2929 23 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 24 Section 1. There is hereby appropriated for the
3131 25 support of public education in Alabama for the fiscal year
3232 26 ending September 30, 2023, for debt service, and for capital
3333 27 outlay to be paid out of funds specified in subsection (a) of
3434 Page 1 1 Section 2 of this act, the amounts specified in subsections
3535 2 (a), (b), (c), (d), and (e) of Section 3 of this act, and
3636 3 Section 4 of this act. For the purpose specified in subsection
3737 4 (b) of Section 2 of this act, amounts are shown by
3838 5 programmatic area and the total for all programs is shown so
3939 6 as to include estimated sources of funds other than those
4040 7 listed in subsection (a) of Section 2 of this act. For the
4141 8 purpose of this act, "ETF" shall mean the Education Trust Fund
4242 9 and "Federal and Local Funds" shall mean all gifts, grants,
4343 10 contributions, or entitlements, including grants by the
4444 11 Congress of the United States, municipalities or counties.
4545 12 Section 2. (a) The appropriations provided for in
4646 13 this act shall be paid from funds in the State Treasury to the
4747 14 credit of the Education Trust Fund, Alabama Peace Officers'
4848 15 Standards and Training Fund, Impaired Drivers Trust Fund,
4949 16 Driver Education and Training Fund, Special Education
5050 17 Catastrophic Fund, Public School Fund and other listed funds
5151 18 and are hereby made for the support of public education in
5252 19 Alabama for the fiscal year ending September 30, 2023, and the
5353 20 appropriations herein made shall be subject to the provisions,
5454 21 terms, conditions and limitations of the Budget and Financial
5555 22 Control Act (Code of Alabama 1975, Sections 41-4-80 et seq.),
5656 23 the provisions of the Budget Management Act of 1976 (Code of
5757 24 Alabama 1975, Sections 41-19-1 et seq.), and shall be in the
5858 25 amounts hereinafter specified.
5959 26 (b) Amounts shown hereinunder the columns "Earmarked
6060 27 Funds" and "Appropriation Total" are as set forth for the
6161 Page 2 1 purpose of establishing amounts estimated to be available by
6262 2 programmatic area from sources other than those listed in
6363 3 subsection (a) of this Section 2, in order, upon consideration
6464 4 of such other funds so estimated to be available, to promote
6565 5 the accountability for an efficient use of funds available,
6666 6 and the same are hereby appropriated by the Legislature.
6767 7 Provided, however, that regardless of the ending date of any
6868 8 pay period which has been or may be established by the
6969 9 Legislature for the payment of salaries of state employees,

14791479 24 year beginning October 1, 2022. For "Fringe Benefits" the rate per day for two

60976097 Section 4. There is hereby appropriated $125,000,00019
60986098 20 from the Education Trust Fund to the Department of Finance to
60996099 21 be distributed to all education entities that received an
61006100 22 allocation pursuant to Section 9 of Act 2020-167, the 2020
61016101 23 PSCA bond issue. Each eligible education entity shall receive
61026102 24 a pro rata share of the above appropriation that is equal to
61036103 25 its pro rata share of bond proceeds allocated to it pursuant
61046104 26 to Section 9 of Act 2020-167. The Legislature recognizes that
61056105 27 construction costs have risen since the enactment of Act
61066106 28 2020-167. Therefore, education entities are authorized to
61076107 29 utilize the funds appropriated in this section toward the cost
61086108 30 of projects being funded by 2020 PSCA bond issue proceeds.
61096109 Page 109 1 Education entities are further authorized to use the funds
61106110 2 appropriated above for any other capital project, including
61116111 3 without limitation construction costs, costs of equipping
61126112 4 facilities, and repairs and maintenance. The funds
61136113 5 appropriated in this section are one-time funding and shall
61146114 6 not be used to pay for ongoing annual expenditures.
