9-2 ENROLLED, An Act,
10-3 To make supplemental appropriations from the
11-4 Education Trust Fund totaling $1,283,283,616 to various
12-5 agencies and entities for the fiscal year ending September 30,
13-6 2022; and to amend Section 3B of Act 2021-342 of the 2021
14-7 Regular Session, the Education Trust Fund Appropriations Act
15-8 for the fiscal year ending September 30, 2022, to clarify the
16-9 intent regarding an appropriation to the Department of
17-10 Education.
18-11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
19-12 Section 1. In addition to all other appropriations
20-13 heretofore or hereafter made, there is hereby appropriated a
21-14 total of $1,283,283,616 from the Education Trust Fund to the
22-15 following agencies and entities for the purposes specified
23-16 below for the fiscal year ending September 30, 2022:
24-17 (1) $177,373,600 to the State Treasurer's Office for
25-18 the PACT Program to fully and finally satisfy the entirety of
26-19 the state's present and future obligation pursuant to Section
27-20 16-33C-16, Code of Alabama 1975.
28-21 (2) $58,400,000 to the Teachers' Retirement System
29-22 for a one-time longevity bonus for retirees of the Teachers'
30-23 Retirement System, pursuant to SB30, Act 2022-178 of the 2022
31-24 Regular Session authorizing such bonus.

16+10 agencies and entities for the fiscal year ending September 30,

18+12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
19+13 Section 1. In addition to all other appropriations
20+14 heretofore or hereafter made, there is hereby appropriated a
21+15 total of $1,283,283,616 from the Education Trust Fund to the
22+16 following agencies and entities for the purposes specified
23+17 below:
24+18 (1) $177,373,600 to the State Treasurer's Office for
25+19 the PACT Program to fully and finally satisfy the entirety of
26+20 the state's present and future obligation pursuant to Section
27+21 16-33C-16, Code of Alabama 1975.
28+22 (2) $58,400,000 to the Teachers' Retirement System
29+23 for a one-time longevity bonus for retirees of the Teachers'
30+24 Retirement System. This appropriation is conditioned upon the
31+25 enactment of SB30 or HB137 during the 2022 Regular Session
32+26 authorizing such bonus.

3434 2 Advancement and Technology Fund to be allocated in accordance
3535 3 with Section 29-9-4, Code of Alabama 1975.
3636 4 (4) $1,250,000 to the Department of Commerce to be
3737 5 used for Alex: The Alabama Experience at the World Games and
3838 6 thereafter to support workforce efforts throughout the state.
3939 7 (5) $5,250,000 to the Marine Environmental Sciences
4040 8 Consortium. Of this appropriation, $4,000,000 shall be
4141 9 expended for renovations on student dormitories; $500,000
4242 10 shall be expended for modernization of the HVAC and food
4343 11 storage systems and serving line in the cafeteria; and
4444 12 $750,000 shall be expended for replacement of a graduate
4545 13 student office/K-12 computer laboratory building.
4646 14 (6) $7,000,000 to the Geological Survey to construct
4747 15 a new Core and Sample Repository Building.
4848 16 (7) $1,000,000 to the Alabama Department of
4949 17 Veterans' Affairs to be used to renovate the Alabama Veteran's
5050 18 Museum in Athens.
5151 19 (8) $1,500,000 to the Alabama Fire Fighters
5252 20 Personnel Standards and Education Commission/Alabama Fire
5353 21 College to be used for a new building that will house the
5454 22 mobile fleet of tractor-drawn training props.
55-23 (9) $3,600,000 to the Alabama Department of Human
56-24 Resources to be used for one-time expansion/development of
57-25 placements and programs designed for high risk foster

