1515 8 SYNOPSIS: This bill would create an additional circuit
1616 9 judgeship, designated as Circuit Judgeship Number
1717 10 8, in the Twenty-third Judicial Circuit comprised
1818 11 of Madison County, an additional circuit judgeship,
1919 12 designated as Circuit Judgeship Number 4, in the
2020 13 Nineteenth Judicial Circuit comprised of Autauga,
2121 14 Chilton, and Elmore Counties, and an additional
2222 15 circuit judgeship, designated as Circuit Judgeship
2323 16 Number 6, in the Twenty-eighth Judicial Circuit
2424 17 comprised of Baldwin County.
2525 18 This bill would provide for the authority of
2626 19 the judges and for the compensation and benefits of
2727 20 the judges.
2828 21 This bill would further provide for the
2929 22 reallocation of circuit judgeships by the Judicial

3636 2 To provide for an additional circuit judgeship in
3737 3 the Twenty-third Judicial Circuit comprised of Madison County;
3838 4 to provide for an additional circuit judgeship in the
3939 5 Nineteenth Judicial Circuit comprised of Autauga, Chilton, and
4040 6 Elmore Counties; to provide for an additional circuit
4141 7 judgeship in the Twenty-eighth Judicial Circuit comprised of
4242 8 Baldwin County; to provide for the authority of the judges and
4343 9 for the compensation and benefit of the judges; and to further
4444 10 provide for the reallocation of vacant circuit judgeships.
4545 11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
4646 12 Section 1. (a) There is created an additional
4747 13 circuit judgeship for the Twenty-third Judicial Circuit which
4848 14 shall be designated as Circuit Judgeship Number 8.
4949 15 (b) There is created an additional circuit judgeship
5050 16 for the Nineteenth Judicial Circuit which shall be designated
5151 17 as Circuit Judgeship Number 4. The judge appointed or elected
5252 18 to Judgeship Number 4 may reside in any county within the
5353 19 Nineteenth Judicial Circuit.
5454 20 (c) There is created an additional circuit judgeship
5555 21 for the Twenty-eighth Judicial Circuit which shall be
5656 22 designated as Circuit Judgeship Number 6.
5757 23 (d) Circuit Judgeship Number 8 in the Twenty-third
5858 24 Judicial Circuit, Circuit Judgeship Number 4 in the Nineteenth
5959 25 Judicial Circuit, and Circuit Judgeship Number 6 in the
6060 26 Twenty-eighth Judicial Circuit shall be filled in January 2023
6161 27 in accordance with the law in effect on that date.
6262 Page 2 1 (e) The initial judges appointed or elected to the
6363 2 additional circuit judgeships created pursuant to subsections
6464 3 (a), (b), and (c) shall serve pursuant to Section 153 of the
6565 4 Constitution of Alabama of 1901.
6666 5 (f) The initial judges appointed or elected to the
6767 6 additional circuit judgeships created pursuant to subsections
6868 7 (a), (b), and (c) shall have and shall exercise all the
6969 8 jurisdiction, power, rights, and authority and shall possess
7070 9 all of the qualifications, perform all of the duties, and
7171 10 shall be subject to all of the responsibilities and duties of
7272 11 the office to which other circuit judges are subject.
7373 12 (g) The annual compensation of the additional
7474 13 circuit judges appointed or elected pursuant to subsections
7575 14 (a), (b), and (c) shall be in accordance with Chapter 10A of
7676 15 Title 12, Code of Alabama 1975, including, but not limited to,
7777 16 the provision that no circuit judge first appointed or elected
7878 17 to office after October 1, 2001, shall be provided a salary
7979 18 supplement or expense allowance.
8080 19 Section 2. Notwithstanding Section 12-9A-2, Code of
8181 20 Alabama 1975, or any other law to the contrary, the Judicial
8282 21 Resources Allocation Commission shall reallocate the first
8383 22 circuit judgeship that becomes vacant after the effective date
8484 23 of this act to the Twenty-third Judicial Circuit. Thereafter,
8585 24 the commission may reallocate any subsequent circuit judgeship
8686 25 that becomes vacant as provided under existing law.

8888 2 1, 2023, following its passage and approval by the Governor,
8989 3 or its otherwise becoming law.
