2929 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
3030 * Section 1. AS 08.01 is amended by adding a new section to read: 4
3131 Sec. 08.01.061. Temporary license. (a) The department may issue a 5
3232 temporary license to practice an occupation in AS 08.01.010 if 6
3333 (1) the applicant 7
3434 (A) is licensed or credentialed to practice the occupation in 8
3535 another state or territory of the United States that 9
3636 (i) has requirements for a license to practice the 10
3737 occupation that are substantially equivalent to or greater than the 11
3838 requirements listed in the applicable chapter of this title; and 12
3939 (ii) authorizes a scope of practice substantially 13
4040 equivalent to the scope of practice of the corresponding license in this 14 34-GH1614\A

4545 (B) does not hold a license to practice that occupation in 2
4646 another jurisdiction but meets the qualifications and requirements for a license 3

4949 (2) at the time of application, the applicant is not subject to 6
5050 disciplinary action related to the occupation in another jurisdiction or the subject of an 7
5151 ongoing review or disciplinary proceeding by the licensing authority in that 8
5252 jurisdiction; 9
5353 (3) in the 10 years preceding the submission of an application, the 10
5454 applicant has not committed an act in another jurisdiction that would constitute 11
5555 grounds for the denial or revocation of a license, certificate, or permit to practice that 12
5656 occupation at the time the act was committed; and 13
5757 (4) the applicable fees are paid. 14
5858 (b) If the department or applicable board requires that an applicant for a 15
5959 professional license submit information related to a criminal history record check, 16
6060 those requirements also apply to an applicant for a temporary license. The department 17
6161 may grant a temporary license before obtaining the resulting report. 18
6262 (c) If the department finds that a temporary license was secured through 19
6363 deceit, fraud, or intentional misrepresentation, the department may take disciplinary 20
6464 action against the temporary license, including revoking the temporary license. 21
6565 (d) A temporary license is valid for up to 180 days as determined by the 22
6666 department. For each temporary license issued to an applicant, the applicant may 23
6767 apply for one 180-day extension, which will be approved at the department's 24
6868 discretion. 25
6969 (e) Except as provided in (f) of this section, a temporary license for an 26
7070 occupation listed in AS 08.01.010 satisfies the requirements to practice that 27
7171 occupation. 28
7272 (f) This section does not apply to an occupation regulated under AS 08.54 or 29
7373 AS 08.62. 30

7878 Sec. 08.01.062. Courtesy licenses. (a) A board established under this title 1
7979 [AND THE DEPARTMENT, WITH RESPECT TO AN OCCUPATION THAT IT 2
8080 REGULATES UNDER THIS TITLE,] may by regulation establish criteria for issuing 3
8181 a [TEMPORARY] courtesy license to nonresidents who enter the state so that, on a 4
8282 temporary basis, they may practice the occupation regulated by the board for a 5
8383 limited purpose. A courtesy license may not authorize a licensee to engage in the 6
8484 general practice of the related occupation [OR THE DEPARTMENT]. 7
8585 (b) The regulations adopted under (a) of this section may include limitations 8
8686 relating to the 9
8787 (1) duration of the license's validity; 10
8888 (2) scope of practice allowed under the license; and 11
8989 (3) other matters considered important by the board [OR THE 12
9090 DEPARTMENT]. 13
9191 * Sec. 3. AS 08.01.063 is repealed and reenacted to read: 14
9292 Sec. 08.01.063. Portability of professional licenses for servicemembers and 15
9393 their spouses. (a) Except as provided in (e) of this section and 50 U.S.C. 4025a, the 16
9494 department shall issue a license to practice an occupation in AS 08.01.010 that has an 17
9595 equivalent scope of practice as a certificate or license held by a servicemember or 18
9696 spouse of a servicemember if the servicemember or spouse relocates residence to the 19
9797 state in accordance with military orders, applies in a manner prescribed by the 20
9898 department, and meets the requirements of this section. An application under this 21
9999 section must include 22
100100 (1) evidence satisfactory to the department that the applicant 23
101101 (A) has received military orders, or is the spouse of a 24
102102 servicemember who has received military orders, for military service in the 25
103103 state; 26
104104 (B) holds a license or certificate issued by the licensing 27
105105 authority of another state that 28
106106 (i) is in good standing with the licensing authority; 29
107107 (ii) has not been revoked or subject to discipline; 30
108108 (iii) does not have an investigation relating to 31 34-GH1614\A

