3131 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 4
3232 * Section 1. AS 23.10 is amended by adding new sections to read: 5
3333 Article 9. Alaska Paid Parental Leave Program. 6
3434 Sec. 23.10.700. Paid parental leave program. The department shall 7
3535 administer the paid parental leave program established under AS 23.10.700 - 8
3636 23.10.795. 9
3737 Sec. 23.10.705. Parental leave fund account. The parental leave fund account 10
3838 is established in the general fund. The commissioner of administration shall separately 11
3939 account for money collected under AS 23.10.710 that the department deposits in the 12
4040 general fund. The legislature may appropriate the annual estimated balance in the 13
4141 account to the department to implement AS 23.10.700 - 23.10.795. The legislature 14 34-LS0612\G

4545 may appropriate the lapsing balance of the account to the unemployment 1
4646 compensation fund under AS 23.20.130. 2
4747 Sec. 23.10.710. Special employee unemployment contribution for paid 3
4848 parental leave program. (a) In the manner provided in AS 23.20 and for the benefit 4
4949 of the paid parental leave program, the department shall collect from each employee 5
5050 an amount equal to .15 percent of the wages, as set out in AS 23.20.175, on which the 6
5151 employee is required to make contributions under AS 23.20.290(d). The department 7
5252 shall remit money collected under this subsection in accordance with AS 37.10.050. 8
5353 (b) Notwithstanding AS 23.20.290(d), the department shall credit each 9
5454 employee with an amount equal to the amount collected from the employee under (a) 10
5555 of this section against unemployment contributions owed by the employee under 11
5656 AS 23.20. 12
5757 (c) The department shall assess and collect, under AS 23.20.185 - 23.20.275, 13
5858 interest and penalties for delinquent reports and payments due under this section. 14
5959 Interest and penalties collected shall be handled in accordance with AS 23.20.130(d). 15
6060 Sec. 23.10.715. Qualifying purpose. An eligible employee may use paid 16
6161 parental leave when the employee needs to be absent from work to 17
6262 (1) care for a child within 12 months of the anticipated birth of that 18
6363 child to, adoption of that child by, or placement of that child with the eligible 19
6464 employee; or 20
6565 (2) complete an adoption or foster placement process of a child before 21
6666 the child is adopted by or placed with the employee. 22
6767 Sec. 23.10.720. Paid parental leave claim. (a) The department shall establish 23
6868 by regulation procedures for filing a claim for paid parental leave under AS 23.10.700 24
6969 - 23.10.795, including a procedure for certifying that the leave is for a qualifying 25
7070 purpose under AS 23.10.715. 26
7171 (b) An employee may file a claim with the department for paid parental leave 27
7272 not more than 60 days before the anticipated start date of the qualifying absence from 28
7373 work nor more than 90 days after the date on which the qualifying absence from work 29
7474 began. The department may waive the 90-day filing deadline for good cause. The 30

7979 of an anticipated qualifying absence from work. The department may adjust claim data 1
8080 through a claim modification process established by the department. 2
8181 (c) The department may accept any of the following as sufficient evidence that 3
8282 a paid parental leave claim is for a qualifying purpose: 4
8383 (1) the child's birth certificate; 5
8484 (2) a document from the child's health care provider or the health care 6
8585 provider of the person who gave birth to the child, stating the child's date of birth; 7
8686 (3) a document from the child's health care provider, the adoption 8
8787 agency involved in the adoption, or another individual approved by the department 9
8888 confirming the adoption or anticipated adoption and the date of the adoption or 10
8989 anticipated adoption; 11
9090 (4) a document from the foster care agency involved in the child's 12
9191 placement, or from another individual approved by the department, confirming the 13
9292 placement or anticipated placement of the child for foster care; or 14
9393 (5) a form signed by the employee acknowledging paternity of the 15
9494 child that meets the requirements of AS 18.50.165. 16
9595 Sec. 23.10.725. Eligibility; benefit amount; duration. (a) An employee who 17
9696 is paid at least $2,500 in wages during at least two of the calendar quarters of the 18
9797 employee's base period is eligible to receive paid parental leave beginning the first day 19
9898 of absence from work for a qualifying purpose under AS 23.10.715. 20
9999 (b) The department shall calculate an employee's base period for purposes of 21
100100 (a) of this section using the first four of the last five completed calendar quarters 22
101101 immediately preceding the first day of the employee's benefit year, except that, if an 23
102102 employee would not otherwise be eligible for paid parental leave because of the use of 24
103103 a base period that does not include the most recently completed calendar quarter 25
104104 immediately preceding the first day of the employee's benefit year, the department 26
105105 shall calculate the employee's base period and determine the employee's eligibility 27
106106 using the four most recently completed calendar quarters before the start of the benefit 28
107107 year. For an individual who has been separated from employment for not more than 26 29
108108 weeks, the department shall calculate the individual's base period using the first four 30
109109 of the last five completed calendar quarters immediately preced

