243 | 228 | (6) "Data system" means a repository of information about licensees, 16 | |
244 | 229 | including examination, licensure, investigative, compact privilege, and adverse action. 17 | |
245 | 230 | (7) "Encumbered license" means a license that a physical therapy 18 | |
246 | 231 | licensing board has limited in any way. 19 | |
247 | 232 | (8) "Executive Board" means a group of directors elected or appointed 20 | |
248 | 233 | to act on behalf of, and within the powers granted to them by, the Commission. 21 | |
249 | 234 | (9) "Home state" means the member state that is the licensee's primary 22 | |
250 | 235 | state of residence. 23 | |
251 | 236 | (10) "Investigative information" means information, records, and 24 | |
252 | 237 | documents received or generated by a physical therapy licensing board pursuant to an 25 | |

279 | 266 | where a licensee is exercising or seeking to exercise the compact privilege. 20 | |
280 | 267 | (21) "Rule" means a regulation, principle, or directive promulgated by 21 | |
281 | 268 | the Commission that has the force of law. 22 | |
282 | 269 | (22) "State" means any state, commonwealth, district, or territory of 23 | |

284 | 271 | SECTION 3. STATE PARTICIPATION IN THE COMPACT 25 | |
285 | 272 | (a) To participate in the Compact, a state must: 26 | |
286 | 273 | (1) Participate fully in the Commission's data system, including using 27 | |
287 | 274 | the Commission's unique identifier as defined in rules; 28 | |
288 | 275 | (2) Have a mechanism in place for receiving and investigating 29 | |
289 | 276 | complaints about licensees; 30 | |

307 | 296 | (c) A member state shall grant the compact privilege to a licensee holding a 16 | |

404 | 399 | SECTION 7. ESTABLISHMENT OF THE PHYSICAL THERAPY COMPACT 17 | |

406 | 401 | (a) The Compact member states hereby create and establish a joint public 19 | |
407 | 402 | agency known as the Physical Therapy Compact Commission. 20 | |
