State lands-fencing 2.25LSO-0388, 1.0 SF0063 FISCAL NOTE The fiscal impact, in the form of an expenditure increase, is indeterminable. Under this bill, landowners whose property adjoins state lands on which the landowner does not hold a lease may construct a lawful partition fence along state lands. In these cases, the Office of State Lands and Investments (OSLI) is required to pay for one-half of the construction cost of the fence. Landowners and OSLI would also contribute to the cost of maintenance of the fence in proportion to their respective interests in the fence. According to OSLI, the average cost to construct a lawful fence statewide is between $3.00 and $7.00 per foot. However, OSLI cannot estimate the number of fences, the length of those fences, or the associated maintenance costs.