114114 separation from employment, except that, if an individual would not otherwise be 1
115115 eligible for paid parental leave because of the use of a base period that does not 2
116116 include the most recently completed calendar quarter, the department shall calculate 3
117117 the individual's base period and determine the individual's eligibility using the four 4
118118 most recently completed calendar quarters before the start of the benefit year. 5
119119 (c) The department shall determine an eligible employee's weekly benefit in 6
120120 the same manner as provided in AS 23.20.350(d). The department shall prorate the 7
121121 weekly benefit amount in accordance with AS 23.10.730 for an employee using an 8
122122 intermittent or a reduced leave schedule. 9
123123 (d) The maximum number of weeks for which an eligible employee may take 10
124124 paid parental leave, and for which paid parental leave insurance benefits are payable in 11
125125 a benefit year, is 26 weeks, cumulative. For employees using intermittent leave or a 12
126126 reduced leave schedule, the department shall calculate the cumulative period of weeks 13
127127 used by the employee in accordance with AS 23.10.730. 14
128128 (e) In this section, "benefit year" means a period of 52 consecutive weeks 15
129129 beginning at 12:00 a.m. of the Sunday preceding the day that an eligible employee 16
130130 first files a claim for paid parental leave and, thereafter, the period of 52 consecutive 17
131131 weeks beginning at 12:00 a.m. of the Sunday preceding the day that the insured 18
132132 worker next files the claim after the end of the eligible employee's last preceding 19
133133 benefit year; however, for an eligible employee covered by this subsection, "benefit 20
134134 year" also means a period of 53 weeks if the filing of a claim for paid parental leave 21
135135 would result in overlapping any quarter of the base year of a previously filed request 22
136136 for paid parental leave. 23
137137 Sec. 23.10.730. Intermittent or reduced leave schedule. (a) An eligible 24
138138 employee may choose to take paid parental leave on an intermittent or reduced leave 25
139139 schedule rather than taking the full leave period consecutively. The department shall 26
140140 prorate paid parental leave benefits taken in increments of less than one week. The 27
141141 minimum amount of leave that may be claimed is one day during any claim week. 28
142142 (b) Paid parental leave taken under this section may not result in a reduction of 29
143143 the total amount of leave a covered employee is entitled to take. 30
144144 Sec. 23.10.735. Elective coverage. (a) A self-employed individual may elect

149149 coverage under AS 23.10.700 - 23.10.795 for an initial period of not less than three 1
150150 years. 2
151151 (b) A self-employed individual who elects coverage is eligible for paid 3
152152 parental leave benefits as soon as the self-employed person meets the requirements 4
153153 under AS 23.10.725. 5
154154 (c) A self-employed individual who has elected coverage may withdraw from 6
155155 coverage within 30 days after the end of the three-year coverage period, or at other 7
156156 times specified by the department in regulation, by submitting written notice to the 8
157157 department. A withdrawal takes effect not sooner than 30 days after the notice is filed. 9
158158 (d) The department shall relieve an individual who has elected coverage under 10
159159 this section from obligations under this section if the individual is no longer self-11
160160 employed or if the individual no longer works in the state. 12
161161 (e) As a condition of election of coverage, a self-employed individual shall 13
162162 agree to supply any information concerning income that the department considers 14
163163 necessary. 15
164164 Sec. 23.10.740. Coordination of benefits. (a) Leave taken under the paid 16
165165 parental leave program shall run concurrently with leave that also qualifies as leave 17
166166 under 29 U.S.C. 2601 - 2654 (Family and Medical Leave Act) or AS 39.20.500 - 18
167167 39.20.550. 19
168168 (b) An employer may require that payments for paid parental leave under 20
169169 AS 23.10.700 - 23.10.795 be made concurrently with, or coordinated with, payments 21
170170 or leave provided under a short-term disability policy or a separate bank of paid time 22
171171 off designated specifically for parental leave under a collective bargaining agreement 23
172172 or employer policy. The employer must provide employees written notice of this 24
173173 requirement. 25
174174 (c) An employee may not be required to use or exhaust any accrued vacation 26
175175 leave, sick leave, or other paid time off before or while receiving paid parental leave 27
176176 benefits under AS 23.10.700 - 23.10.795. However, the employee may choose to use 28
177177 accrued vacation leave, sick leave, or other paid time off while receiving paid parental 29
178178 leave benefits under AS 23.10.700 - 23.10.795 if the total amount received does not 30

