Eminent domain study.

A BILL
for
1 AN ACT relating to eminent domain; requiring the joint
2 corporations, elections and political subdivisions interim
3 committee to commence a study regarding eminent domain as
4 specified; requiring a report; and providing for an
5 effective date.

11 (a) During the 2025 interim, the joint corporations,
12 elections and political subdivisions interim committee
13 shall study issues surrounding the use of the power of
14 eminent domain in the state. As part of the study, the
15 committee shall consider the following issues at a minimum:

2 property through the use of eminent domain;

4 (ii) Reclamation and restoration of property
5 after an easement is released;
6
7 (iii) Liability for damages caused by the
8 utilization of property acquired through eminent domain;
9
10 (iv) Reasons the power of eminent domain can be
11 used;
12
13 (v) Parties authorized to use the power of
14 eminent domain;
15
16 (vi) Abandonment of easements acquired through
17 eminent domain; and
18
19 (vii) Types of land that can be acquired through
20 eminent domain.

22 (b) Based upon the study required by subsection (a)
23 of this section, the joint corporations, elections and 2025STATE OF WYOMING25LSO-07253HB0314
1 political subdivisions interim committee shall prepare any
2 recommended legislation for consideration during the 2026
3 budget session.

5. This act is effective immediately upon
6 completion of all acts necessary for a bill to become law
7 as provided by Article 4, Section 8 of the Wyoming
8 Constitution.
