9-2 ENROLLED, An Act,
10-3 Relating to Cullman County; amending Section 1 of
11-4 Act 2020-160 of the 2020 Regular Session, now appearing as
12-5 Section 45-22-224, Code of Alabama 1975, to provide that the
13-6 Battleground School Historical Board may transfer ownership of
14-7 the Battleground School property by a vote of the board; and
15-8 deleting the additional requirement of a referendum.
16-9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
17-10 Section 1. Section 1 of Act 2020-160, of the 2020
18-11 Regular Session, now appearing as Section 45-22-224, Code of
19-12 Alabama 1975, is hereby amended to read as follows:
20-13 "§45-22-224.
21-14 "(a) In Cullman County, the Battleground School
22-15 Historical Board is established to own, operate, manage, and
23-16 preserve the former Battleground School property in the
24-17 unincorporated community of Battleground, including any ball
25-18 fields and other historical structures, owned by the Cullman
26-19 County Board of Education. The Battleground School Historical
27-20 Board shall be composed of five members appointed by the
28-21 Cullman County Legislative Delegation for terms of four years.
29-22 Members of the board shall continue to serve until a successor
30-23 is appointed. Members of the board are immune from civil
31-24 liability for actions taken in the conduct of their duties to
32-25 the extent allowed under Section 36-1-12.

34-1 "(b)(1) The Battleground School Historical Board may
35-2 accept title to the former Battleground School property owned
36-3 by the Cullman County Board of Education and may hold the
37-4 property for the benefit and use of the public, particularly
38-5 the unincorporated community of Battleground. The Battleground
39-6 School Historical Board may receive state, local, and other
40-7 governmental funding and may accept charitable donations.
41-8 "(2) The board may not sell or transfer ownership of
42-9 the property unless approved by upon approval of a majority
43-10 vote of the board and then by a majority vote of the qualified
44-11 electors in the unincorporated community of Battleground at a
45-12 referendum called by the judge of probate and held during the
46-13 following general election.
47-14 "(c) The Battleground School Historical Board may be
48-15 reorganized as an unincorporated nonprofit association or
49-16 other entity authorized by law by unanimous consent of the
50-17 board."
51-18 Section 2. This act shall become effective
52-19 immediately following its passage and approval by the
53-20 Governor, or its otherwise becoming law.
