, materials and equipment for a new or 19 existing career and technical education program in the 20 district. Amounts awarded under this section shall be in 21 addition to and shall not be considered in determining the 22 school foundation program amount under the education 23 resource block grant model pursuant to W.S. 21-13-309 2025STATE OF WYOMING25LSO-0685 ENGROSSED 8HB0235 1 2 3. Any school district receiving funds under 4 W.S. 21-12-105 for a career and technical education 5 demonstration project grant shall be ineligible to receive 6 funds under this section for the period the district 7 receives funds under W.S. 21-12-105. 8 9 (c) Not later than August 15 of the applicable school 10 year and following review of applications submitted under 11 this section, the department shall notify applicant 12 districts of its grant awards and shall provide each 13 applicant district a written statement of the reasons for 14 approving or denying the application. No award shall be 15 given to a district unless it has expended, or will expend 16 with the award of the grant requested under this section, 17 the entire amount generated under W.S. 21-13-309(m)(v)(D) 18 for supplies, materials and 19 equipment for career and technical education programs 20 21 22 23 utilizing expenditure data from the immediately preceding 2025STATE OF WYOMING25LSO-0685 ENGROSSED 9HB0235 1 five (5) school years from the date of application and 2 amounts from the special reserve fund created under W.S. 3 21-13-504 for supplies, materials and equipment for career 4 and technical education programs. reference shall 5 be given to districts that have not received a grant under 6 this section in the immediately preceding five (5) school 7 years from the date of application. If an application is 8 approved, the department shall award the grant from amounts 9 made available by legislative appropriation from the public 10 school foundation program account for purposes of this 11 section. 12 132011 Wyoming Session Laws, Chapter 185, 14 ATTACHMENT "A"(b)(xxv), as amended by 2017 Wyoming Session 15 Laws, Chapter 205, Section 3 is amended to read: 16 17 ATTACHMENT "A" 18 ATTACHMENT "A" CONTAINS AN ENUMERATION OF 19 EDUCATION RESOURCE BLOCK GRANT MODEL COMPONENTS 20 SUMMARIZING AND EXECUTING RECOMMENDATIONS 21 CONTAINED IN THE 2010 COST OF EDUCATION STUDY AS 22 FOLLOWS: 23 2025STATE OF WYOMING25LSO-0685 ENGROSSED 10HB02351 (b) Notwithstanding components specified in the 2010 2 cost of education study accepted by the legislature, the 3 Wyoming education resource block grant model components and 4 the resourcing for those components, as enacted by the 5 legislature, shall be as follows: 6 7 (xxv) Vocational Career and technical education: 8 0.29 times FTE vocational career and technical education 9 ADM. 10 11 12 13 14 15W.S. 21-13-309(m)(v)(D)(III) is repealed. 16 172011 Wyoming Session Laws, Chapter 185, 18 ATTACHMENT "A"(a)(iii)(D), as amended by 2012 Wyoming 19 Session Laws, Chapter 99, Section 3 is repealed. 20 21There is appropriated four million nine 22 hundred ninety thousand six hundred thirtyone dollars 23 ($4,990,631.00) from the public school foundation program 2025STATE OF WYOMING25LSO-0685 ENGROSSED 11HB0235 1 account to the department of education- 2 career and technical education supplies, equipment and 3 replacement payments to school districts made necessary by 4 the amendments enacted in this act. This appropriation 5 shall be for the period beginning July 1, 2025 and ending 6 June 30, 2026. This appropriation shall not be transferred 7 or expended for any other purpose and any unexpended, 8 unobligated funds remaining from this appropriation shall 9 revert as provided by law on June 30, 2026. It is the 10 intent of the legislature that this appropriation be 11 included in the standard budget for the department of 12 education-school finance for the immediately succeeding 13 fiscal biennium. 14 15This act is effective July 1, 2025 16 17 (END)
