1919 13 Relating to Mobile County; to provide for the
2020 14 assessment and collection of additional court costs in certain
2121 15 criminal cases in circuit and district courts for the
2222 16 creation, implementation, and continued administration of a
2323 17 mental health diversionary program; and to provide for the
2424 18 distribution of proceeds.
2525 19 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2626 20 Section 1. (a) In Mobile County, in addition to any
2727 21 court costs and fees now or hereafter authorized in the
2828 22 county, additional court costs in the amount of ten dollars
2929 23 ($10) shall be assessed and collected as costs on each
3030 24 criminal case, including traffic cases, filed in the circuit
3131 25 court and district court, except those filed in the juvenile
3232 26 or family court.
3333 Page 1 1 (b) (1) The costs shall be collected as other costs
3434 2 in cases are assessed and collected by the clerk of the court
3535 3 and shall be paid by the clerk to the Mobile County
3636 4 Commission. The county commission, in consultation with the
3737 5 judge assigned to the mental health diversionary program,
3838 6 shall distribute the proceeds of the court costs to the
3939 7 circuit court and the district attorney for the creation,
4040 8 implementation, and continuing administration of a mental
4141 9 health diversionary program, to be known as the "mental health
4242 10 court."
4343 11 (2) The fees shall not be waived by any court unless
4444 12 all other fees, assessments, costs, fines, and charges
4545 13 associated with the case are waived.
4646 14 Section 2. This act shall become effective on the
4747 15 first day of the third month following its passage and
4848 16 approval by the Governor, or its otherwise becoming law.