61156115 7 Section 5. Each college or university receiving an
61166116 8 appropriation from the Education Trust Fund in Section 3C that
61176117 9 operates a public teacher preparation program leading to the
61186118 10 attainment of an initial elementary teaching certification
61196119 11 shall be in compliance with the credit hour requirements of
61206120 12 reading or literacy coursework, or both, based on the science
61216121 13 of learning to read, including multisensory strategies in
61226122 14 foundation reading skills. All such programs shall fully
61236123 15 cooperate with the Alabama State Department of Education’s
61246124 16 internal or external initiatives, such as the Barksdale
61256125 17 Reading Institute, that gauge compliance with the Literacy Act
61266126 18 to improve the preparation of classroom teachers. Any college
61276127 19 or university not in compliance with these provisions by
61286128 20 January 2, 2023, as determined by the State Superintendent of
61296129 21 Education, shall have their Education Trust Fund appropriation
61306130 22 in Section 3C reduced by $1,000,000 or one-half of one
61316131 23 percent, whichever is greater. The State Superintendent of
61326132 24 Education shall certify the list of non-compliant colleges or
61336133 25 universities to the Finance Director, the Chair of the House
61346134 26 Ways and Means-Education, the Chair of the Senate Finance and
61356135 Page 110 1 Taxation-Education Committee and the Legislative Fiscal
61366136 2 Officer prior to any reduction in funding.
61376137 3 Section 6. (a) In addition to the appropriations
61386138 4 herein made, all gifts, grants, contributions, insurance
61396139 5 proceeds or entitlements, in excess of the amount carried in
61406140 6 this act, including grants by the Congress of the United
61416141 7 States, municipalities or counties, to any department,
61426142 8 division, board, bureau, commission, agency, institution,
61436143 9 office or officer of the State of Alabama are hereby
61446144 10 appropriated and, in the event the same are recurring, are
61456145 11 reappropriated to such department, division, board, bureau,
61466146 12 commission, agency, institution, office or officer to be used
61476147 13 only for the purpose or purposes for which the grant or
61486148 14 contribution was or shall be made. Further, all state, county,
61496149 15 municipal and educational entities are authorized to disburse
61506150 16 such sums as deemed necessary by mutual agreement between said
61516151 17 entities and the State of Alabama, Department of Examiners of
61526152 18 Public Accounts to partially defray the cost of auditing
61536153 19 services performed by said agency. All such sums are hereby
61546154 20 appropriated and reappropriated if necessary to the Department
61556155 21 of Examiners of Public Accounts for audit services, to be
61566156 22 expended through the fund established by Section 41-5A-22,
61576157 23 Code of Alabama 1975.
61586158 24 (b) The State Superintendent of Education shall
61596159 25 encourage the Local Education Agencies to use federal stimulus
61606160 26 funds provided by the Congress of the United States through
61616161 27 the Elementary and Secondary School Emergency Relief Fund for
61626162 Page 111 1 one-time, non-recurring allowable expenses to address the
61636163 2 coronavirus pandemic in Alabama public schools. The
61646164 3 Superintendent shall periodically report to the Finance
61656165 4 Director, Chairs of the Senate Finance and Taxation-Education
61666166 5 Committee, the House Ways and Means-Education Committee, and
61676167 6 the Legislative Fiscal Officer, regarding the planned and
61686168 7 actual expenditures of these funds by the Local Education
61696169 8 Agencies.
61706170 9 (c) The Local Education Agencies shall expend no
61716171 10 less than $100,000,000 of all federal stimulus funds provided
61726172 11 by the Congress of the United States to address the
61736173 12 coronavirus pandemic in Alabama public schools to implement
61746174 13 the safely opening schools program, to include, but not
61756175 14 limited to: screening, testing, isolation and quarantine of
61766176 15 students and school personnel with symptoms, in order to
61776177 16 protect students, teachers, and support personnel for schools
61786178 17 to return to full-time in-person education. Local school
61796179 18 boards shall have the choice to utilize the funds for the
61806180 19 above purposes to the degree that meets their individual
61816181 20 needs.
61826182 21 Section 7. The State Superintendent of Education
61836183 22 shall make requisitions to the State Comptroller in favor of
61846184 23 the proper beneficiary in accordance with the law and rules
61856185 24 and regulations governing the expenditure or disbursement of
61866186 25 any and all funds appropriated to the State Department of
61876187 26 Education and/or the State Board of Education in this act,
61886188 27 whereupon the Comptroller shall issue her warrant therefor.
61896189 Page 112 1 All other appropriations in this act shall be paid after
61906190 2 proper requisitions are made to the State Comptroller in the
61916191 3 manner now provided by law.
