2929 22 prohibit the annexation by local law of any property within

3232 25 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3333 26 Section 1. The following amendment to the
3434 27 Constitution of Alabama of 1901, is proposed and shall become
3535 Page 1 1 valid as a part of the Constitution when all requirements of
3636 2 this act are fulfilled:

3838 4 (a) For the purposes of this amendment, the "White
3939 5 House Fork Landmark District" in Baldwin County is defined as

259259 9 (b) No property within the White House Fork Landmark
260260 10 District may be annexed into any municipality by local law.
261261 11 (c) Subsection (b) shall not apply to any
262262 12 municipality incorporated after the ratification of this
263263 13 amendment which includes any part of the White House Fork
264264 14 Landmark District.
265265 15 (d) The White House Fork Landmark District shall not
266266 16 be considered a legal entity and shall not have any of the
267267 17 following powers or authority:
268268 18 (1) Standing to sue or be sued.
269269 19 (2) Taxing authority.
270270 20 (3) Zoning authority.
271271 21 (4) Police power and public safety authority.
272272 22 (5) Authority to adopt ordinances, rules, or
273273 23 regulations within its boundaries.
274274 24 (6) Any other authority or power commonly associated
275275 25 with a legal entity.
276276 26 (e) Upon ratification of this constitutional
277277 27 amendment and contingent upon the ratification of the
278278 Page 10 1 Constitution of Alabama of 2022, the Code Commissioner shall
279279 2 number and place this amendment as appropriate in the
280280 3 constitution based upon a logical sequence and the particular
281281 4 subject or topic of the amendment. In this amendment, the Code
282282 5 Commissioner may change capitalization, spelling, and
283283 6 punctuation for the purpose of style and uniformity; correct
284284 7 manifest grammatical, clerical, and typographical errors; and
285285 8 correct incorrect cross-references. The Code Commissioner,
286286 9 during publication, may also omit this instructional
287287 10 paragraph.
288288 11 Section 2. An election upon the proposed amendment
289289 12 shall be held at the general election in November 2022 in
290290 13 accordance with Section 284.01 of the Constitution of Alabama
291291 14 of 1901, now appearing as Section 284.01 of the Official
292292 15 Recompilation of the Constitution of Alabama of 1901, as
293293 16 amended, and the election laws of this state.
294294 17 Section 3. The appropriate election official shall
295295 18 assign a ballot number for the proposed constitutional
296296 19 amendment on the election ballot and shall set forth the
297297 20 following description of the substance or subject matter of
298298 21 the proposed constitutional amendment:
299299 22 "Relating to Baldwin County, proposing an amendment
300300 23 to the Constitution of Alabama of 1901, to define the White
301301 24 House Fork Landmark District within the county and to prohibit
302302 25 the annexation by local law of any property within the
303303 26 district into any municipality except under certain
304304 27 conditions.
