| 24 | 24 | | 18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

| 25 | 25 | | 19 Section 1. Sections 45-48-121.03 and 45-48-121.04 of |
|---|
| 26 | 26 | | 20 the Code of Alabama 1975, are amended to read as follows: |
|---|
| 27 | 27 | | 21 "§45-48-121.03. |
|---|
| 28 | 28 | | 22 "(a) There is hereby created the Personnel Board of |
|---|
| 29 | 29 | | 23 Marshall County, which shall be composed of five members. One |
|---|
| 30 | 30 | | 24 member shall be appointed by the county commission, three |
|---|
| 31 | 31 | | 25 members shall be appointed by the Marshall County Legislative |
|---|
| 32 | 32 | | 26 Delegation, and one shall be elected by the county employees |
|---|
| 33 | 33 | | 27 who will be are subject to this part. All appointments to the |
|---|
| 34 | 34 | | Page 1 1 board shall be made within 30 days. One of the members |
|---|
| 35 | 35 | | 2 originally so appointed shall serve for a term of two years, |
|---|
| 36 | 36 | | 3 one for a term of three years, one for a term of four years, |
|---|
| 37 | 37 | | 4 one for a term of five years, and one for a term of six years. |

| 38 | 38 | | 5 The original members of the board so appointed shall draw lots |
|---|
| 39 | 39 | | 6 to determine the length of term each shall serve. Thereafter, |
|---|
| 40 | 40 | | 7 all members shall serve for terms of six years each, and until |
|---|
| 41 | 41 | | 8 their respective successors are appointed as specified |
|---|
| 42 | 42 | | 9 provided above. Any The elected member of the board whose term |

| 44 | 44 | | 11 reelection, but for no more than two full terms. The appointed |

| 46 | 46 | | 13 "(b) No person shall be appointed to the board |

| 47 | 47 | | 14 unless he or she is of recognized good character and ability, |
|---|
| 48 | 48 | | 15 and is an actual resident in and qualified elector of the |
|---|
| 49 | 49 | | 16 county. No person shall be eligible to appointment or shall |
|---|
| 50 | 50 | | 17 continue to be a member of a board created under this part who |
|---|
| 51 | 51 | | 18 holds an elective office under the state, county, or any city |
|---|
| 52 | 52 | | 19 therein, or who is a candidate for elective office. Vacancies |
|---|
| 53 | 53 | | 20 on the board shall be filled for the unexpired terms in the |
|---|
| 54 | 54 | | 21 same manner as original appointments are made. Following the |
|---|
| 55 | 55 | | 22 initial appointment of the board, the board shall within 15 |
|---|
| 56 | 56 | | 23 days convene and The board shall elect a chair from among its |
|---|
| 57 | 57 | | 24 members, who shall preside at its meetings. Three members |
|---|
| 58 | 58 | | 25 shall constitute a quorum for the transaction of any business |
|---|
| 59 | 59 | | 26 which may properly come before the board. Each person so |
|---|
| 60 | 60 | | 27 appointed, within 15 days after appointment, shall qualify by |
|---|
| 61 | 61 | | Page 2 1 making oath (which shall be recorded as provided by law) that |
|---|
| 62 | 62 | | 2 he or she will faithfully execute the duties of office to the |
|---|
| 63 | 63 | | 3 best of his or her ability and knowledge. The board shall |
|---|
| 64 | 64 | | 4 adopt reasonable rules regulating the procedure of the board. |
|---|
| 65 | 65 | | 5 Notice of all meetings of the board shall be given to each |
|---|
| 66 | 66 | | 6 member by the secretary of the board. The personnel board is |
|---|
| 67 | 67 | | 7 authorized and may employ clerical assistants, personnel |
|---|
| 68 | 68 | | 8 officers, and engage legal counsel. |

| 70 | 70 | | 10 "Each member of the board shall be paid an expense |
|---|
| 71 | 71 | | 11 allowance of one hundred dollars ($100) two hundred dollars |
|---|
| 72 | 72 | | 12 ($200) per month by the Marshall County Commission." |

| 73 | 73 | | 13 Section 2. This act shall become effective on the |
|---|
| 74 | 74 | | 14 first day of the third month following its passage and |
|---|
| 75 | 75 | | 15 approval by the Governor, or its otherwise becoming law. |
