13-6 ENROLLED, An Act,
14-7 Relating to Marshall County; to authorize the
15-8 Sheriff of Marshall County to establish procedures to make
16-9 limited purchases using a credit or debit card, provided
17-10 compliance with required accountability and audit measures and
18-11 other procedures are followed.
19-12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20-13 Section 1. (a) This act shall apply only to Marshall
21-14 County.
22-15 (b) For purposes of this act, the following words
23-16 have the following meanings:
24-17 (1) CREDIT CARD. A line of credit issued by a
25-18 domestic lender or credit card bank.
26-19 (2) DEBIT CARD. A card issued by a bank in relation
27-20 to a checking or savings account held by the Marshall County
28-21 Sheriff's Office.
29-22 (c) To provide for convenience in making purchases
30-23 of tangible personal property or services approved by the
31-24 sheriff, the Sheriff of Marshall County may establish
32-25 procedures to make certain purchases from funds under the

34-1 control of the sheriff through use of a credit or debit card
35-2 issued to the Marshall County Sheriff's Office.
36-3 (d) The sheriff may adopt written policy and
37-4 procedures governing the use of credit or debit cards which,
38-5 at a minimum, include each of the following:
39-6 (1) A monetary limit on the amount of any individual
40-7 purchase which may be made with a credit or debit card.
41-8 (2) A monetary limit on the total monthly amount
42-9 that may be purchased with a credit or debit card taking into
43-10 consideration the monetary limit of the discretionary fund
44-11 used.
45-12 (3) Procedures to ensure that the sheriff or his or
46-13 her designee has sole access to any credit or debit card,
47-14 credit or debit card numbers, access codes, or security codes.
48-15 (4) Procedures to keep accurate records of all
49-16 purchases made with a credit or debit card which shall be
50-17 periodically reviewed during required audits.
51-18 (5) Procedures to ensure that all credit or debit
52-19 card bills are carefully reviewed by the sheriff each month to
53-20 make sure that no unauthorized charges appear on the bill.
54-21 (6) Procedures to ensure that all credit or debit
55-22 card bills are paid in full on a timely basis each month to
56-23 avoid service charges, late fees, or interest payments.

6063 3 the following:
6164 4 (1) Whether the credit or debit card issuer requires
6265 5 an annual fee for using the card.
6366 6 (2) Whether the credit or debit card issuer offers
6467 7 rewards or rebates based upon purchases made using the
6568 8 account.
6669 9 (3) What interest rates, service charges, finance
6770 10 charges, or late fees will be assessed in the event a bill
6871 11 from the credit or debit card issuer is paid late or the
6972 12 balance is not paid in full.
7073 13 (4) Whether penalties or fees will be assessed
7174 14 against the sheriff in the event he or she decides to
7275 15 terminate the credit or debit card.
7376 16 (5) Any other consideration deemed relevant by the
7477 17 sheriff.
7578 18 (f) In the event the credit or debit card provides
7679 19 rewards or rebates based upon the use of the card, any rewards
7780 20 or rebates earned from the card or cards shall be deposited in
7881 21 the Sheriff's Discretionary Fund of Marshall County.
7982 22 Section 2. This act shall become effective
8083 23 immediately following its passage and approval by the
8184 24 Governor, or its otherwise becoming law.
