15	15	8 SYNOPSIS: Under existing law, with certain exceptions,
16	16	9 low-speed vehicles, including golf carts, may not
17	17	10 operate on the public roads of this state.
18	18	11 This bill would propose an amendment to the
19	19	12 Constitution of Alabama of 1901, to authorize the
20	20	13 Shelby County Commission and municipalities within
21	21	14 the county to authorize and regulate the use of
22	22	15 low-speed vehicles, including many golf carts, on
23	23	16 certain public roads.

27	27	20 AN ACT

29	29	22 Relating to Shelby County; to propose an amendment
30	30	23 to the Constitution of Alabama of 1901, to authorize the
31	31	24 Shelby County Commission and municipalities within the county
32	32	25 to authorize the use of low-speed vehicles on certain public
33	33	26 roads.
34	34	27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
35	35	Page 1 1 Section 1. The following amendment to the
36	36	2 Constitution of Alabama of 1901, is proposed and shall become
37	37	3 valid as a part of the Constitution when all requirements of
38	38	4 this act are fulfilled:
39	39	5 PROPOSED AMENDMENT
40	40	6 (a) As used in this amendment, the term "low-speed
41	41	7 vehicle" means a four-wheeled motor vehicle with a top speed
42	42	8 of not greater than 25 miles per hour, which has a
43	43	9 gross vehicle weight rating of less than 3,000 pounds, and is
44	44	10 certified as complying with the applicable federal safety
45	45	11 standards, including 49 C.F.R. § 571.500, as amended.
46	46	12 (b)(1) The governing body of a municipality in
47	47	13 Shelby County, by ordinance, may authorize and regulate the
48	48	14 operation of low-speed vehicles on certain public roads within
49	49	15 the corporate limits of the municipality, as determined by the
50	50	16 governing body of the municipality.
51	51	17 (2) The Shelby County Commission, by resolution, may
52	52	18 authorize and regulate the operation of low-speed vehicles on
53	53	19 certain public roads in the unincorporated portions of the
54	54	20 county, as determined by the county commission.
55	55	21 Section 2. An election upon the proposed amendment
56	56	22 shall be held in accordance with Section 284.01 of the
57	57	23 Constitution of Alabama of 1901, now appearing as Section
58	58	24 284.01 of the Official Recompilation of the Constitution of
59	59	25 Alabama of 1901, as amended, and the election laws of this
60	60	26 state.
61	61	Page 2 1 Section 3. The appropriate election official shall
62	62	2 assign a ballot number for the proposed constitutional
63	63	3 amendment on the election ballot and shall set forth the
64	64	4 following description of the substance or subject matter of
65	65	5 the proposed constitutional amendment:
66	66	6 "Relating to Shelby County, proposing an amendment
67	67	7 to the Constitution of Alabama of 1901, to authorize the
68	68	8 Shelby County Commission and municipalities within the county
69	69	9 to authorize and regulate the use of low-speed vehicles,
70	70	10 including certain golf carts, on certain public roads.
