1919 13 Relating to Baldwin County; to amend Section
2020 14 45-2-80.83, relating to the Baldwin County law library, to
2121 15 provide that the law librarian shall be eligible to
2222 16 participate in insurance plans offered to county employees by
2323 17 the county commission; and to provide that the law librarian
2424 18 may earn and accrue leave in the same manner as county
2525 19 employees.
2626 20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2727 21 Section 1. Section 45-2-80.83, Code of Alabama 1975,
2828 22 is amended to read as follows:
2929 23 "ยง45-2-80.83.
3030 24 "(a)(1) The sums to be paid to the Baldwin County
3131 25 Commission, as herein provided, shall be kept in a special
3232 26 fund designated as the Baldwin County Law Library and Judicial
3333 27 Administration Fund and shall be expended by the Presiding
3434 Page 1 1 Circuit Judge of the Circuit Court of Baldwin County, to
3535 2 create, establish, and maintain the law library and to provide
3636 3 for the more effective administration of justice, including,
3737 4 but not limited to, any of the following:
3838 5 "a. Paying the costs of securing the advice and
3939 6 attendance of witnesses; registration.
4040 7 "b. Registration fees and other actual expenses
4141 8 incurred in attending seminars, institutes, conferences, and
4242 9 other meetings in connection with continuing legal and
4343 10 judicial education, membership fees, or dues in legal and
4444 11 judicial organizations; paying.
4545 12 "c. Paying the salaries of court employees when
4646 13 necessary for the efficient operation of the courts; and any.
4747 14 "d. Any other actual and necessary expenses incurred
4848 15 by the judges of the circuit in promoting legal and judicial
4949 16 competency.
5050 17 "(2)a. The presiding circuit judge shall draw
5151 18 warrants on the county for expenditures by indicating on the
5252 19 warrants the funds against which the warrants are to be drawn.
5353 20 "b. One dollar fifty cents ($1.50) from each fee in
5454 21 the fund shall be used primarily to purchase books,
5555 22 periodicals, and other library fixtures and equipment as, in
5656 23 the opinion of the presiding circuit judge, may be advisable,
5757 24 but to the extent not so used, the funds may be otherwise
5858 25 expended for the maintenance of the library.
5959 Page 2 1 "c. Thirteen dollars fifty cents ($13.50) from each
6060 2 fee in the fund shall be used for the purposes of judicial
6161 3 administration as provided in this section.
6262 4 "(3)a. The management of the law library is and
6363 5 shall be vested in the Presiding Judge of the Circuit Court of
6464 6 Baldwin County, and all books, periodicals, reports, and other
6565 7 property purchased with the funds produced by this subpart
6666 8 shall be the property of Baldwin County.
6767 9 "b. The presiding judge may from time to time sell
6868 10 or exchange the books, reports, periodicals, and personal
6969 11 property as may be necessary to keep the library up to date
7070 12 and apply the proceeds of the sale thereof or the value
7171 13 thereof upon the purchase of other books, reports,
7272 14 periodicals, and personal property for use in the library.
7373 15 "c. The presiding judge of the circuit court may
7474 16 accept any gift or loan of any books, reports, periodicals,
7575 17 and other property for public use in the library upon the
7676 18 terms and conditions as may be stipulated by the donor or
7777 19 lender thereof and as may be agreeable to the judge.
7878 20 "d. The presiding circuit judge may designate the
7979 21 clerk of the circuit court or any other suitable person to
8080 22 operate or assist in the operation of the library.
8181 23 "(4) The funds established by this subpart division
8282 24 shall be audited in the same manner as other county funds are
8383 25 audited.
8484 26 "(b)(1) A person employed by the presiding circuit
8585 27 judge for 20 hours a week as a law librarian to operate or
8686 Page 3 1 assist in the operation of the law library shall be eligible
8787 2 to do any of the following:
8888 3 "participate a. Participate in the Employees'
8989 4 Retirement System of Alabama.
9090 5 "b. Participate in any health insurance, life
9191 6 insurance, and disability coverage offered to county employees
9292 7 by the Baldwin County Commission.
9393 8 "c. Earn and accrue leave as outlined in the Baldwin
9494 9 County Commission personnel handbook.
9595 10 "(2) Any funds necessary for the administration of
9696 11 this subsection shall be taken from the Baldwin County Law
9797 12 Library Operating Fund and shall be paid to the Baldwin County
9898 13 Commission."
9999 14 Section 2. This act shall become effective
100100 15 immediately following its passage and approval by the
101101 16 Governor, or its otherwise becoming law.
