1 SB61 2 214368-2 3 By Senator Scofield (N & P) 4 RFD: Local Legislation 5 First Read: 11-JAN-22 Page 0 SB61 1 SB61 2 3 4 With Notice and Proof 5 6 ENROLLED, An Act, 7 Relating to the City of Albertville in Marshall 8 County; to authorize the City Council of the City of 9 Albertville by ordinance to establish and regulate the 10 operation of entertainment districts; and to authorize the 11 city council to provide penalties for violations. 12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 13 Section 1. This act is adopted pursuant to the 14 authority in subdivision (31) of Section 104 of the 15 Constitution of Alabama of 1901. 16 Section 2. (a) The City Council of the City of 17 Albertville by ordinance may provide for the establishment of 18 an entertainment district or districts in the city. The number 19 and boundaries of any entertainment district shall be defined 20 in the ordinance. The ordinance of the city council shall 21 regulate hours of operation of an entertainment district and 22 may regulate the type of licenses authorized to operate as a 23 part of the entertainment district. The ordinance may provide 24 for the revocation of the entertainment district designation Page 1 SB61 1 and may regulate any other aspect of the operation of the 2 entertainment district. 3 (b) A retail licensee of the Alabama Alcoholic 4 Beverage Control Board, licensed to sell alcoholic beverages 5 for on-premises consumption located in an entertainment 6 district, may be authorized to obtain an entertainment 7 district permit subject to the provisions of the ordinance. 8 Notwithstanding any other provision of law, any licensee that 9 receives an entertainment district permit shall comply with 10 all laws and rules governing its license, except that patrons, 11 guests, or members of the licensee may exit the licensed 12 premises with open containers of alcoholic beverages anywhere 13 within the confines of the entertainment district, but they 14 may not enter the premises of another licensee with open 15 containers or closed containers of alcoholic beverages 16 acquired elsewhere. In addition, the ordinance shall prohibit 17 a person, other than a retail licensee, from possessing or 18 bringing in the entertainment district an open or closed 19 container of alcoholic beverages acquired outside of the 20 entertainment district during the hours of operation of the 21 entertainment district. 22 (c) The ordinance of the city council shall be 23 enforced by the City of Albertville and shall provide 24 penalties for violations of the ordinance as otherwise 25 authorized by law. Page 2 SB61 1 Section 3. All laws or parts of laws which conflict 2 with this act are repealed. 3 Section 4. This act shall become effective 4 immediately following its passage and approval by the 5 Governor, or its otherwise becoming law.
