45 | 45 | | 11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

46 | 46 | | 12 Section 1. (a) There is created an additional |
---|
47 | 47 | | 13 circuit judgeship for the Twenty-third Judicial Circuit which |
---|
48 | 48 | | 14 shall be designated as Circuit Judgeship Number 8. |
---|
49 | 49 | | 15 (b) There is created an additional circuit judgeship |
---|
50 | 50 | | 16 for the Nineteenth Judicial Circuit which shall be designated |
---|
51 | 51 | | 17 as Circuit Judgeship Number 4. The judge appointed or elected |
---|
52 | 52 | | 18 to Judgeship Number 4 may reside in any county within the |
---|
53 | 53 | | 19 Nineteenth Judicial Circuit. |
---|
54 | 54 | | 20 (c) There is created an additional circuit judgeship |
---|
55 | 55 | | 21 for the Twenty-eighth Judicial Circuit which shall be |
---|
56 | 56 | | 22 designated as Circuit Judgeship Number 6. |
---|
57 | 57 | | 23 (d) Circuit Judgeship Number 8 in the Twenty-third |
---|
58 | 58 | | 24 Judicial Circuit, Circuit Judgeship Number 4 in the Nineteenth |

59 | 59 | | 25 Judicial Circuit, and Circuit Judgeship Number 6 in the |

60 | 60 | | 26 Twenty-eighth Judicial Circuit shall be filled in January 2023 |

63 | 63 | | 2 additional circuit judgeships created pursuant to subsections |

64 | 64 | | 3 (a), (b), and (c) shall serve pursuant to Section 153 of the |

65 | 65 | | 4 Constitution of Alabama of 1901. |

66 | 66 | | 5 (f) The initial judges appointed or elected to the |
---|
67 | 67 | | 6 additional circuit judgeships created pursuant to subsections |
---|
68 | 68 | | 7 (a), (b), and (c) shall have and shall exercise all the |
---|
69 | 69 | | 8 jurisdiction, power, rights, and authority and shall possess |
---|
70 | 70 | | 9 all of the qualifications, perform all of the duties, and |
---|
71 | 71 | | 10 shall be subject to all of the responsibilities and duties of |
---|
72 | 72 | | 11 the office to which other circuit judges are subject. |
---|
73 | 73 | | 12 (g) The annual compensation of the additional |
---|
74 | 74 | | 13 circuit judges appointed or elected pursuant to subsections |
---|
75 | 75 | | 14 (a), (b), and (c) shall be in accordance with Chapter 10A of |
---|
76 | 76 | | 15 Title 12, Code of Alabama 1975, including, but not limited to, |
---|
77 | 77 | | 16 the provision that no circuit judge first appointed or elected |
---|
78 | 78 | | 17 to office after October 1, 2001, shall be provided a salary |
---|
79 | 79 | | 18 supplement or expense allowance. |
---|
80 | 80 | | 19 Section 2. Notwithstanding Section 12-9A-2, Code of |
---|
81 | 81 | | 20 Alabama 1975, or any other law to the contrary, the Judicial |
---|
82 | 82 | | 21 Resources Allocation Commission shall reallocate the first |
---|
83 | 83 | | 22 circuit judgeship that becomes vacant after the effective date |
---|
84 | 84 | | 23 of this act to the Twenty-third Judicial Circuit. Thereafter, |
---|
85 | 85 | | 24 the commission may reallocate any subsequent circuit judgeship |
---|
86 | 86 | | 25 that becomes vacant as provided under existing law. |
---|
87 | 87 | | Page 3 1 Section 3. This act shall become effective January |
---|
88 | 88 | | 2 1, 2023, following its passage and approval by the Governor, |
---|
89 | 89 | | 3 or its otherwise becoming law. |
