1919 13 Relating to Marshall County; to amend Sections
2020 14 45-48-121.03 and 45-48-121.04 of the Code of Alabama 1975,
2121 15 relating to the Personnel Board of Marshall County; to further
2222 16 provide for the appointment and expense allowance of members
2323 17 of the board.
2424 18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2525 19 Section 1. Sections 45-48-121.03 and 45-48-121.04 of
2626 20 the Code of Alabama 1975, are amended to read as follows:
2727 21 "§45-48-121.03.
2828 22 "(a) There is hereby created the Personnel Board of
2929 23 Marshall County, which shall be composed of five members. One
3030 24 member shall be appointed by the county commission, three
3131 25 members shall be appointed by the Marshall County Legislative
3232 26 Delegation, and one shall be elected by the county employees
3333 27 who will be are subject to this part. All appointments to the
3434 Page 1 1 board shall be made within 30 days. One of the members
3535 2 originally so appointed shall serve for a term of two years,
3636 3 one for a term of three years, one for a term of four years,
3737 4 one for a term of five years, and one for a term of six years.
3838 5 The original members of the board so appointed shall draw lots
3939 6 to determine the length of term each shall serve. Thereafter,
4040 7 all members shall serve for terms of six years each, and until
4141 8 their respective successors are appointed as specified
4242 9 provided above. Any The elected member of the board whose term
4343 10 shall expire expires shall be eligible for reappointment
4444 11 reelection, but for no more than two full terms. The appointed
4545 12 members of the board shall be eligible for reappointment.
4646 13 "(b) No person shall be appointed to the board
4747 14 unless he or she is of recognized good character and ability,
4848 15 and is an actual resident in and qualified elector of the
4949 16 county. No person shall be eligible to appointment or shall
5050 17 continue to be a member of a board created under this part who
5151 18 holds an elective office under the state, county, or any city
5252 19 therein, or who is a candidate for elective office. Vacancies
5353 20 on the board shall be filled for the unexpired terms in the
5454 21 same manner as original appointments are made. Following the
5555 22 initial appointment of the board, the board shall within 15
5656 23 days convene and The board shall elect a chair from among its
5757 24 members, who shall preside at its meetings. Three members
5858 25 shall constitute a quorum for the transaction of any business
5959 26 which may properly come before the board. Each person so
6060 27 appointed, within 15 days after appointment, shall qualify by
6161 Page 2 1 making oath (which shall be recorded as provided by law) that
6262 2 he or she will faithfully execute the duties of office to the
6363 3 best of his or her ability and knowledge. The board shall
6464 4 adopt reasonable rules regulating the procedure of the board.
6565 5 Notice of all meetings of the board shall be given to each
6666 6 member by the secretary of the board. The personnel board is
6767 7 authorized and may employ clerical assistants, personnel
6868 8 officers, and engage legal counsel.
6969 9 "§45-48-121.04.
7070 10 "Each member of the board shall be paid an expense
7171 11 allowance of one hundred dollars ($100) two hundred dollars
7272 12 ($200) per month by the Marshall County Commission."
7373 13 Section 2. This act shall become effective on the
7474 14 first day of the third month following its passage and
7575 15 approval by the Governor, or its otherwise becoming law.
