2829 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
2930 * Section 1. AS 44.21.020 is amended to read: 4

5556 * Sec. 2. AS 44.21 is amended by adding a new section to read: 13
5657 Sec. 44.21.022. Address confidentiality program. (a) The address 14
5758 confidentiality program is established in the department to protect the confidentiality 15
5859 of the address of an individual enrolled in the program. 16
5960 (b) The department shall 17
6061 (1) establish and administer the program; 18
6162 (2) designate a post office box as a substitute mailing address for an 19
6263 individual enrolled in the program; 20
6364 (3) forward the mail of an individual enrolled in the program from the 21
6465 post office box designated under (2) of this subsection to the individual's residential 22
6566 street address, post office box, school address, or work address as specified on the 23
6667 individual's application for enrollment in the program; 24
6768 (4) maintain the confidentiality of the address of an individual enrolled 25
6869 in the program; and 26
6970 (5) adopt regulations establishing a procedure for a qualified individual 27
7071 under (c) of this section to enroll in or withdraw from the program. 28
7172 (c) The following individuals may enroll in the program: 29
7273 (1) a victim of a crime involving domestic violence, stalking, or sexual 30

7778 (A) a court has issued a protective order on behalf of the 1
7879 victim; or 2
7980 (B) the victim meets other standards set by the department; 3
8081 (2) a guardian of a minor, if a court has issued a protective order on 4
8182 behalf of the minor; 5
8283 (3) a peace officer; 6
8384 (4) a correctional officer; and 7
8485 (5) a household member of an individual specified under (1) - (4) of 8
8586 this subsection who is enrolled in the program. 9
8687 (d) Notwithstanding (c) of this section, a person with a duty to register under 10
8788 AS 12.63.010 may not enroll in the program. 11
8889 (e) A state or municipal agency shall allow an individual enrolled in the 12
8990 program to use the post office box designated by the department under (b)(2) of this 13
9091 section as the individual's mailing address. 14
9192 (f) The length of initial enrollment in the program is five years. If an 15
9293 individual enrolled in the program does not renew the individual's enrollment in the 16
9394 program every five years, the department shall remove the individual from the 17
9495 program. The department shall remove an individual enrolled in the program if, during 18
9596 the time of the individual's enrollment in the program, the individual is required to 19
9697 register under AS 12.63.010. 20
9798 (g) The department may not collect a registration fee from an individual 21
9899 qualified under (c) of this section to enroll in the program. 22
99100 (h) The department shall disclose an individual's address to a peace officer in 23
100101 response to a search warrant issued by a state or federal court. 24
101102 (i) A person who discloses information that is confidential under this section 25
102103 about an individual enrolled in the program under (c) of this section is guilty of a class 26
103104 B misdemeanor if the person 27
104105 (1) is authorized to access the address confidentiality program database 28
105106 and recklessly discloses the information to the respondent of a protective order; 29
106107 (2) is not authorized to access the address confidentiality program 30

112113 (3) accesses the address confidentiality program database without 2
113114 authorization to access the database and recklessly discloses the information. 3
114115 (j) In this section, 4
115116 (1) "correctional officer" means a person 5
116117 (A) appointed by the commissioner of corrections whose 6
117118 primary duty under AS 33.30 is to provide custody, care, security, control, and 7
118119 discipline of persons charged or convicted of offenses against the state or held 8
119120 under authority of state law; 9
120121 (B) employed in a correctional facility in this state whose 10
121122 primary duty is to provide custody, care, security, control, and discipline of 11
122123 persons charged or convicted of offenses or held under authority of law; or 12
123124 (C) employed full time in a municipal correctional facility 13
124125 whose primary duty is to provide custody, care, security, control, and 14
125126 discipline of persons charged or convicted of offenses or held under authority 15
126127 of law, and the correctional facility is located in a municipality that has 16
127128 adopted AS 18.65.130 - 18.65.290 by ordinance under AS 18.65.285; 17
128129 (2) "crime involving domestic violence" has the meaning given in 18
129130 AS 18.66.990; 19
130131 (3) "department" means the Department of Administration; 20
131132 (4) "household member" means an adult or minor who lives in the 21
132133 same residence as an individual enrolled in the program; 22
133134 (5) "peace officer" has the meaning given in AS 01.10.060; 23
134135 (6) "program" means the address confidentiality program. 24
135136 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 25
136137 read: 26
137138 TRANSITION: REGULATIONS. The Department of Administration may adopt 27
138139 regulations necessary to implement AS 44.21.022, enacted by sec. 2 of this Act. The 28
139140 regulations take effect under AS 44.62 (Administrative Procedure Act) but not before the 29
140141 effective date of the law being implemented by the regulation. 30
