29 | 29 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3 |

30 | 30 | | * Section 1. AS 47.07.020(i) is amended to read: 4 |

31 | 31 | | (i) The department shall allow a person under six years of age who is |

33 | 33 | | determined to be eligible for benefits under this chapter to remain eligible for 6 |

46 | 46 | | implement this Act, the Department of Health shall amend and submit for federal approval the 2 |

47 | 47 | | state plan for medical assistance coverage consistent with AS 47.07.020(i), as amended by 3 |
---|
48 | 48 | | sec. 1 of this Act. 4 |

49 | 49 | | * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 5 |

51 | 51 | | CONDITIONAL EFFECT; NOTIFICATION. (a) Section 1 of this Act takes effect 7 |

52 | 52 | | only if the United States Department of Health and Human Services 8 |

53 | 53 | | (1) approves the amendments to the state plan for medical assistance coverage 9 |
---|
54 | 54 | | submitted in accordance with sec. 2 of this Act; or 10 |
---|
55 | 55 | | (2) determines that approval of the amendments to the state plan for medical 11 |
---|
56 | 56 | | assistance coverage submitted in accordance with sec. 2 of this Act is not necessary. 12 |
---|
57 | 57 | | (b) The commissioner of health shall notify the revisor of statutes in writing within 30 13 |
---|
58 | 58 | | days after the United States Department of Health and Human Services approves the 14 |
---|
59 | 59 | | amendments to the state plan or determines that approval is not necessary under this section. 15 |
---|
60 | 60 | | * Sec. 4. If sec. 1 of this Act takes effect, it takes effect on the day after the date the United 16 |
---|
61 | 61 | | States Department of Health and Human Services approves the amendments to the state plan 17 |
---|
62 | 62 | | or determines that approval is not necessary. 18 |