183183 (d) Paid parental leave under AS 23.10.700 - 23.10.795 does not relieve an 1
184184 employer from the obligation to comply with more generous terms included in a 2
185185 collective bargaining agreement or employment contract. 3
186186 Sec. 23.10.745. Disqualification. In addition to any other penalty that may 4
187187 apply, an employee may be disqualified from paid parental leave benefits for up to one 5
188188 year if the department determines the employee intentionally made a false statement or 6
189189 misrepresentation of a material fact, or intentionally failed to report a material fact, to 7
190190 obtain paid parental leave. 8
191191 Sec. 23.10.750. Appeals. The department shall establish a process for an 9
192192 employee to appeal a determination by the department regarding a paid parental leave 10
193193 claim within 90 days after receiving notice of the determination. 11
194194 Sec. 23.10.755. Recovery of improper payments. (a) An employee who 12
195195 receives paid parental leave to which the employee is not entitled under AS 23.10.700 13
196196 - 23.10.795 shall repay to the department the amount improperly paid. The department 14
197197 shall deposit the payment in the parental leave fund account established in 15
198198 AS 23.10.705. 16
199199 (b) The department shall promptly prepare and send a notice of determination 17
200200 to the employee at the employee's last address of record, stating that the employee is 18
201201 required to repay the amount of paid parental leave received in error. If the employee 19
202202 does not repay the amount received in error within a reasonable time set by the 20
203203 department, the department shall deduct the amount from future paid parental leave 21
204204 benefits owed to the employee or from the permanent fund dividend of the employee 22
205205 under AS 43.23.140(b)(6). However, the department may waive repayment of all or a 23
206206 portion of the amount of paid parental leave received in error if the department 24
207207 determines that the employee has died or has acted in good faith when claiming and 25
208208 receiving paid parental leave benefits and that requiring repayment would be unfair or 26
209209 inequitable. 27
210210 (c) If the employee has not repaid the paid parental leave benefit or if the 28
211211 amount has not been deducted from future benefits or the permanent fund dividend of 29
212212 the employee within two years after the last day of the year in which payment was 30
213213 made, the commissioner may declare the amount uncollectible. 31 34-LS0612\G

217217 Sec. 23.10.760. Annual report. On or before July 1 of each year, the 1
218218 department shall submit a report to the senate secretary and the chief clerk of the 2
219219 house of representatives and notify the legislature that the report is available. The 3
220220 department shall make the report available to the public on the department's Internet 4
221221 website. The report must include 5
222222 (1) the actual and projected number of participants in the program; 6
223223 (2) demographic information on program participants, including 7
224224 occupation and employment type and whether the leave was taken for the birth of a 8
225225 child, adoption of a child, or the placement of a foster child; 9
226226 (3) the average weekly benefit; 10
227227 (4) the average leave duration; 11
228228 (5) the current and projected fund balance; 12
229229 (6) the processing time for initial claims and determinations; 13
230230 (7) the number of claim denials and stated reasons for claim denials; 14
231231 (8) the number of appeals filed and outcomes related to those appeals; 15
232232 (9) the average length of time between application and receipt of 16
233233 benefits; 17
234234 (10) a description of the department's outreach efforts. 18
235235 Sec. 23.10.765. Public education and outreach campaign. The department 19
236236 shall conduct a public education and outreach campaign to educate employees and 20
237237 employers about the availability of paid parental leave. 21
238238 Sec. 23.10.770. Employment protection; health insurance maintenance; 22
239239 enforcement. (a) An eligible employee who takes paid parental leave under 23
240240 AS 23.10.700 - 23.10.795 is entitled to return to the position the employee held when 24
241241 the leave began or to be restored to an equivalent position with equivalent seniority, 25
242242 pay, benefits, working hours, and other terms and conditions of employment, 26
243243 including service credits the employee was entitled to at the start of paid parental 27
244244 leave. 28
245245 (b) During any period of qualified paid parental leave, the employer shall 29
246246 maintain the employee's health care benefits on the same terms as before the leave 30
247247 began. The employee shall continue to pay the employee's share