59-1 children/youth, of which $75,000 shall be expended for Beacon
60-2 House in Jasper.
61-3 (10) $60,000,000 to the Alabama Innovation Fund. Of
62-4 this appropriation, $15,000,000 shall be expended for Hudson
63-5 Alpha Institute for Biotechnology; and $45,000,000 shall be
64-6 expended for the Southern Research Institute.
65-7 (11) $117,681,460 to the Education Trust Fund Budget
66-8 Stabilization Fund established by Section 29-9-4, Code of
67-9 Alabama 1975. Of this amount, $111,181,460 shall be used to
68-10 fully fund the required balance, and $6,500,000 shall be used
69-11 to pay advanced unreimbursed insurance claims for Jacksonville
70-12 State University.
71-13 (12) $25,105,000 to the Alabama Community College
72-14 System. Of this appropriation, $3,400,000 shall be used for
73-15 one-time expenses for the Southern Union Community College
74-16 Aviation project; $3,000,000 shall be used for one-time
75-17 expenses for the Wallace State Community College-Oneonta
76-18 Blount County multi-purpose complex; $230,000 shall be used
77-19 for one-time expenses for the Wallace State Community
78-20 College-Hanceville Winston County Learning Center project;
79-21 $2,000,000 shall be used for the Central Alabama Community
80-22 College for one-time expenses for Marine Technology and
81-23 Building Construction facility; $3,470,000 shall be used for
82-24 one-time expenses for the Coastal Alabama Community College
83-25 Career Tech Center; $1,100,000 shall be used for one-time

85-1 expenses for the Northeast Alabama Community College Career
86-2 Planning Center; $590,000 shall be used for the Gadsden State
87-3 Community College-Ayers Campus for one-time expenses for
88-4 digital bulletin boards and new roofing; $105,000 shall be
89-5 used for one-time capital improvement expenses for the Gadsden
90-6 State Community College-Cherokee Campus; $950,000 shall be
91-7 used for one-time expenses for the Jackson County Innovation
92-8 and Career Academy; $3,400,000 shall be used for one-time
93-9 expenses for Snead State Community College; $3,380,000 shall
94-10 be used for Calhoun Community College for one-time expenses
95-11 for the Alabama Center for the Arts Academy; and $3,480,000
96-12 shall be used for one-time expenses for Bevill State Community
97-13 College.
98-14 (13) $2,500,000 to Alabama A&M University to be used
99-15 for one-time infrastructure improvements.
100-16 (14) $525,000 to Athens State University. Of this
101-17 appropriation, $250,000 shall be used for one-time expenses
102-18 for the Cyber Lab; $200,000 shall be used for one-time
103-19 expenses for the Center for Excellence in Education Diversity;
104-20 and $75,000 shall be used for one-time expenses for the Arts
105-21 Center.
106-22 (15) $14,325,419 to Auburn University at Montgomery
107-23 to be used for one-time expenses for the STEM Lab.

109-1 (16) $3,200,000 to the University of North Alabama
110-2 to be used for one-time expenses for the power production
111-3 workforce training program.
112-4 (17) $3,490,000 to the University of Alabama at
113-5 Birmingham to be used for one-time expenses for the School of
114-6 Dentistry-Dothan Campus.
115-7 (18) $2,000,000 to Troy University to be used for
116-8 one-time expenses for the audio-visual pilot project.
117-9 (19) $450,000 to the University of West Alabama to
118-10 be used for one-time expenses for amphitheater improvements.
119-11 (20) $7,500,000 to the University of South Alabama
120-12 to be used for one-time expenses for the engineering building.
121-13 (21) $2,070,000 to Tuskegee University. Of this
122-14 appropriation, $2,000,000 shall be used for one-time expenses
123-15 for capital projects; and $70,000 shall be used for one-time
124-16 expenses for memorial monument construction.
125-17 (22) $1,350,000 to Alabama State University. Of this
126-18 appropriation, $1,000,000 shall be used for one-time expenses
127-19 for improvements to the music and fine arts facilities;
128-20 $200,000 shall be used for one-time expenses for the National
129-21 Center for the Civil Rights and African Culture; and $150,000
130-22 shall be used for one-time expenses for the Forensics Sciences

133-1 (23) $18,000,000 to the University of Alabama in
134-2 Huntsville to be used for one-time expenses for the
135-3 engineering building.
136-4 (24) $2,000,000 to the University of Montevallo to
137-5 be used for one-time expenses for electric repairs.
138-6 (25) $3,989,000 to the Alabama Space Science Exhibit
139-7 Commission. Of this appropriation, $3,000,000 shall be used
140-8 for one-time expenses for the Shuttle Pathfinder restoration;
141-9 and $989,000 shall be used for one-time expenses for rocket
142-10 removal at the I-65 welcome station.
143-11 (26) $500,000 to the Alabama Institute for the Deaf
144-12 and Blind.
145-13 (27) $700,000 to the Department of Public Health for
146-14 a new mobile facility for hearing screening for the Lions
147-15 Club.
148-16 (28) $2,670,000 to the Alabama Commission on Higher
149-17 Education. Of this appropriation, $270,000 shall be used for
150-18 the Best and Brightest STEM Pilot Program under the same terms
151-19 and conditions as Act 2020-204; $100,000 shall be expended for
152-20 the Trails Foundation and allocated for the Singing River
153-21 Trail; $800,000 shall be used for the Alabama National Guard
154-22 Education Assistance Scholarships; $1,200,000 shall be used
155-23 for one-time expenses for the USS Alabama; $150,000 shall be
156-24 used for one-time expenses for the Museum of Flight; and

