15	15	8 SYNOPSIS: Under existing general law, a local health
16	16	9 care authority determines procedures for appointing
17	17	10 board members through its articles of
18	18	11 incorporation. The Houston County Health Care
19	19	12 Authority is a duly constituted local health care
20	20	13 authority created pursuant to general law.
21	21	14 This bill proposes a local constitutional
22	22	15 amendment, related to Houston County, to authorize
23	23	16 the County Commission of Houston County to appoint
24	24	17 members to the board of the Houston County Health
25	25	18 Care Authority.

31	31	24 Relating to Houston County; to propose an amendment
32	32	25 to the Constitution of Alabama of 1901, to authorize the
33	33	26 County Commission of Houston County to appoint members to the
34	34	27 Houston County Health Care Authority Board of Directors.
35	35	Page 1 1 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
36	36	2 Section 1. The following amendment to the
37	37	3 Constitution of Alabama of 1901, is proposed and shall become
38	38	4 valid as a part of the Constitution when all requirements of
39	39	5 this act are fulfilled:
40	40	6 PROPOSED AMENDMENT
41	41	7 (a) On and after the ratification of this amendment,
42	42	8 for any existing vacancy and as vacancies occur, the Public
43	43	9 Directors of the Board of the Houston County Health Care
44	44	10 Authority, or any successor health care authority in Houston
45	45	11 County established or reincorporated pursuant to Article 11 of
46	46	12 Chapter 21 of Title 22, Code of Alabama 1975, who are
47	47	13 appointed by the Houston County Commission shall be
48	48	14 individuals appointed by the county commission at its
49	49	15 discretion and without regard to any individuals nominated by
50	50	16 the board. Any member appointed shall be of good moral
51	51	17 character and shall have never been convicted of a felony or
52	52	18 other offense involving moral turpitude.
53	53	19 (b) The board shall amend the governing documents of
54	54	20 the authority to reflect the requirements of this amendment.
55	55	21 Upon ratification of this constitutional amendment
56	56	22 and contingent upon the ratification of the Constitution of
57	57	23 Alabama of 2022, the Code Commissioner shall number and place
58	58	24 this amendment as appropriate in the constitution based upon a
59	59	25 logical sequence and the particular subject or topic of the
60	60	26 amendment. In this amendment, the Code Commissioner may change
61	61	27 capitalization, spelling, and punctuation for the purpose of
62	62	Page 2 1 style and uniformity; correct manifest grammatical, clerical,
63	63	2 and typographical errors; and correct incorrect
64	64	3 cross-references. When publishing the Constitution of Alabama
65	65	4 of 2022, as amended, the Code Commissioner may omit this
66	66	5 instructional paragraph.
67	67	6 Section 2. An election upon the proposed amendment
68	68	7 shall be held in accordance with Section 284.01 of the
69	69	8 Constitution of Alabama of 1901, now appearing as Section
70	70	9 284.01 of the Official Recompilation of the Constitution of
71	71	10 Alabama of 1901, as amended, and the election laws of this
72	72	11 state.
73	73	12 Section 3. The appropriate election official shall
74	74	13 assign a ballot number for the proposed constitutional
75	75	14 amendment on the election ballot and shall set forth the
76	76	15 following description of the substance or subject matter of
77	77	16 the proposed constitutional amendment:
78	78	17 "Relating to Houston County, proposing an amendment
79	79	18 to the Constitution of Alabama of 1901, to authorize the
80	80	19 Houston County Commission to appoint members to the Board of
81	81	20 Directors of the Houston County Health Care Authority at its
82	82	21 discretion and without nominations or directives made by the
83	83	22 members of the board. This amendment only pertains to Houston
84	84	23 County. All other health care authorities in the state will
85	85	24 remain the same.
