14-8 Relating to impersonating a peace officer; to

16-10 officer; and in connection therewith would have as its purpose
17-11 or effect the requirement of a new or increased expenditure of
18-12 local funds within the meaning of Amendment 621 of the
19-13 Constitution of Alabama of 1901, as amended by Amendment 890,
20-14 now appearing as Section 111.05 of the Official Recompilation
21-15 of the Constitution of Alabama of 1901, as amended.
22-16 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23-17 Section 1. Section 13A-10-11, Code of Alabama 1975,
24-18 is amended to read as follows:
25-19 "§13A-10-11.
26-20 "(a) For the purposes of this section, a peace
27-21 officer includes a federal peace officer.
28-22 "(a) (b) A person commits the crime of impersonating
29-23 a peace officer if he falsely pretends to be a peace officer
30-24 and does any act in that capacity.
31-25 "(b) (c) Impersonating a peace officer is a Class C
32-26 felony."
33-Page 1 1 Section 2. Although this bill would have as its
34-2 purpose or effect the requirement of a new or increased
35-3 expenditure of local funds, the bill is excluded from further
36-4 requirements and application under Amendment 621, as amended
37-5 by Amendment 890, now appearing as Section 111.05 of the
38-6 Official Recompilation of the Constitution of Alabama of 1901,
39-7 as amended, because the bill defines a new crime or amends the
40-8 definition of an existing crime.
41-9 Section 3. This act shall become effective on the
42-10 first day of the third month following its passage and
43-11 approval by the Governor, or its otherwise becoming law.

14+8 SYNOPSIS: Under existing law, for the purposes of the
15+9 crime of impersonating a peace officer, the
16+10 definition of a peace officer does not include a
17+11 federal peace officer.
18+12 This bill would revise the definition of
19+13 peace officer for that purpose to include a peace
20+14 officer of the federal government.
