2 department of family services to request a waiver under the 
3 supplemental nutrition assistance program as specified; 
4 providing definitions; and providing for an effective date.

13 (a)  As used in this section:

15 (i)  "Candy" means a preparation of sugar, honey 
16 or other natural or artificial sweeteners in combination  2025STATE OF WYOMING25LSO-07982HB0323
1 with chocolate, fruit, nuts or other ingredients or 
2 flavorings in the form of bars, drops or pieces;

4 (ii)  "Soft drink" means a nonalcoholic beverage 
5 that contains natural or artificial sweeteners. "Soft 
6 drink" shall not include a beverage that contains milk, 
7 milk products, soy, rice or similar milk substitutes or a 
8 beverage that is greater than fifty percent (50%) vegetable 
9 or fruit juice by volume.

11 (b)  Not later than July 1, 2025, the director of the 
12 department of family services shall request a waiver from 
13 the United States department of agriculture to exclude 
14 candy and soft drinks from the definition of eligible foods 
15 under 7 C.F.R. ยง 271.2. If the waiver is granted, the 
16 director of the department of family services shall 
17 prohibit the purchase of candy and soft drinks with 
18 benefits provided under the supplemental nutrition 
19 assistance program. If no waiver is granted, the director 
20 of the department of family services shall repeat the 
21 request for a waiver annually until the waiver is granted.

2 completion of all acts necessary for a bill to become law 
3 as provided by Article 4, Section 8 of the Wyoming 
4 Constitution.
