19	19	13 Relating to Baldwin County; to amend Section
20	20	14 45-2-80.83, relating to the Baldwin County law library, to
21	21	15 provide that the law librarian shall be eligible to
22	22	16 participate in insurance plans offered to county employees by
23	23	17 the county commission; and to provide that the law librarian
24	24	18 may earn and accrue leave in the same manner as county
25	25	19 employees.
26	26	20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
27	27	21 Section 1. Section 45-2-80.83, Code of Alabama 1975,
28	28	22 is amended to read as follows:
29	29	23 "§45-2-80.83.
30	30	24 "(a)(1) The sums to be paid to the Baldwin County
31	31	25 Commission, as herein provided, shall be kept in a special
32	32	26 fund designated as the Baldwin County Law Library and Judicial
33	33	27 Administration Fund and shall be expended by the Presiding
34	34	Page 1 1 Circuit Judge of the Circuit Court of Baldwin County, to
35	35	2 create, establish, and maintain the law library and to provide
36	36	3 for the more effective administration of justice, including,
37	37	4 but not limited to, any of the following:
38	38	5 "a. Paying the costs of securing the advice and
39	39	6 attendance of witnesses; registration.
40	40	7 "b. Registration fees and other actual expenses
41	41	8 incurred in attending seminars, institutes, conferences, and
42	42	9 other meetings in connection with continuing legal and
43	43	10 judicial education, membership fees, or dues in legal and
44	44	11 judicial organizations; paying.
45	45	12 "c. Paying the salaries of court employees when
46	46	13 necessary for the efficient operation of the courts; and any.
47	47	14 "d. Any other actual and necessary expenses incurred
48	48	15 by the judges of the circuit in promoting legal and judicial
49	49	16 competency.
50	50	17 "(2)a. The presiding circuit judge shall draw
51	51	18 warrants on the county for expenditures by indicating on the
52	52	19 warrants the funds against which the warrants are to be drawn.
53	53	20 "b. One dollar fifty cents ($1.50) from each fee in
54	54	21 the fund shall be used primarily to purchase books,
55	55	22 periodicals, and other library fixtures and equipment as, in
56	56	23 the opinion of the presiding circuit judge, may be advisable,
57	57	24 but to the extent not so used, the funds may be otherwise
58	58	25 expended for the maintenance of the library.
59	59	Page 2 1 "c. Thirteen dollars fifty cents ($13.50) from each
60	60	2 fee in the fund shall be used for the purposes of judicial
61	61	3 administration as provided in this section.
62	62	4 "(3)a. The management of the law library is and
63	63	5 shall be vested in the Presiding Judge of the Circuit Court of
64	64	6 Baldwin County, and all books, periodicals, reports, and other
65	65	7 property purchased with the funds produced by this subpart
66	66	8 shall be the property of Baldwin County.
67	67	9 "b. The presiding judge may from time to time sell
68	68	10 or exchange the books, reports, periodicals, and personal
69	69	11 property as may be necessary to keep the library up to date
70	70	12 and apply the proceeds of the sale thereof or the value
71	71	13 thereof upon the purchase of other books, reports,
72	72	14 periodicals, and personal property for use in the library.
73	73	15 "c. The presiding judge of the circuit court may
74	74	16 accept any gift or loan of any books, reports, periodicals,
75	75	17 and other property for public use in the library upon the
76	76	18 terms and conditions as may be stipulated by the donor or
77	77	19 lender thereof and as may be agreeable to the judge.
78	78	20 "d. The presiding circuit judge may designate the
79	79	21 clerk of the circuit court or any other suitable person to
80	80	22 operate or assist in the operation of the library.
81	81	23 "(4) The funds established by this subpart division
82	82	24 shall be audited in the same manner as other county funds are
83	83	25 audited.
84	84	26 "(b)(1) A person employed by the presiding circuit
85	85	27 judge for 20 hours a week as a law librarian to operate or
86	86	Page 3 1 assist in the operation of the law library shall be eligible
87	87	2 to do any of the following:
88	88	3 "participate a. Participate in the Employees'
89	89	4 Retirement System of Alabama.
90	90	5 "b. Participate in any health insurance, life
91	91	6 insurance, and disability coverage offered to county employees
92	92	7 by the Baldwin County Commission.
93	93	8 "c. Earn and accrue leave as outlined in the Baldwin
94	94	9 County Commission personnel handbook.
95	95	10 "(2) Any funds necessary for the administration of
96	96	11 this subsection shall be taken from the Baldwin County Law
97	97	12 Library Operating Fund and shall be paid to the Baldwin County
98	98	13 Commission."
99	99	14 Section 2. This act shall become effective
100	100	15 immediately following its passage and approval by the
101	101	16 Governor, or its otherwise becoming law.
