Requires procurement officers to document whether to pursue a design professional or contractor for damages in the event of construction cost overruns. Requires the chief procurement officer to compile a public list of construction companies or design professionals that are in noncompliance with the procurement code or owe penalties. Makes construction cost overruns a tort for purposes of the design claim conciliation panel. Requires bids for a contract under the competitive sealed bidding process to include a liability contingency fund. Requires the state procurement office to include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards. Makes cost overruns a construction defect for the purposes of the contractor repair act. Establishes a procurement professional standards task force. Effective 7/1/2112. (HD1)

Clarifies that "customary and traditional subsistence farming", which is customary and traditional subsistence farming conducted by a native Hawaiian cultural practitioner in certain situations, is included as a protected activity under the Hawaii Right to Farm Act. Clarifies that the cultivation of crops and activities related to game, fish, and livestock on agricultural lands may be for economic use or customary and traditional subsistence farming. Provides that one of the State's policies under the Hawaii State Planning Act's agricultural objectives is to assure the right of native Hawaiian cultural practitioners to engage in customary and traditional subsistence farming for direct personal or family consumption. Authorizes the board of land and natural resources to provide shoreline encroachment easements that do not exceed 10 years to landowners having structures that encroach on the shoreline. Requires the board of land and natural resources to adopt rules that establish a policy and procedure for the granting or renewal of shoreline encroachment easements. Requires the adopted policy to consider the impact of expected sea level rise on the encroaching structures. Prohibits the granting of any new shoreline encroachment easements until the new policy is adopted.

Reduces from 500 feet to 100 feet the buffer zones for commercial hemp production and processing. Authorizes hemp to be grown at a residential property under the control of a person licensed under federal law to produce hemp. Repeals authorization from the state department of agriculture as a prerequisite to transport hemp. Authorizes commercial hemp producers to sell whole, unprocessed hemp leaves to consumers, subject to certain requirements. Requires labels that disclose that leaves and hemp products were from hemp grown in the State. Replaces the referenced testing standard authority on labels for hemp products.

Requires persons applying for a commercial marine license to appear in person before DLNR. Prohibits DLNR from issuing or renewing a commercial marine license to an alien crew member who has not been granted permission to land temporarily by federal law. Requires a DLNR permit for black coral taken within the jurisdiction of the State for commercial purposes.

Removes the authority of the county liquor commissions to enforce the liquor tax law and requires violations of the liquor tax law to be referred to the director of taxation for investigation. Repeals the general right of inspection without a warrant for potential violations of the liquor tax law. Requires applications for liquor licenses to be notarized. Repeals the discretionary power of the liquor commission to deny a license to any person the liquor commission investigator finds is not fit and proper to hold a license. Repeals the requirement that investigative reports to the liquor commission include any and all matters that are relevant to the application or license in the judgment of the investigator.