61926192 4 Section 8. Nothing in this act shall be construed to
61936193 5 affect or repeal any law authorizing or permitting any
61946194 6 college, school or other education or eleemosynary institution
61956195 7 of the State to receive, collect or disburse any fees,
61966196 8 tuitions, charges, sales, endowments, trusts or income
61976197 9 therefrom, which are now or may hereafter be authorized to
61986198 10 receive, collect or disburse. The receiving college, school or
61996199 11 institution shall further maintain separate accounts for such
62006200 12 receipts or shall maintain a system of accounting which will
62016201 13 show a cash flow of such receipts received under the provision
62026202 14 of this appropriation.
62036203 15 Section 9. The appropriations made herein to the
62046204 16 departments, boards, offices, commissions, and agencies
62056205 17 include the amounts necessary and said departments, boards,
62066206 18 offices, commissions, and agencies are hereby directed to make
62076207 19 the transfer of funds to the State Personnel Department in the
62086208 20 amounts enumerated in the general appropriations act for the
62096209 21 fiscal year ending September 30, 2023. All agencies and
62106210 22 institutions enumerated in this act that receive services from
62116211 23 other governmental agencies enumerated in this act or the
62126212 24 general appropriations act shall make full payment in a timely
62136213 25 manner (as determined by the Department of Finance) for such
62146214 26 services.
62156215 Page 113 1 Section 10. All encumbered balances of a previous
62166216 2 fiscal year appropriation other than the exclusions authorized
62176217 3 by the Code of Alabama 1975, Section 41-4-93, shall lapse no
62186218 4 later than September 30 of the fiscal year immediately
62196219 5 following the fiscal year for which the appropriation was made
62206220 6 and shall revert to the credit of the Education Trust Fund or
62216221 7 earmarked fund from which the appropriation or appropriations
62226222 8 were made.
62236223 9 Section 11. Upon certification to the Director of
62246224 10 Finance by the State Attorney General that a federal court has
62256225 11 ordered the State of Alabama to pay claims, attorney fees, or
62266226 12 other costs relating to said court order, funds are hereby
62276227 13 appropriated to the affected department, board, bureau, or
62286228 14 commission in the amount necessary to satisfy that court
62296229 15 order. Such appropriations are in addition to any other
62306230 16 appropriation heretofore or hereafter made in this
62316231 17 appropriation act. Such appropriations are conditioned upon
62326232 18 the availability of funds and a determination by the Director
62336233 19 of Finance that other current appropriations are not available
62346234 20 for court-ordered payments.
62356235 21 Section 12. Local boards of education may exercise
62366236 22 flexibility among line item expenditures, not to create a
62376237 23 reduction of earned teacher units and/or local board of
62386238 24 education support personnel.
62396239 25 Section 13. The State Superintendent of Education
62406240 26 may approve a request by a local board of education for
62416241 27 redirecting Other Current Expense funds designated for
62426242 Page 114 1 pass-through calculations to their local Child Nutrition
62436243 2 Program if the redirected funds do not prevent the Child
62446244 3 Nutrition Program of that local board of education from
62456245 4 maintaining a one-month fund balance.
62466246 5 Section 14. The appropriations made herein to the
62476247 6 departments, boards, offices, commissions and agencies include
62486248 7 the amounts necessary to pay the State Employees' Insurance
62496249 8 Board (SEIB). The SEIB rate shall be $930 per month for each
62506250 9 full-time employee for the fiscal year ending September 30,
62516251 10 2023. The State Employees' Insurance Board will adjust the
62526252 11 insurance program wherever appropriate to maintain the
62536253 12 aforementioned fixed rate.
62546254 13 Section 15. Notwithstanding any other provisions of
62556255 14 this act or any other act, any amount from appropriations for
62566256 15 the fiscal year ending September 30, 2022 to the various state
62576257 16 agencies and institutions in this act, including
62586258 17 appropriations from the Education Trust Fund, which are
62596259 18 unexpended and reverted on September 30, 2022 are hereby
62606260 19 reappropriated to the respective state agencies, offices and
62616261 20 institutions for the fiscal year beginning October 1, 2022.