112112 unprofessional conduct pending in any state relating to it; and 1
113113 (iv) has not been voluntarily surrendered while under 2
114114 investigation for unprofessional conduct in any state; and 3
115115 (C) is in good standing with the licensing authority of any state 4
116116 that has issued the applicant a license or certificate. 5
117117 (2) a notarized affidavit affirming, under penalty of law, that 6
118118 (A) the applicant is the person described and identified in the 7
119119 application; 8
120120 (B) all statements made in the application are true and correct; 9
121121 (C) the applicant has read and understands the requirements to 10
122122 receive a license and the scope of practice of that license type; 11
123123 (D) the applicant will comply with the requirements to practice 12
124124 under the license, including requirements related to discipline and fulfillment 13
125125 of continuing education; and 14
126126 (E) the applicant is in good standing with the licensing 15
127127 authority of 16
128128 (i) the jurisdiction that issued the applicant's existing 17
129129 license or certificate; and 18
130130 (ii) any other jurisdiction of a state, district, or territory 19
131131 of the United States that has issued the applicant a license or certificate; 20
132132 (3) if the applicant is the spouse of a military servicemember, a copy of 21
133133 the marriage certificate; and 22
134134 (4) payment of any applicable fees. 23
135135 (b) If an applicant meets the requirements of (a) of this section, the department 24
136136 shall issue a license to the applicant within 30 days after receipt of the application. The 25
137137 department may extend the 30-day period only for the purpose of completing a 26
138138 criminal history record check under (d) of this section. If the department cannot issue 27
139139 the license within 30 days, the department may issue to the applicant a temporary 28
140140 license to practice the profession while the criminal history record check is pending. 29
141141 (c) Notwithstanding (d) of this section, a license issued under this section is 30
142142 subject to the applicable department or board requirements for that license and for the 31 34-GH1614\A

146146 practice of the related profession, including renewal dates established under 1
147147 AS 08.01.100. 2
148148 (d) If the department or applicable board requires that an applicant for a 3
149149 professional license submit information related to a criminal history record check, the 4
150150 department may require an applicant under this section to meet the same requirements. 5
151151 (e) This section does not apply to 6
152152 (1) a profession not set out under AS 08.01.010; or 7
153153 (2) a profession that is subject to an interstate licensing compact that 8
154154 has been entered into by the state. 9
155155 (f) In this section, 10
156156 (1) "license" has the meaning given in 50 U.S.C. 4025a; 11
157157 (2) "licensing authority" has the meaning given under 50 U.S.C. 12
158158 4025a; 13
159159 (3) "military orders" has the meaning given under 50 U.S.C. 4025a; 14
160160 (4) "military service" has the meaning given under 50 U.S.C. 3911; 15
161161 (5) "scope of practice" has the meaning given under 50 U.S.C. 4025a; 16
162162 (6) "servicemember" has the meaning given in 50 U.S.C. 3911. 17

168168 unless exempted under AS 08.13.160(d); 23

171171 school licensed under this chapter unless exempted under AS 08.13.160(d) or 26

181181 (5) operate a shop in violation of AS 08.13.120; 2

183183 exempted under AS 08.13.160(d) to practice barbering, hairdressing, hair braiding, 4
184184 manicuring, esthetics, body piercing, tattooing, or permanent cosmetic coloring 5
185185 without a license, [TEMPORARY PERMIT,] temporary license under AS 08.01.061, 6

187187 (7) permit the use of the person's license, [TEMPORARY PERMIT,] 8
188188 temporary license under AS 08.01.061, or student permit by another person; 9
189189 (8) obtain or attempt to obtain a license, [TEMPORARY PERMIT,] 10
190190 temporary license under AS 08.01.061, or student permit by fraudulent means. 11
191191 * Sec. 5. AS 08.13.120(b) is amended to read: 12
192192 (b) The regulations adopted under (a) of this section must include provisions 13
193193 under which the board may issue a temporary shop license to a person who has a 14
194194 license or temporary license under AS 08.01.061 [PERMIT UNDER THIS 15
195195 CHAPTER] to practice tattooing, permanent cosmetic coloring, or body piercing. The 16
196196 temporary shop license authorized under this subsection may only be issued to cover a 17
197197 site where the practitioner intends to hold a workshop or to demonstrate techniques as 18
198198 part of a convention or other special event, as defined by the board, that includes other 19
199199 practitioners of tattooing, permanent cosmetic coloring, or body piercing. Each 20
200200 practitioner of tattooing, permanent cosmetic coloring, or body piercing who holds a 21
201201 workshop or demonstrates techniques at a convention or special event shall have a 22
202202 separate temporary shop license and a license or temporary license under 23
203203 AS 08.01.061 [PERMIT UNDER THIS CHAPTER] to practice tattooing, permanent 24
204204 cosmetic coloring, or body piercing. The board shall issue a temporary shop license 25
205205 upon receipt of an application from a practitioner demonstrating compliance with the 26
206206 regulations adopted under this section and payment of the appropriate fee; however, 27
207207 the temporary shop license may be summarily revoked, without refunding of the fee, if 28
208208 the Department of Environmental Conservation determines after an inspection that the 29
209209 cleanliness or sanitation conditions at the site covered by the temporary shop license 30
210210 pose a clear and immediate danger to the public health or safety. A licensee may 31 34-GH1614\A