253253 (c) An employer may not take or threaten any adverse employment action or 2
254254 discriminate against the employee for applying for or using paid parental leave under 3
255255 AS 23.10.700 - 23.10.795. 4
256256 (d) An employer may not take any action that prevents or discourages an 5
257257 employee from taking paid parental leave under AS 23.10.700 - 23.10.795, including 6
258258 failing to provide timely and complete information required by the department or 7
259259 reporting or threatening to report suspected citizenship or immigration status of the 8
260260 employee or an employee's family member. 9
261261 (e) An employer may not adopt or enforce a policy that allows paid parental 10
262262 leave taken under AS 23.10.700 - 23.10.795 to be considered as an absence that could 11
263263 result in discipline, discharge, demotion, suspension, or any other adverse action 12
264264 against the employee. 13
265265 (f) The department shall establish a complaint process by regulation for an 14
266266 employee who believes the employee's employer violated this section. A complaint 15
267267 must be filed within two years after the violation occurred or the date the employee 16
268268 reasonably should have known about the violation, whichever is later. 17
269269 (g) After granting the employer a reasonable opportunity for a fair hearing, or 18
270270 after the employer acknowledges that a violation occurred, the department may 19
271271 determine whether a violation occurred. If the department determines a violation 20
272272 occurred, the department may order the employer to remedy the violation, which may 21
273273 include 22
274274 (1) granting the requested paid parental leave; 23
275275 (2) providing up to two years of back pay, plus interest; 24
276276 (3) reinstating the employee; 25
277277 (4) paying to the complainant attorney fees allowed under the Alaska 26
278278 Rules of Civil Procedure; 27
279279 (5) other relief the department considers appropriate. 28
280280 (h) After the department issues a final determination, either party may appeal 29
281281 the determination to a court of competent jurisdiction. 30
282282 Sec. 23.10.775. Notice to employees. (a) An employer shall provide written 31 34-LS0612\G

286286 notice to each employee upon hiring, and annually thereafter, of the benefits available 1
287287 under AS 23.10.700 - 23.10.795. The notice must include 2
288288 (1) the employee's right to paid parental leave benefits under 3
289289 AS 23.10.700 - 23.10.795 and the terms under which the benefits may be used; 4
290290 (2) the amount of paid parental leave available; 5
291291 (3) the procedure for filing a claim for paid parental leave benefits; 6
292292 (4) notice that discrimination and retaliatory personnel actions against 7
293293 the employee for requesting, applying for, or using paid parental leave benefits is 8
294294 prohibited; and 9
295295 (5) notice that the employee has a right to file a complaint for a 10
296296 violation of AS 23.10.700 - 23.10.795. 11
297297 (b) Each employer shall display and maintain a poster in a conspicuous place 12
298298 accessible to employees at the employer's place of business that contains the 13
299299 information required by this section in a form approved by the department. 14
300300 Sec. 23.10.780. Child support interception. (a) Notwithstanding any other 15
301301 provision of AS 23.10.700 - 23.10.795, an individual filing a new claim for paid 16
302302 parental leave must disclose whether child support obligations are owed by that 17
303303 individual. If the individual discloses that child support obligations are owed and the 18
304304 individual is determined to be eligible for paid parental leave, the department shall 19
305305 notify the child support services agency of the Department of Revenue that the 20
306306 individual has been determined to be eligible for paid parental leave. 21
307307 (b) The department shall, unless the obligor and obligee agree otherwise, 22
308308 deduct and withhold from paid parental leave compensation payable to an individual 23
309309 who owes child support obligations 24
310310 (1) the amount specified by the individual to the department to be 25
311311 deducted and withheld under this subsection, if neither (2) nor (3) of this subsection is 26
312312 applicable; 27
313313 (2) the amount specified in an agreement submitted to the department 28
314314 under 42 U.S.C. 654(19)(B)(i) (sec. 454(19)(B)(i), Social Security Act), by the child 29
315315 support services agency of the Department of Revenue, unless (3) of this subsection is

