1 SB61 2 214368-1 3 By Senator Scofield (N & P) 4 RFD: Local Legislation 5 First Read: 11-JAN-22 Page 0 1 214368-1:n:05/26/2021:FC/ma LSA2021-1431 2 3 4 5 6 7 8 9 A BILL 10 TO BE ENTITLED 11 AN ACT 12 13 Relating to the City of Albertville in Marshall 14 County; to authorize the City Council of the City of 15 Albertville by ordinance to establish and regulate the 16 operation of entertainment districts; and to authorize the 17 city council to provide penalties for violations. 18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 19 Section 1. This act is adopted pursuant to the 20 authority in subdivision (31) of Section 104 of the 21 Constitution of Alabama of 1901. 22 Section 2. (a) The City Council of the City of 23 Albertville by ordinance may provide for the establishment of 24 an entertainment district or districts in the city. The number 25 and boundaries of any entertainment district shall be defined 26 in the ordinance. The ordinance of the city council shall 27 regulate hours of operation of an entertainment district and Page 1 1 may regulate the type of licenses authorized to operate as a 2 part of the entertainment district. The ordinance may provide 3 for the revocation of the entertainment district designation 4 and may regulate any other aspect of the operation of the 5 entertainment district. 6 (b) A retail licensee of the Alabama Alcoholic 7 Beverage Control Board, licensed to sell alcoholic beverages 8 for on-premises consumption located in an entertainment 9 district, may be authorized to obtain an entertainment 10 district permit subject to the provisions of the ordinance. 11 Notwithstanding any other provision of law, any licensee that 12 receives an entertainment district permit shall comply with 13 all laws and rules governing its license, except that patrons, 14 guests, or members of the licensee may exit the licensed 15 premises with open containers of alcoholic beverages anywhere 16 within the confines of the entertainment district, but they 17 may not enter the premises of another licensee with open 18 containers or closed containers of alcoholic beverages 19 acquired elsewhere. In addition, the ordinance shall prohibit 20 a person, other than a retail licensee, from possessing or 21 bringing in the entertainment district an open or closed 22 container of alcoholic beverages acquired outside of the 23 entertainment district during the hours of operation of the 24 entertainment district. 25 (c) The ordinance of the city council shall be 26 enforced by the City of Albertville and shall provide Page 2 1 penalties for violations of the ordinance as otherwise 2 authorized by law. 3 Section 3. All laws or parts of laws which conflict 4 with this act are repealed. 5 Section 4. This act shall become effective 6 immediately following its passage and approval by the 7 Governor, or its otherwise becoming law. Page 3
