10-2 ENROLLED, An Act,
11-3 Relating to Shelby County; to amend Section 23 of
12-4 Act 79-524, 1979 Regular Session (Acts 1979, p. 935), as last
13-5 amended by Act 2007-482, relating to the personnel board for
14-6 county law enforcement officers, to further provide for the
15-7 amount of proceeds the board may receive from the tax imposed
16-8 on beer or malt or brewed beverages to assure the operation of
17-9 the personnel system for the recruitment and retention of
18-10 employees of the sheriff's office.
19-11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20-12 Section 1. Section 23 of Act 79-524, 1979 Regular
21-13 Session (Acts 1979, p. 935), as amended, is amended to read as
22-14 follows:
23-15 "Section 23. All expenses incurred in the
24-16 implementation of the provisions of this act shall be financed
25-17 from a special fund provided in the county treasury for such
26-18 purposes, pursuant to the passage of an additional tax on the
27-19 sales of beer, malt, or brewed beverages in Shelby County at
28-20 the 1977 Regular Session of the Legislature. It is further
29-21 provided, however, that expenditures by the board in one year
30-22 shall not exceed one hundred fifty thousand dollars ($150,000)
31-23 two hundred seventy-five thousand dollars ($275,000) derived
32-24 from the proceeds of the tax. Any income derived from the
33-25 proceeds of the tax, which exceeds the actual expenditures of

35-1 the board for any year, shall be paid over to the county
36-2 general fund and shall be used exclusively by the Sheriff's
37-3 Department for law enforcement purposes in the county."
38-4 Section 2. This act shall become effective on the
39-5 first day of the third month following its passage and
40-6 approval by the Governor, or its otherwise becoming law.