62626262 21 Section 16. (a) The At-Risk and High Hopes
62636263 22 appropriations made to the State Department of Education shall
62646264 23 be expended as follows: 50% shall be at the discretion of the
62656265 24 State Superintendent of Education and 50% shall be awarded in
62666266 25 the form of grants to school systems/entities for activities
62676267 26 or programs designed to enhance outcomes for At-Risk Students.
62686268 27 At-Risk Students shall be defined as students who have not met
62696269 Page 115 1 proficiency standards for state accountability assessments and
62706270 2 one or more of the following apply: the student attends a
62716271 3 Title I school; qualifies for free or reduced lunch; qualifies
62726272 4 for special education or Tier III intervention; or is an
62736273 5 English language learner. In the awarding of grants,
62746274 6 preference will be given to undertakings that will directly
62756275 7 impact student achievement and improve performance on state
62766276 8 assessments to include remediation for students, after-school
62776277 9 and tutorial programs, career/technical programs, character
62786278 10 education, enrichment activities, programs that enhance
62796279 11 reading and mathematics abilities in students, activities that
62806280 12 increase grade-to-grade promotion, career and college
62816281 13 readiness and early warning and prevention programs. Programs
62826282 14 must employ evidence-based practices and measure student
62836283 15 growth and achievement using research-based norms and
62846284 16 criterion. Funds should be awarded on a per-pupil basis, with
62856285 17 no more than ten percent of the grant award going toward
62866286 18 personnel costs.
62876287 19 (b) In an effort to provide the best and most
62886288 20 efficient implementation for intervention and innovation in
62896289 21 schools, administration of the grant awards shall be assigned
62906290 22 to the Alabama State Department of Education's Division of
62916291 23 Administrative and Financial Support with evaluative input
62926292 24 from other Alabama State Department of Education advisory
62936293 25 personnel, including the State Superintendent of Education, as
62946294 26 appropriate. The grant application process must require
62956295 27 districts to submit plans to the Alabama State Department of
62966296 Page 116 1 Education detailing their intended use of the grant funds with
62976297 2 regard to student proficiency and growth. Grants may be
62986298 3 awarded any time after July 1st so schools can prepare for the
62996299 4 new school year. Notwithstanding the foregoing, the Alabama
63006300 5 State Department of Education's Division of Administrative and
63016301 6 Financial Support shall make every reasonable effort to notify
63026302 7 grant recipients of awards by August 1, 2022. No funding will
63036303 8 be available until October 1, 2022. Grantees will have no
63046304 9 guarantee of funding until October 1, 2022.
63056305 10 (c) Upon the awarding of any grant funds, the
63066306 11 Alabama State Department of Education must submit a report to
63076307 12 the Chairs of the House Ways and Means-Education Committee,
63086308 13 the Senate Committee on Finance and Taxation-Education and the
63096309 14 Legislative Fiscal Officer that shall indicate the
63106310 15 grant-recipient districts and each district’s plan for those
63116311 16 funds. Those districts shall submit follow-up reports
63126312 17 indicating the results of those plans from the previous school
63136313 18 year by July 31, 2023.
63146314 19 Section 17. All nongovernmental entities, identified
63156315 20 by the Legislative Services Agency, which are allocated funds
63166316 21 in Section 3 of this act shall file a report with the Chair of
63176317 22 the House Ways and Means-Education Committee, the Chair of the
63186318 23 Senate Committee on Finance and Taxation-Education, the
63196319 24 Finance Director, and the Legislative Fiscal Officer regarding
63206320 25 the proposed expenditures and usage of the funds appropriated
63216321 26 in the fiscal year ending September 30, 2023.
63226322 Page 117 1 Section 18. If any section, paragraph, sentence,
63236323 2 clause, provision or portion of this act or all or any portion
63246324 3 of the appropriations herein made is held unconstitutional or
63256325 4 invalid, it shall not affect any other section, paragraph,
63266326 5 sentence, clause, provision or portion of this act or any
63276327 6 other appropriation or appropriations or portion thereof
63286328 7 hereby made not in and of itself unconstitutional or invalid.
63296329 8 Section 19. All laws or parts of laws, general,
63306330 9 special, private or local in conflict with or inconsistent
63316331 10 with the provisions of this act are hereby expressly repealed.
63326332 11 Section 20. This act shall become effective on
63336333 12 October 1, 2022.