214214 appeal a summary revocation under this subsection to the superior court. 1
215215 * Sec. 6. AS 08.13.130(a) is amended to read: 2
216216 (a) A practitioner shall display the practitioner's license in a conspicuous 3
217217 location in the practitioner's place of business. Each shop owner is responsible for the 4
218218 conspicuous display of the shop's license and the licenses of employees and 5
219219 individuals renting booths in the shop. A person holding a student permit or [,] 6
220220 temporary license under AS 08.01.061 [, OR TEMPORARY PERMIT] shall display 7
221221 the permit or license in a conspicuous location in the school in which the person is 8
222222 enrolled or the shop in which the person works. The school or shop owner is 9
223223 responsible for the display of a permit or license for each enrolled student, apprentice, 10
224224 or temporary license holder. 11
225225 * Sec. 7. AS 08.13.150 is amended to read: 12
226226 Sec. 08.13.150. Disciplinary sanctions and grounds for refusal of a license 13
227227 or permit. The board may, in addition to the actions authorized under AS 08.01.075, 14
228228 refuse, suspend, or revoke a license, temporary shop license, student permit, or 15
229229 temporary license under AS 08.01.061 [, OR TEMPORARY PERMIT] for failure to 16
230230 comply with this chapter, with a regulation adopted under this chapter, with a 17
231231 regulation adopted by the Department of Environmental Conservation under 18
232232 AS 44.46.020, or with an order of the board. 19
233233 * Sec. 8. AS 08.13.175 is amended to read: 20
234234 Sec. 08.13.175. Temporary license. A person who receives a temporary 21
235235 license under AS 08.01.061 must work [MEETS THE REQUIREMENTS OF 22
236236 AS 08.13.080(a)(1), (2), (3), (4), OR (6) IS ENTITLED TO BE TEMPORARILY 23
237237 LICENSED AFTER APPLYING FOR EXAMINATION UNDER THIS CHAPTER 24
238238 IF THE APPLICANT WORKS] under the direct supervision, and within the physical 25
239239 presence, of a person who is licensed under this chapter. [IN THE AREA OF 26
240240 PRACTICE FOR WHICH THE APPLICANT HAS APPLIED FOR 27
241241 EXAMINATION. A TEMPORARY LICENSE ISSUED UNDER THIS SECTION IS 28
242242 VALID FOR 120 DAYS AND IS NONRENEWABLE. A PERSON MAY NOT 29
243243 RECEIVE MORE THAN ONE TEMPORARY LICENSE FOR EACH AREA OF 30

387387 occupational therapy without being licensed under this chapter unless the person is 4
388388 (1) a student in an accredited occupational therapy program or in a 5
389389 supervised field work program; 6
390390 (2) a graduate of a foreign school of occupational therapy fulfilling the 7
391391 internship requirement of AS 08.84.032, and then only unless under the continuous 8
392392 direction and immediate supervision of an occupational therapist; 9
393393 (3) an occupational therapist or occupational therapy assistant 10
394394 employed by the United States government while in the discharge of official duties; 11
395395 (4) granted a temporary license [LIMITED PERMIT] under 12
396396 AS 08.01.061 [AS 08.84.075]; 13
397397 (5) licensed under this title and uses occupational therapy skills in the 14
398398 practice of the profession for which the license is issued; or 15
399399 (6) employed as a teacher or teacher's aide by an educational 16
400400 institution and is required to use occupational therapy skills during the course of 17
401401 employment, if 18
402402 (A) the occupational therapy skills are used under a program 19
403403 implemented by the employer and developed by a licensed occupational 20
404404 therapist; 21
405405 (B) the employer maintains direct supervision of the person's 22
406406 use of occupational therapy skills; and 23
407407 (C) the person does not represent to 24
408408 (i) be an occupational therapist or occupational therapy 25
409409 assistant; and 26
410410 (ii) practice occupational therapy. 27
