Sponsored by: Senator(s) Brennan, Barlow, Olsen, Rothfuss and Schuler and Representative(s) Brown, G, Brown, L, Filer, Geringer and Harshman A BILL for 1 AN ACT relating to school finance; creating a competitive 2 grant program for crossing guards for K-12 public schools; 3 providing an appropriation; requiring reporting; requiring 4 rulemaking; and providing for an effective date. 5 6 7 8. W.S. 21-13-338 is created to read: 9 10 11 12 13 (a) For school year 2025-2026 through school year 14 2027-2028, a school district may apply to the state 15 department of education for state assistance, train and 2025STATE OF WYOMING25LSO-06772SF0123 1 educate volunteers and faculty, pay wages for faculty and 2 purchase equipment for a crossing guard program for schools 3 located within the school district. Amounts awarded under 4 this section shall be in addition to and shall not be 5 considered in determining the school foundation program 6 amount under the education resource block grant model 7 pursuant to W.S. 21-13-309. 8 9 (b) A grant awarded under this section shall be for a 10 period of one (1) year and shall not exceed ten thousand 11 dollars ($10,000.00) per school per year. Applications by 12 school districts for a grant under this section shall be 13 submitted on a form and in a manner specified by rule of 14 the department of education, shall be filed with the 15 department of education on or before June 30 each year to 16 secure a grant during the immediately succeeding school 17 year and shall at a minimum include: 18 19 (i) A proposal documenting the need for crossing 20 guards and a plan for expenditure of grant amounts. The 21 proposal shall identify at minimum the following: 22 2025STATE OF WYOMING25LSO-06773SF01231 (A) The proposed schools and intersections 2 where volunteers and school district employees will act as 3 crossing guards if awarded funding under the grant program; 4 5 (B) The number of hours and the number of 6 volunteers and school district employees that will act as 7 crossing guards if awarded funding under the grant program; 8 9 (C) The training and education requirements 10 for volunteers and school district employees acting as a 11 crossing guards if awarded under funding under the grant 12 program; 13 14 (D) Equipment, with itemized prices for 15 each piece of equipment, to be funded by the grant. 16 17 (ii) Other necessary information required by the 18 department of education. 19 20 (c) Not later than August 1 of each applicable school 21 year and following review of applications submitted under 22 this section, the department of education shall notify 23 applicant school districts of its decision to award or deny 2025STATE OF WYOMING25LSO-06774SF0123 1 a grant application and shall provide each applicant 2 district a written statement of the reasons for approving 3 or denying the application. The department of education may 4 approve or deny an application in whole or in part and may 5 award funds for specific schools within a school district, 6 while denying funds for others. If an application is 7 approved, the department shall award the grant from amounts 8 made available by legislative appropriation from the public 9 school foundation program account for purposes of this 10 section. 11 12 (d) Each school district receiving a grant under this 13 section shall report to the department of education the 14 expenditure of amounts awarded under this section and shall 15 provide other information as required by rule of the 16 department of education. 17 18 (e) Not later than August 1 of each applicable school 19 year, the department of education shall report to the joint 20 education interim committee on the expenditure of grant 21 awards. 22 2025STATE OF WYOMING25LSO-06775SF01231 (f) The department of education, in consultation with 2 the department of transportation, shall promulgate rules 3 necessary to carry out this section. The rules shall, at 4 minimum, identify training and education requirements for 5 volunteers and school district employees acting as crossing 6 guards and funded by the crossing guard grant program 7 created by this section. 8 9 (g) This section is repealed effective July 1, 2028. 10 11. There is appropriated four million nine 12 hundred fifty thousand dollars ($4,950,000.00) from the 13 public school foundation program account to the department 14 of education‑school finance for the grant program created by 15 section 1 of this act. Not more than one million six 16 hundred fifty thousand dollars ($1,650,000.00) shall be 17 expended each school year. This appropriation shall be for 18 the period beginning July 1, 2025 and ending June 30, 2028. 19 This appropriation shall not be transferred or expended for 20 any other purpose and any unexpended, unobligated funds 21 remaining from this appropriation shall revert as provided 22 by law on June 30, 2028. It is the intent of the 23 legislature that this appropriation not be included in the 2025STATE OF WYOMING25LSO-06776SF0123 1 standard budget for the department of education for the 2 immediately succeeding fiscal biennium. 3 4. This act is effective immediately upon 5 completion of all acts necessary for a bill to become law 6 as provided by Article 4, Section 8 of the Wyoming 7 Constitution. 8 9 (END)
