10		-	3 To make an appropriation of $1,069,234 from the
11		-	4 Education Trust Fund to Talladega College in Talladega,
12		-	5 Alabama for the support and maintenance of the educational
13		-	6 program of the institution, for the fiscal year ending
14		-	7 September 30, 2023; to provide that the appropriation is
15		-	8 subject to certain provisions of the Code of Alabama 1975; to
16		-	9 require an operations plan and an audited financial statement
17		-	10 prior to the release of any funds; and to require an end of
18		-	11 year report.
19		-	12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20		-	13 Section 1. There is hereby appropriated the sum of
21		-	14 $1,069,234 from the Education Trust Fund to Talladega College
22		-	15 in Talladega, Alabama for the support and maintenance of the
23		-	16 educational program of the institution, for the fiscal year
24		-	17 ending September 30, 2023.
25		-	18 Section 2. The above appropriation is made for the
26		-	19 support of public education in Alabama and for the support and
27		-	20 maintenance of the above program. The appropriation shall be
28		-	21 subject to the provisions, terms, conditions, and limitations
29		-	22 of the Budget and Financial Control Act, Code of Alabama 1975,
30		-	23 Sections 41-4-80 et seq.; the provisions of The Budget
31		-	24 Management Act of 1976, Code of Alabama 1975, Sections 41-19-1
32		-	25 et seq.; and any other provisions of this act.

34		-	1 Section 3. (a) Prior to the release of any funds
35		-	2 appropriated under this act the following reports shall be
36		-	3 submitted:
37		-	4 (1) An operations plan for the fiscal year 2023,
38		-	5 including goals and measurable performance indicators, shall
39		-	6 be submitted to and approved by the Director of Finance, as
40		-	7 provided for state agencies in Code of Alabama 1975, Section
41		-	8 41-19-10.
42		-	9 (2) An audited financial statement for all
43		-	10 operations during the fiscal year 2021.
44		-	11 (b) It is the intent that funds appropriated for
45		-	12 fiscal year 2023 shall be released by the Director of Finance
46		-	13 following receipt of the above reports.
47		-	14 (c) In addition, quarterly reports shall be made to
48		-	15 the Director of Finance relating actual expenditures and
49		-	16 accomplishments to planned expenditures and accomplishments.
50		-	17 An end of year performance report for the fiscal year 2023
51		-	18 shall be made to the Director of Finance stating the work
52		-	19 accomplished and the services provided and the costs of
53		-	20 accomplishing the work and providing the services, citing
54		-	21 meaningful measures of program effectiveness and costs, as is
55		-	22 required for state agencies in Code of Alabama 1975, Section
56		-	23 41-19-11.

58		-	1 (d) The Director of Finance shall forward a copy of
59		-	2 all required reports to the Legislative Council in a timely
60		-	3 manner.
61		-	4 Section 4. This act shall become effective October
62		-	5 1, 2022.
