1515 8 SYNOPSIS: Under existing law, with certain exceptions,
1616 9 low-speed vehicles, including golf carts, may not
1717 10 operate on the public roads of this state.
1818 11 This bill would propose an amendment to the
1919 12 Constitution of Alabama of 1901, to authorize the
2020 13 Shelby County Commission and municipalities within
2121 14 the county to authorize and regulate the use of
2222 15 low-speed vehicles, including many golf carts, on
2323 16 certain public roads.

2929 22 Relating to Shelby County; to propose an amendment
3030 23 to the Constitution of Alabama of 1901, to authorize the
3131 24 Shelby County Commission and municipalities within the county
3232 25 to authorize the use of low-speed vehicles on certain public
3333 26 roads.
3434 27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3535 Page 1 1 Section 1. The following amendment to the
3636 2 Constitution of Alabama of 1901, is proposed and shall become
3737 3 valid as a part of the Constitution when all requirements of
3838 4 this act are fulfilled:
3939 5 PROPOSED AMENDMENT
4040 6 (a) As used in this amendment, the term "low-speed
4141 7 vehicle" means a four-wheeled motor vehicle with a top speed
4242 8 of not greater than 25 miles per hour, which has a
4343 9 gross vehicle weight rating of less than 3,000 pounds, and is
4444 10 certified as complying with the applicable federal safety
4545 11 standards, including 49 C.F.R. ยง 571.500, as amended.
4646 12 (b)(1) The governing body of a municipality in
4747 13 Shelby County, by ordinance, may authorize and regulate the
4848 14 operation of low-speed vehicles on certain public roads within
4949 15 the corporate limits of the municipality, as determined by the
5050 16 governing body of the municipality.
5151 17 (2) The Shelby County Commission, by resolution, may
5252 18 authorize and regulate the operation of low-speed vehicles on
5353 19 certain public roads in the unincorporated portions of the
5454 20 county, as determined by the county commission.
5555 21 Section 2. An election upon the proposed amendment
5656 22 shall be held in accordance with Section 284.01 of the
5757 23 Constitution of Alabama of 1901, now appearing as Section
5858 24 284.01 of the Official Recompilation of the Constitution of
5959 25 Alabama of 1901, as amended, and the election laws of this
6060 26 state.

6262 2 assign a ballot number for the proposed constitutional
6363 3 amendment on the election ballot and shall set forth the
6464 4 following description of the substance or subject matter of
6565 5 the proposed constitutional amendment:
6666 6 "Relating to Shelby County, proposing an amendment
6767 7 to the Constitution of Alabama of 1901, to authorize the
6868 8 Shelby County Commission and municipalities within the county
6969 9 to authorize and regulate the use of low-speed vehicles,
7070 10 including certain golf carts, on certain public roads.
