10-2 ENROLLED, An Act,
11-3 Relating to Shelby County; to amend Section 6 of Act
12-4 93-664 of the 1993 Regular Session (Acts 1993, p. 1145), as
13-5 amended by Act 2015-344 of the 2015 Regular Session (Acts
14-6 2015, p. 1070), relating to the civil service system of the
15-7 county; to further provide for the unclassified service in the
16-8 office of the Property Tax Commissioner.
17-9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
18-10 Section 1. Section 6 of Act 93-664 of the 1993
19-11 Regular Session (Acts 1993, p. 1145), as amended by Act
20-12 2015-344 of the 2015 Regular Session (Acts 2015, p. 1070), is
21-13 amended to read as follows:
22-14 "Section 6. At the time Shelby County becomes
23-15 subject to the provisions of this act, all employees and
24-16 appointees holding full-time positions in the classified
25-17 service of the county shall be granted permanent status in the
26-18 classified service and designation as a regular employee as
27-19 herein defined. All employees employed in a position in the
28-20 classified service that have not completed their probationary
29-21 period shall be required to complete it before gaining the
30-22 designation as regular employees as defined herein. The
31-23 service shall be divided into two categories, as follows:
32-24 "(1) The Administrator of Probate and Recording
33-25 Services (Chief Clerk) and the Assistant to the Judge of

35-1 Probate in the Office of the Judge of Probate and the
36-2 Administrator, Chief Appraiser, Supervisor of Collections and
37-3 Assessments, and the Supervisor of Business Personal Property
38-4 in the Office of the Property Tax Commissioner shall be
39-5 exempted from the civil service system and the classified
40-6 services.
41-7 "(2) A classified service comprised of all employees
42-8 and appointees holding regular full-time permanent positions
43-9 in the service of the county. Employees occupying these
44-10 positions shall be deemed to be in the classified service
45-11 unless specifically exempted from the service in accordance
46-12 with this act.
47-13 "(3) The unclassified service shall include, but not
48-14 be limited to, the following:
49-15 "a. Officials elected by popular vote.
50-16 "b. The County Attorney, County Manager, and County
51-17 Engineer.
52-18 "c. Consultants and/or independent contractors to
53-19 the commission.
54-20 "d. Individuals employed in positions which are
55-21 funded either partially or fully through federal, state, or
56-22 local grants.
57-23 "e. Guards performing security duties associated
58-24 with either courthouse security or inmate work details.

60-1 "f. Employees occupying the positions of project
61-2 director, secretary, computer operator, or any other positions
62-3 of the Drug Task Force under the supervision of the Sheriff of
63-4 Shelby County or an incorporated board.
64-5 "g. Part-time members of boards.
65-6 "h. Attorneys, physicians, surgeons, and dentists
66-7 who, with permission of the appointing authority of a
67-8 governing body, engage in outside similar employment.
68-9 "i. The Administrator, Chief Appraiser, Supervisor
69-10 of Collections and Assessments, and the Supervisor of Business
70-11 Personal Property for the Property Tax Commissioner; and any
71-12 employees or appointees paid through the discretionary fund of
72-13 the Property Tax Commissioner. Notwithstanding any other
73-14 provisions of this act or any other law to the contrary, the
74-15 Property Tax Commissioner may from time to time adopt job
75-16 descriptions and assign duties and responsibilities to the
76-17 unclassified positions in the office of the Property Tax
77-18 Commissioner as determined appropriate.
78-19 "j. Any employees or appointees paid through the
79-20 discretionary fund of the Property Tax Commissioner who
80-21 receive or received more than 50 percent of their total
81-22 compensation from such fund.
82-23 "k. The Administrator of Probate and Recording
83-24 Services (Chief Clerk) and the Assistant to the Judge of
84-25 Probate. Any employees or appointees paid through the Index

86-1 Fund (a discretionary fund of the Judge of Probate) or paid
87-2 through the Mental Health Program Discretionary Fund of the
88-3 Judge of Probate established by Act 2013-259, who receive or
89-4 received more than 50 percent of their total county
90-5 compensation from one of the funds.
91-6 "l. The chief probation officer-juvenile court
92-7 service director appointed by the district court judge that is
93-8 designated as the judge of the juvenile court. The County
94-9 Manager may provide performance information to the district
95-10 court judge concerning the chief probation officer-juvenile
96-11 court services director.
97-12 "m. Coroner and deputy coroner and any other
98-13 employees under the supervision of the coroner.
99-14 "n. Employees occupying positions recognized as
100-15 either part-time, temporary, students and interns, and
101-16 emergency.
102-17 "(4) All unclassified service positions in the
103-18 following departments shall be governed by the leave policies
104-19 and compensation schedule as outlined within this act: County
105-20 commission, Judge of Probate, Property Tax Commissioner.
106-21 Full-time employees in the unclassified service of the county
107-22 commission, the Office of Judge of Probate, and the Office of
108-23 Property Tax Commissioner shall receive benefits eligibility
109-24 as with the classified service. No board or appointing
110-25 authority shall be authorized to designate an individual in

112-1 the unclassified service as a regular employee in the service
113-2 of the county."
114-3 Section 2. This act shall become effective on the
115-4 first day of the third month following its passage and
116-5 approval by the Governor, or its otherwise becoming law.