158-1 $150,000 shall be used for one-time expenses for the
159-2 Humanities Foundation for the Healing History Program.
160-3 (29) $6,875,000 to the Department of Education. Of
161-4 this appropriation, $2,800,000 shall be used for the American
162-5 Village for one-time expenses for Independence Hall
163-6 construction; $50,000 shall be used for one-time expenses for
164-7 the Sports Officials Foundation; $50,000 shall be expended for
165-8 the Jazz Hall of Fame for the music education program;
166-9 $200,000 shall be used for the Office of Math Improvement;
167-10 $200,000 shall be used for the Encyclopedia of Alabama;
168-11 $475,000 shall be used for the Stillman Teacher Prep Program;
169-12 $500,000 shall be expended for Ed Farm; and $100,000 shall be
170-13 expended for Kindervision.
171-14 (30) $100,000 to the Alabama Music Hall of Fame.
172-15 (31) $50,000 to the State Commission on Physical
173-16 Fitness for the Alabama Sports Council.
174-17 (32) $475,000 to the Alabama Department of Examiners
175-18 of Public Accounts for the PCG Contract.
176-19 (33) $1,000,000 to the Alabama Educational
177-20 Television Commission to be used for one-time expenses for
178-21 studio renovations.
179-22 (34) $475,000 to the Alabama Historical Commission
180-23 to be used for one-time expenses for Fort Toulouse/Fort
181-24 Jackson.

183-1 (35) $500,000 to the Alabama Supercomputer Authority
184-2 for cyber security and IT support for K-12 schools in
185-3 consultation with ALET, to be expended for professional
186-4 development for all education employees in the form of
187-5 software-based cyber security training focused on improving
188-6 digital security.
189-7 Section 2. Section 3B of Act 2021-342, the Education
190-8 Trust Fund Appropriations Act for the fiscal year ending
191-9 September 30, 2022, is hereby amended as follows:
192-10 "13. Education, Department of:
193-11 (a) Administrative Services Program
194-12 The proposed spending plan for the ETF monies
195-13 included in the above program is as follows:
196-14 Operations and Maintenance of the Department.

198-16 Of the above appropriation, $3,000,000 shall be
199-17 expended for a grant program to be administered by the State
200-18 Superintendent of Education to address unmet capital,
201-19 equipment, or other needs of K-12 schools, of which $1,000,000
202-20 shall be expended for one-time recreational facility needs at
203-21 Springville High School in St. Clair County. Remaining
204-22 individual Individual grant amounts may not exceed $250,000
205-23 $500,000 for any one system. The Superintendent shall notify
206-24 all members of the local legislative delegation five days
207-25 prior to the announcement of any grant made to any K-12 school

209-1 located in the legislative jurisdiction. The five days prior
210-2 notice requirement shall be waived in the event of a declared
211-3 emergency. The State Superintendent of Education shall report
212-4 all grants awarded to the Chairs of the Senate Committee on
213-5 Finance and Taxation-Education, the House Ways and
214-6 Means-Education Committee, and the Deputy Director of the
215-7 Legislative Services Agency-Fiscal Division. Such report shall
216-8 include, amounts awarded and intended use of funds."
217-9 Section 3. All funds appropriated in this act not
218-10 expended in the fiscal year ending September 30, 2022, shall
219-11 not revert, but shall be carried forward for the purpose
220-12 appropriated.
221-13 Section 4. This act shall become effective
222-14 immediately following its passage and approval by the
223-15 Governor, or its otherwise becoming law.

55+23 (9) $200,000,000 to the Education Trust Fund Debt
56+24 Service Sinking Fund to be used for the existing debt service
57+25 on the following bonds: GO 2014-A, GO 2016-C, GO 2018-A, GO
58+26 2018-B, AIFA 2009-B, AIFA 2019-A, and AIFA 2019-B.
