9-2 ENROLLED, An Act,
10-3 Relating to Limestone County; to authorize
11-4 communication districts in Limestone County to contract and
12-5 otherwise cooperate with an emergency communication district
13-6 or public safety agency in a neighboring state; and to provide
14-7 for immunity for districts and their officers and employees.
15-8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
16-9 Section 1. This act shall apply only to Limestone
17-10 County.
18-11 Section 2. (a) The board of commissioners of a
19-12 communication district established by the Limestone County
20-13 Commission pursuant to Chapter 98 of Title 11, Section 11-98-1
21-14 et seq., Code of Alabama 1975, which serves territory lying
22-15 within Limestone County may do any of the following:
23-16 (1) Contract or otherwise cooperate with an
24-17 emergency communication district serving any part of an
25-18 adjacent county in the State of Tennessee for the provision of
26-19 emergency communication services, including, but not limited
27-20 to, dispatch services, or assistance in the provision of
28-21 emergency communications services within any part of the
29-22 respective territory or area of service of any communication
30-23 district that is party to the contract or cooperative
31-24 agreement.

33-1 (2) Contract or otherwise cooperate with any public
34-2 safety agency of the State of Tennessee or functional division
35-3 of a political subdivision of the State of Tennessee which
36-4 provides fire fighting, rescue, natural or man-made disaster
37-5 or major emergency response, law enforcement, or ambulance or
38-6 emergency medical services within any part of a county in
39-7 Tennessee that is adjacent to Limestone County, for the
40-8 provision of emergency communications services, including, but
41-9 not limited to, dispatch services or assistance in the
42-10 provision of emergency services within any part of the
43-11 respective territory or areas of service of any communication
44-12 district, public safety agency, or division of a political
45-13 subdivision that is party to the contract or cooperative
46-14 agreement.
47-15 (b) A communication district contracting or
48-16 cooperating with an entity pursuant to this section and any
49-17 officers or employees of the communication district shall be
50-18 considered as acting in a county governmental capacity for any
51-19 actions taken pursuant to this act. Any officer or employee of
52-20 the communication district performing any activity or duty
53-21 authorized by this section shall be entitled to the same
54-22 rights, privileges, exceptions, and immunities provided by law
55-23 for any county governmental activity or duty performed within
56-24 Limestone County, to the same extent as allowed for their

55+22 the communication district performing any activity or duty
56+23 authorized by this section shall be entitled to the same
57+24 rights, privileges, exceptions, and immunities provided by law
58+25 for any county governmental activity or duty performed within
59+26 Limestone County, to the same extent as allowed for their

5961 2 11, Code of Alabama 1975..
6062 3 (c) This section is cumulative in its nature and
6163 4 shall be in addition to any and all power and authority
6264 5 granted to a communication district, a county, or a
6365 6 municipality under any other law.
6466 7 Section 3. The provisions of this act are severable.
6567 8 If any part of this act is declared invalid or
6668 9 unconstitutional, that declaration shall not affect the part
6769 10 that remains.
6870 11 Section 4. This act shall become effective
6971 12 immediately following its passage and approval by the
7072 13 Governor, or its otherwise becoming law.