321321 (3) any amount required to be deducted and withheld through legal 1
322322 process, as defined in 42 U.S.C. 662(e) (sec. 462(e), Social Security Act), properly 2
323323 served on the department. 3
324324 (c) The department shall pay an amount deducted and withheld under (b) of 4
325325 this section to the child support services agency of the Department of Revenue. 5
326326 (d) An amount deducted and withheld under (b) of this section shall for all 6
327327 purposes be treated as if it were paid to the individual as paid parental leave and paid 7
328328 by that individual to the child support services agency of the Department of Revenue 8
329329 in satisfaction of the individual's child support obligations. 9
330330 (e) This section applies only if appropriate arrangements have been made for 10
331331 reimbursement by the child support services agency of the Department of Revenue for 11
332332 the administrative costs incurred by the department under this section. 12
333333 (f) In this section, "child support obligation" includes only obligations that are 13
334334 being enforced under a plan described in 42 U.S.C. 654 (sec. 454, Social Security 14
335335 Act), which has been approved by the United States Secretary of Health and Human 15
336336 Services under 42 U.S.C. 651-665 (Part D of Title IV of the Social Security Act). 16
337337 Sec. 23.10.785. Federal income tax withholding. (a) If the Internal Revenue 17
338338 Service determines that paid parental leave benefits under AS 23.10.700 - 23.10.795 18
339339 are subject to federal income tax, when an individual files a new claim for paid 19
340340 parental leave, the department shall advise the individual that 20
341341 (1) paid parental leave compensation benefits are subject to federal 21
342342 income tax; 22
343343 (2) federal requirements exist pertaining to estimated federal tax 23
344344 payments; 24
345345 (3) the individual may elect to have federal income tax deducted and 25
346346 withheld from the individual's payment of paid parental leave at the amount specified 26
347347 in 26 U.S.C. (Internal Revenue Code); and 27
348348 (4) the individual is permitted to change a previously elected status for 28
349349 the withholding of federal income tax. 29
350350 (b) Amounts deducted for federal income taxes and withheld fro

358358 (c) The department shall comply with legal requirements of the federal 3
359359 Department of Labor and the Internal Revenue Service regarding the deduction and 4
360360 withholding of federal income tax. 5
361361 Sec. 23.10.795. In AS 23.10.700 - 23.10.795, 6
362362 (1) "employee" means a person in the service of an employer; 7
363363 (2) "employer" has the meaning given in AS 23.20.520; 8
364364 (3) "employment" has the meanings given in AS 23.20.525 and 9
365365 23.20.526. 10

703703 under AS 25.27.165 and 25.27.166, including procedures for hearings; and 8
704704 (D) procedures under which the agency shall enter into 9
705705 contracts or agreements with financial institutions, including brokerage houses, 10
706706 insurance companies, and other companies providing individual investment, 11
707707 transaction, or deposit accounts, doing business in the state to develop and 12
708708 operate an automated data match system as required by 42 U.S.C. 666(a)(17); 13
709709 the agency may pay a reasonable fee to a financial institution for conducting a 14
710710 data match under a contract or agreement under this subparagraph; the fee may 15
711711 not exceed the actual costs incurred by the financial institution for conducting 16
712712 the data match; 17
713713 (3) administer and enforce AS 25.25 (Uniform Interstate Family 18
714714 Support Act); 19
715715 (4) establish, enforce, and administer child support obligations 20
716716 administratively under this chapter; 21
717717 (5) administer the state plan required under 42 U.S.C. 651 - 669 (Title 22
718718 IV-D, Social Security Act) as amended; 23
719719 (6) disburse support payments collected by the agency to the obligee, 24
720720 together with interest charged under (2)(B) of this subsection; 25
721721 (7) establish and enforce administratively under this chapter, or 26
722722 through the superior courts of the state, child support orders from other jurisdictions 27
723723 pertaining to obligors within the state; 28
724724 (8) enforce and administer spousal support orders if a spousal support 29
725725 obligation has been established with respect to the spouse and if the support obligation 30

734734 (11) establish or disestablish, administratively under AS 25.27.165 - 5
735735 25.27.166 or through court action, the paternity of a child; 6
736736 (12) promptly provide to the Bureau of Vital Statistics, in a format 7
737737 approved by the bureau, any final agency decision administratively establishing or 8
738738 disestablishing the paternity of a child born in this state; and 9
